Himmelberg (Developer) are parties to a Utility Annexation Transition Agreement executed by them on the 28th day of December 1995, granting to Hastings Utilities an interest in Commencing at a point 605.36 feet North of the Southwest corner of the North Half (Nl/2) of fractional Section Nineteen (19), Township Seven (7) North, Range Nine (9) West of the 6th P.M., Adams County, Nebraska, running thence East parallel with the South line of said North Half (Nl/2) of said Section 230 feet; thence South parallel with West line of said Section 140 feet; thence West parallel with said South line of said North Half (Nl/2) 230 feet; and thence North on the West line of said Section to the place of commencement, more commonly known as 1695 S. Wabash Ave., subject to statutory road on the West of said tract and to any easements of record, and, WHEREAS, a construction lien was filed under the provisions of the Utility Annexation Transition Agreement as Instrument No. 961151 against, Commencing at a point 605.36 feet North of the Southwest corner of the North Half (Nl/2) of fractional Section Nineteen (19), Township Seven (7) North, Range Nine (9) West of the 6th P.M., Adams County, Nebraska, running thence East parallel with the South line of said North Half (N1/2) of said Section 230 feet; thence South parallel with West line of said Section 140 feet; thence West parallel with said South line of said North Half (Nl/2) 230 feet; and thence North on the West line of said Section to the place of commencement, more commonly known as 1695 S. Wabash Ave., subject to statutory road on the West of said tract and to any easements of record, and, WHEREAS, Wayne F. Himmelberg and Sandra K. Himmelberg, has completed improvements upon the said parcel in accordance with the provisions of the said Contracts; NOW, THEREFORE, Hastings Utilities hereby releases its interest resulting from the Construction Lien filed as Instrument No. 961151 against, Commencing at a point 605.36 feet North of the Southwest corner of the North Half (Nl/2) of fractional Section Nineteen (19), Township Seven (7) North, Range Nine (9) West of the 6th P.M., Adams County, Nebraska, running thence East parallel with the South line of said North Half (Nl/2) of said Section 230 feet; thence South parallel with West line of said Section 140 feet; thence West parallel with said South line of said North Half (Nl/2) 230 feet; and thence North on the West line of said Section to the place of commencement, more commonly known as 1695 S.
