HomeMy WebLinkAboutSP01-05-10COURTHOUSE HASTINGS NEBRASKA Tuesday, January 5, 2010 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Neumann, Hynes Orthmann, Saathoff and Woodman. District Five seat, vacant. Motion by Saathoff, seconded by Orthmann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. District Five seat, vacant. The Chairman announced the locations of the open meetings law and agendas in the room. Minutes of the previous meeting were approved as circulated. Orthmann had no report. Neumann attended the Planning meeting on January 4th and reported that the next Planning workshop with the JEO consultant will be January 25th at the ACOB at 6:00 PM. He also attended the Buildings and Grounds Committee meeting this morning. He also told the Board that on January 13th the South Heartland will be having a ribbon cutting at 2:00 PM and an open house of their new facility from 2:00 to 5:00 PM. Hynes attended the Roads Committee meeting this morning. Saathoff attended the Hastings Utilities dinner on December 15th, a Chamber meeting on the 16th , an Ag Business meeting on the17th, and a Senior Action meeting on the 21st and an Advisory Committee meeting of Mid NE Individual Services on the 29th. Kehoe stated that he thought there would be a City/County Committee meeting on January 13th but has not been advised of it as yet. He attended the Buildings and Grounds Committee meeting this morning. Woodman had three conversations with Joe Patterson, City Administrator about snow removal around the Courthouse. Fifth Street is not on the City Emergency Snow Route and the Mayor & City Council have to pass a resolution to include it on the Emergency Route, however, he did agree to have Fifth Street cleaned so deputies could get out for emergencies. He also attended the Roads Committee meeting this morning. During the public comments portion of the meeting, Beth Miracel, Extension Agent, presented the Board with a fruit basket thanking them for their consideration of the employees’ safety in closing the county offices during the Christmas blizzard. Motion by Orthmann, seconded by Kehoe that there being no further business, we declare this Board adjourned sine die and appoint the County Clerk as temporary Chairperson. Roll call, ayes: Kehoe, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. District Five seat, vacant. Clerk Lewis asked for nominations from the Board for Chairman for 2010. Motion by Neumann, seconded by Orthmann to nominated Larry Woodman for Chairman of the Board for 2010. Roll call, ayes: Kehoe, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none District Five seat, vacant. Woodman resumed chairmanship of the Board. Motion by Saathoff, seconded by Kehoe to nominate Neumann as Vice Chairman for 2010. Motion by Hynes, seconded by Neumann to name the following banks as Adams County depositories: Wells Fargo, Heritage Bank, Hastings State bank, Adams County Bank, Nebraska Public Agency Investment Trust (NPAIT), Five Points Bank, US Bank, Geneva State Bank and Bank of Doniphan. Roll call, ayes: Kehoe, Neumann, Hynes, Orthmann, Saathoff and Woodman,. Nays, none. District Five seat, vacant. Motion by Orthmann, seconded by Saathoff to authorize the County Treasurer to deposit funds in local banks: Up to $2,500,000.00 in Wells Fargo Bank; up to $6,000,000.00 in Heritage Bank; up to $1,350,000.00 in Hastings State bank; up to $2,775,000.00 on Adams County Bank, up to $6,000,000.00 in Nebraska Public Agency Investment Trust (NPAIT); up to $6,000,000.00 in Five Points Bank; up to $1,500,000.00 in Bank of Doniphan; up to $1,000,000.00 in US Bank and up to $1,000,000.00 in Geneva State Bank. Motion by Kehoe, seconded by Hynes to give consent to the County Treasurer to deposit up to 100% of capital stock and surplus in any of the depository banks named and said deposits to be protected by bonds and securities as required by law. Motion by Saathoff to designate the Hastings Tribune as the legal newspaper for Adams County. Roll call, ayes: Kehoe, Neumann, Hynes, Orthmann, Saathoff ad Woodman. Nays, none. District Five seat, vacant. Dee Haussler, Economic Development director, appeared to make a request of the Board to release several properties from County Industrial Areas. Motion by Saathoff, seconded by Neumann to release in 20% increments the following properties from the County Industrial Areas West and North: Central Logistics, first 20%; ECHO Co, third 20%; L & H Mfg, third 20%; Van Diest Supply Co, fourth 20%; Pepsi Cola Bottling Co, fourth 20%; Eaton Corp, fourth 20%; Nebraska Cold Storage, fourth 20% and AGP the fifth and final 20%. Roll call, ayes: Kehoe, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. District Five seat, vacant. Saathoff brought forth a discussion regarding not accepting out of county checks for payment of drivers licenses from residents in the Adams County who own property & pay taxes in Adams County. He stated that he had 2 complaints in the past 6 months. He wants the Treasurer’s office to accept out of county checks from property owners in the county or make it cash only for all customers getting drivers licenses here. Woodman stated that he knows the policy of the Treasurer does make some people angry. Neumann stated that by making it a cash only policy everyone would be angry. Treasurer Bev Davis explained that this policy had been implemented when the state made it legal for a Nebraska resident to get their drivers license in any county of the state. She reported that they were receiving bad checks for person getting commercial drivers licenses and then not being able to collect on them. She stated that it costs the County money when they can’t collect. Her staff does tell those persons with out of county banks that they have the option to pay with credit or debit cards or there is an ATM machine across the street.. Motion by Saathoff to accept cash only for driver’s licenses in the Treasurer’s office. Woodman called three times for a second to the motion and none was ever received. The motion died for lack of a second. Davis also asked the Board to approve the release and replacement of a security pledge from Hastings State Bank. Motion by Orthmann, seconded by Hynes to approve the release of a $350,000.00 pledge # 36202FAE6 from Hastings State Bank. Roll call, ayes: Kehoe, Neumann, Hynes, Orthmann, Saathoff and Woodman. Motion by Neumann, seconded by Saathoff to reappoint Eldon Orthmann and Becky Matticks to the Adams County Convention and Visitors Bureau Board for another term to expire June 2014 and appoint Eric Christensen to the Board also for a term to expire June 2014. Dawn Miller presented information regarding ARRA (stimulus funding) projects known as Juniata Southwest and Holstein South and contracts with the Nebraska Dept of Roads. Motion by Neumann, seconded by Hynes to approve and authorize the Chairman to sign the Resolution 10-01-05 and contract with the Nebraska Dept of Roads for project BRO-7001(14), Juniata Southwest. Motion by Saathoff, seconded by Neumann to approve and authorize the Chairman to sign the contract with Nebraska Dept of Roads for project STPE-2145(1) Holstein South. Neumann brought forward a discussion about making all county owned and leased properties tobacco free stating that it is the healthy and right thing to do. This policy would not be implemented until July in order to give employees the opportunity to adjust to it or to quit tobacco use. There was discussion of perhaps offering help to employees who choose to quit tobacco usage. There was also discussion regarding fines for those employees who violate the policy. There was some discussion about employees at the Roads Dept and the fact that they would have to walk quite some distance to be off of county owned property. Miller thought she probably would lose some employees if this became policy. County Clerk Lewis stated that she felt it should be an all or nothing policy with no exceptions or you defeat the purpose of promoting healthy living to the employees. It was decided the Board Personnel Committee should review policies of other counties and bring the discussion back to the Board at a later date. Motion by Kehoe, seconded by Saathoff to move to Executive Session for discussion of county burial request and contract personnel.
