A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Thomsen, Curtis,
Neumann, Hynes, Orthmann, Saathoff and Woodman.
Motion by Saathoff, seconded by Neumann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication
in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Thomsen,
Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
The Chairman announced the locations of the open meetings law and agendas in the room and also asked if there were any conflicts of interest with any agenda items.
Minutes of the previous meeting were approved as circulated.
Orthmann reported attending a meeting with Woodman and Kaleena Fong on the 15th, a meeting at Heartland Pet Connection on the 17th with Chip Volcek & Lynn Janosch, a meeting on the 23rd
with Jan Johnson about the telephone system, on the 22nd through the 24th he and Volcek met with NEMA for a check of inventory, also met with Volcek and persons in Phelps County and
had the Buildings and Grounds Committee meeting this morning.
Curtis attended the Central District meeting at the Grand Island interchange on the 17th, a Library Board meeting on the 28th and a meeting of the South Central Economic Development
District on the 31st.
Neumann attended a Wellness Committee meeting on the 16th and the Buildings and Grounds Committee meeting this morning.
Hynes attended a Roads Committee meeting after the Board meeting on the 15th, also met with the Roads Committee yesterday to open asphalt bids and the Roads Committee meeting this morning.
Saathoff attended the Central District meeting at the Grand Island interchange on the 17th, the Business After Hours where Governor Heinemann, Senator Utter and the State Ag Director
were present on the 18th, a Chamber Board meeting on the 23rd, an HEDC meeting, the opening of asphalt bids yesterday and the Roads Committee meeting this morning.
Thomsen met with Wendy Keele of the Hastings Alcohol & Substance Abuse Coalition on the 15th, met with Jan Johnson on the 22nd about the phone system and also met with Judy Mignery regarding
Planning and Zoning matters, the Planning Commission meeting last night and the Buildings and Grounds Committee meeting this morning.
Woodman met with Eldon Orthmann and Kaleena Fong on the 15th, a Roads Committee meeting on the 15th , met with the City about the Reuse grant, attended the Roads meeting yesterday to
open asphalt bids and the Roads Committee meeting this morning.
During public comments Audrey Lee, attorney from the County Attorney’s office told the Board that she has been researching EEOC regulations and the federal Genetic Information Act and
the tying of health insurance benefits to employee wellness. She also stated that anything the County offers for wellness opportunities needs to be available to ALL employees, even
those with physical limitations and Adams County has one employee who uses a wheel chair.
Motion by Neumann to move to Board of Equalization for motor vehicle exemption applications, discussion of Tax List Corrections by Assessor Hynes and Tax List Corrections. Roll call,
ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Board of Equalization at 9:45 AM.
Attorney Lee presented a grant application to the Board for approval.
Motion by Neumann, seconded by Saathoff to approve and authorize the Chairman to sign the Victim Witness grant application. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann,
Saathoff and Woodman. Nays, none.
At 10:00 Am Dawn Miller presented information regarding the bids for 4 asphalt projects. These were the bids that were opened by her and the Roads Committee on April 4th with representatives
from Werner Construction and Vontz Paving present. She stated that for Segment #4 Werner had failed to extend the unit prices and the total amount on the bid sheet. She stated that
the total was verbally given by the representative from Werner Construction. This amount was lower than Vontz’s bid. Miller told the Board that the ad for bids did state that the
Board has the right to wave any irregularities. Brad Vontz of Vontz Paving stated that the bid sheet states “…this will be a lump sum contract and the total contract amount will be
obtained by multiplying the Plan Quantities by the associated Unit Prices.” He also stated that he has lost contracts because of the error that Werner has made.
Motion by Neumann, seconded by Orthmann to move to Executive Session for contract negotiations regarding asphalt bids. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff
and Woodman. Nays, none. Entered Executive Session at 10:15. Also present were Dawn Miller and Phil Lorenzen of D A Davidson & Co, bond company.
Motion by Orthmann, seconded by Neumann to return to regular session. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Returned to regular
session at 10:34 AM.
Motion by Hynes, seconded by Thomsen to award asphalt bids to the low bidders as follows: Segment #1, Werner Construction; Segment #2, Vontz Paving; Segment #3, Werner Construction and
Segment #4, Werner Construction. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Phil Lorenzen of D A Davidson & Co , bonding company, presented information regarding issuing highway allocation bonds for the asphalt projects that were awarded. There was discussion
regarding the amount of bonds and the length of payment time. Lorenzen stated now is a good time to borrow with the interest rates as low as they currently are.
Motion by Hynes, seconded by Saathoff to approve consideration of highway allocation bonds in the amount of $3.5 million with Phil Lorenzen of D A Davidson & Co. Roll call, ayes: Thomsen,
Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Saathoff left the room at 11:05 AM.
Judy Mignery, Planning Administrator presented corrected resolutions for the vacation of Gronewold and DeMuth Subdivisions for Board approval.
Motion by Neumann, seconded by Hynes to approve and authorize the Chairman to sign correction of Resolution 11-03-15.4 for the DeMuth Subdivision vacation. Roll call, ayes: Thomsen,
Curtis, Neumann, Hynes, Orthmann, and Woodman. Nays, none. Saathoff, absent.
Motion by Hynes, seconded by Orthmann to approve and authorize the Chairman to sign correction of Resolution 11-03-15.3 for the Gronewold Subdivision vacation. Roll call, ayes: Thomsen,
Curtis, Neumann, Hynes, Orthmann and Woodman. Nays, none. Saathoff, absent.
Saathoff returned at 11:10 AM.
Motion by Curtis, seconded by Neumann to approve the Bell Subdivision, case 11-03.2, applicants Larry and Linda Nienheueser. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann,
Saathoff and Woodman. Nays, none.
Dawn Miller, Highway Superintendent, presented a resolution for a Certificate of Compliance for Soft Match credit for Board approval.
Motion by Saathoff, seconded by Orthmann to approve and authorize the Chairman to sign Resolution 11-04-05 for a Certificate of Compliance for Soft Match credit for BR-01435 (26th &
Pawnee Ave) project C1-219. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete resolution on file in the County Clerk’s office.
Miller also asked approval to seek sealed bids for a used Caterpillar motorgrader and also to authorize the Chairman to sign gravel contracts.
Motion by Neumann, seconded b y Hynes to declare a 2001 Caterpillar motorgrader, SN 2ZK05828 as surplus equipment and direct the Highway Superintendent to advertise for sealed bids for
purchase. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Motion by Hynes, seconded by Neumann to approve and authorize the Chairman to sign gravel contracts. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman.

Clerk Lewis read into the record the Certificate of Delivery and Acceptance from Windstream for the new telephone system.
Motion by Neumann, seconded by Thomsen to approve and authorize the Chairman to sign the Certificate of Delivery and Acceptance from Windstream for the new county telephone system.
Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Harold Johnson, Maintenance Supervisor, presented an amended grant application from the Dept of Energy.
Motion by Neumann, seconded by Thomsen to approve and authorize the Chairman to sign the amended grant application from the Dept of Energy. Roll call, ayes: Thomsen, Curtis, Neumann,
Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Clerk Lewis stated she has received bonds for Cottonwood and Denver Township clerks for approval.
Motion by Curtis, seconded by Orthmann to approve bonds for Cottonwood and Denver Township clerks. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman.

Motion by Hynes, seconded by Saathoff to accept officer’s reports for the month of March from District Court Clerk and Sheriff and the report of public sale of taxes by the Treasurer.

The Adams County Board of Supervisors met as a Board of Equalization for the purpose of hearing motor vehicle exemption applications, request by the Assessor to correct a Tax Correction
and new Tax List Corrections with Chairman, Larry Woodman, presiding. Roll call members present were: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Also present
were Attorney Lee, County Clerk Lewis, Assessor Hynes and Treasurer Davis.
Motion by Neumann, seconded by Curtis to approve motor vehicle exemption application for Hastings College for a 2010 Dodge Caravan. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes,
Orthmann, Saathoff and Woodman. Nays, none.
Assessor Hynes told the Board that she had mistakenly named the owner of property on two Tax List Corrections that were approved at the last Board of Equalization as City of Hastings
and the property owner should have been Rodney Davis.
Motion by Curtis, seconded by Thomsen to approve the change of ownership on two Tax List Corrections from the City of Hastings to Rodney Davis. Roll call, ayes: Thomsen, Curtis, Neumann,
Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Motion by Saathoff, seconded by Hynes to approve tax List Correction numbers 13802 through 13804. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman.
Nays, none.
Motion by Hynes, seconded by Orthmann to return to regular session. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Returned to regular
session at 9:55 AM.
