ORDINANCE N0.4159
AN ORDINANCE OF THE CITY OF HASTINGS, NEBRASKA, TO EXTEND
THE BOUNDARIES AND INCLUDE WITHIN THE CORPORATE LIMITS OF AND
ANNEX TO THE CITY OF HASTINGS, NEBRASKA CERTAIN CONTIGUOUS AND
ADJACENT LANDS OUTSIDE OF THE CITY OF HASTINGS, ADAMS COUNTY,
NEBRASKA; AND TO PROVIDE FOR SERVICE BENEFITS THERETO.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
HASTINGS, NEBRASKA:
SECTION 1. It is hereby found and determined by the City Council of the City of
Hastings, Nebraska:
a) The tracts streets and roadways located outside of Hastings, Adams County,
Nebraska, as hereinafter more particularly described, are urban and suburban in
character and are contiguous and adjacent to the corporate limits of the City of
Hastings, Nebraska;
b) Police, fire, and snow removal benefits currently available to residents of the City
will be immediately available thereto, and other City services are or will be
available as provided by law;
c) Customers of the City's utility services within the annexed areas, will have the
benefit of rates applicable to users of such services within the current City limits;
and
d) There is a unity of interest of the use of such tracts with the use of lots and tracts
in such City and the community of convenience and welfare and the interest of
such City will be enhanced through incorporating such lots and tracts and streets
within the limits of such City.
SECTION 2. That the boundaries of the City of Hastings, Nebraska, be and hereby are
extended to include within the corporate limits of such City the adjacent and contiguous lands
located outside of the City of Hastings, Adams County, Nebraska, more particularly described as
follows:
The following Legal Description is located in the Southeast corner
of the Northeast Quarter East of Verge Subdivision, The Northwest
Quarter of Section 9 East of Verge Subdivision, The Northeast and
Southeast Quarters of Section 9 lying Southwesterly of the
Northeasterly Right - of -Way line of the Burlington Northern/Sante
Fe Railroad, The South 33 feet of the East 1,030.13 feet (East 12~
Street) of the Southwest Quarter of Section 4, The West 33 feet of the

Beginning at the point of intersection of the Center line of East 7~'
Street with the Southeasterly line of Verge Subdivision, an Addition to
the City of Hastings, said point being 137.79 feet West of the Quarter
corner common to Sections 8 and 9 in T7N, R9W of the 6`~ P.M.,
Adams County, Nebraska, said Southeasterly line being the existing
Corporation line; Thence Northeasterly along the said Southeasterly
line of Verge Subdivision (existing Corporation line} a distance of
3,174.71 feet more or less to the point of intersection with the Westerly
100 foot Right - of -Way line of the Union Pacific Railroad; Thence

2,642.41 feet more or less to the Center of said Section, said point

Beginning.
Containing a calculated Area of 276.36 Acres more or less.
SECTION 3. That a certified copy of this Ordinance, together with a plat of such
lands as acquired from the records of the County, if applicable, shall be filed of recorded in
the Office of the Register of Deeds of Adams County, Nebraska.
SECTION 4. That such lands are hereby annexed to the City of Hastings, Adams
County, Nebraska. In cases of incremental annexation, local sales and use tax is effective in
the entire area as determined by the Local Option Revenue Act and is not affected by the
phase-in of property tax values.
SECTION 5. That upon this Ordinance taking effect, police, fire and snow
removal services of the Ciry shall be furnished to the lands hereinbefore annexed, and other
City services are or will be available as provided by law, and the plan prepared in connection

with this annexation; and the City rates for water and electricity furnished by Hastings Utilities
shall apply to such lots and tracts.
SECTION 6. This Ordinance shall take effect and be in full force from and after
its passage, approval, and publication or posting as required by law, in its entirety or in
pamphlet form, as the case may be, said effective date being February 13 , 2008
SECTION 7. The provision of this Ordinance are separable, and the invalidity of
any phrase, clause, or part of this Ordinance shall not affect the validity or effectiveness of the
remainder of this Ordinance.
