Laurie L. Fraser, being duly sworn, deposes and states
that:
1. On February 1, 2008, a joint tenancy warranty deed was
recorded as Instrument No. 20080428, and a deed of trust was
recorded as Instrument No. 20080429, in the office of the
Register of Deeds of Adams County, Nebraska. Said deed conveyed
the real estate described as:
Lot Five A (5 A), in the Replat of Lots Five (5) and Six
(6), Block Thirty-Two (32), St. Joseph's Addition to the
City of Hastings, Adams County, Nebraska, according to the
recorded plat thereof
to Phillip W. VanPatter and Laurie Banza-VanPatter, husband and
wife. Said deed of trust was executed by Phil VanPatter and
Laurie VanPatter, husband and wife.
2. Affiant states that Phillip W. VanPatter and Phil
VanPatter are one and the same person notwithstanding the
discrepancy in names, and Laurie Banza-VanPatter and Laurie
VanPatter are one and the same person notwithstaning the
discrepancy in names.
