Home My WebLink AboutSP09-06-11COURTHOUSE HASTINGS NEBRASKA Tuesday, September 6, 2011 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Motion by Orthmann, seconded by Neumann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room and also asked if there were any conflicts of interest with any agenda items. Minutes of the previous meeting were approved as circulated. Orthmann attended a Community Action partnership Board meeting on the 18th, a meeting at Prairie Title regarding the Parde building on the 30th, a Midland Area Agency on Aging meeting on September 1st and the Buildings and grounds meeting this morning. Curtis attended a Library Board meeting on the 22nd, a Handbook Committee meeting on the 29th, an Extension luncheon at the state fair on the 31st, the NACO School of Excellence class on September 1st and an Extension Board meeting that same evening. Neumann attended the Buildings and Grounds Committee meeting this morning. They discussed the new light receptacles and the electrician projects cost savings of around two-thirds on our electric bill. He reported there is around $25,000.00 left in the grant funds and Harold Johnson is discussing the possibility of replacing windows in the Courthouse Annex. He also attended two CASA meetings. They are working on a grant to purchase the Lanning Dormitory to house young adult foster children who have aged out of the system but are left on the streets. He also attended the MAAA meeting on September 1st. Hynes attended the Roads Committee meeting this morning and the 30 year anniversary for Thermo King on September 1st. He and Woodman toured some county roads after that. Saathoff attended the Roads Committee meeting this morning, a Chamber Board meeting on the 24th and an HEDC meeting on the 25th. Thomsen attended an ASAAP meeting on the 16th, the closing on the Parde building on the 30th, met with Jan Johnson and Abbey Werkmeister of Verizon about the new cell phone plan and the Buildings and Grounds Committee meeting this morning. Woodman attended the meeting on the building closing on the 30th, the Thermo King anniversary and the roads tour on September 1st and the Roads Committee meeting this morning. Judy Mignery, Planning Administrator, appeared on behalf of Joyce Mangers of the City to ask the Board to accept dedication of streets and easements in Utecht Subdivision. This acceptance does not obligate the County to anything. Motion by Saathoff, seconded by Hynes to accept dedication of streets and easements in the Utecht Subdivision. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Dawn Miller, Highway Superintendent, presented a resolution for approval that would void a resolution passed and approved by the Board on June 14th. This resolution will never be approved by the Nebraska Dept of Roads and was presented to the Board for approval prior to acceptance by NDOR in the hope of speeding up the process. Motion by Neumann, seconded by Saathoff to approve and authorize the Chairman to sign Resolution 11-09-06.1 voiding a Resolution 11-06-14.2 passed by the Board on June 14, 2011. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County Clerk’s office. Miller also presented information regarding setting of fees to landowners for weed spraying and seed wheat cleaning. It was noted by the auditors that the County does not have any of these fees formally approved by the County Board. This will come back to the Board for formal adoption at the next meeting. Attorney Lee asked for approval of a resolution for foreclosure of Tax Sales Certificates. Motion by Neumann, seconded by Orthmann to approve and authorize the Chairman to sign Resolution 11-09-06.2 for foreclosure of Tax Sales Certificates. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County Clerk’s office. At 10:00 AM the Board held a public hearing for adoption of the County 2011-2012 budget. County Clerk Lewis read the budget message she had prepared to submit with the budget. No one appeared to speak for or against the budget and the Chairman closed the hearing. Motion by Thomsen, seconded by Curtis to approve the budget as presented. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Curtis to approve and authorize the Chairman to sign Resolution 11-09-06.3 setting the 2011-tax levy different than the 2010 levy at .3341 cents per $100.00 of valuation. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete resolution on file in the County Clerk’s office. Joe Ballweg, Veterans Service Officer, introduced John Clifford and asked that he be sworn in as the newest member to the Adams County Veterans Service Committee. Clifford will represent Post 365 of Juniata. Chairman Woodman did the swearing in. County Clerk Lewis presented two securities from Five Points bank for release and replacement. Motion by Curtis, seconded by Neumann to release two $1,000,000.00 securities to be replaced by two securities in the same amounts from Five Points Bank. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. All inventories from the county departments were presented to the Board for approval and acceptance. Motion by Hynes, seconded by Orthmann to accept the 2011 inventories from the county offices as presented. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Dick Witt of 614 W 10th St spoke on behalf of the Adams County Historical Society to request permission to replace a fence around the Lone Grave, aka the Susan Hale grave north of Kenesaw. He stated that the surrounding land owner had removed the old fence while removing weeds and shrubs that had grown into the fence. He stated that Adams County actually owns the property. Motion by Saathoff, seconded by Neumann to approve the request of Dick Witt on behalf of the Adams County Historical Society to replace the fence around the Susan Hale grave north of Kenesaw. County Clerk presented a brief over view of the proposed changes to the Supervisor districts that are required because of new 2010 census data. The County total population is 31, 364 and the ideal number of population in each district is 4480, however the statutes allow a variance of 5% plus or minus. District Two lost over 10% of its population due to the numerous annexations done by the City of Hastings over the past 10 years. She stated that she will be presenting information to the Hastings City Council on the council ward boundaries. After the City approves their changes, she will bring the proposal back to the Board for approval. Motion by Orthmann, seconded by Curtis to move to Board of equalization for to hear an appeal of a homestead exemption application and tax list corrections. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Board of equalization at 10:45 AM. Woodman stated that he had taken part in the meeting at Prairie Title for the closing of the purchase of the Parde building. He asked the Board to approve his signing of the closing documents. Motion by Neumann, seconded by Thomsen to authorize the Chairman to sign the closing documents for the purchase of the building at 601 S Rhode Island Ave. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Roll call members present were: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Also present were County Clerk Lewis, Attorney Lee, Assessor Hynes and Mr & Mrs Darrell Rowan. Assessor Hynes explained to the Board her reason for rejecting the exemption request for 2010 was because the application did not include a doctors statement and was considered incomplete by the state. If the Board chooses to approve the application the state will not reimburse the County for the lost taxes. Mr. Rowan stated that when he applied in 2010 he was told by a clerk in the Assessor’s office to send his request for a doctors statement to the Veterans Hospital in Grand Island so the Assessor’s office could call each year to verify the information and save him some time. Mr. Rowan stated he took the form for a doctors signature to the VA but it was never returned to him or the Assessor’s office and he was never contacted to notify him until he received the rejection notice. He said he received a letter from the state saying “Congratulations you have been approved for homestead exemption for 2010 and 2011”, however he didn’t keep the letter. Assessor Hynes stated she had checked with the NE Dept of Revenue and they do not send any such letters and the 2011 exemption applications have not yet been approved by the state. Motion by Neumann, seconded by Saathoff to approve the Homestead Exemption application for Darrell Rowan of 1129 Webster for 2010 tax year. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Orthmann, seconded by Curtis to approve and authorize the Chairman to sign Tax List Corrections numbered 13855 through 13865. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann< Saathoff and Woodman. Nays, none. Assessor Hynes also asked approval to correct an error in her office. A portion of a lot, ID #182-930, owned by Orville Kothe had been sold to Jerry and Kay Thomas of Roseland, however instead of only a portion of the lot transferring ownership, the entire lot transferred ownership. Mr. Kothe should have been taxed for part of the lot and Thomas’s should have only paid on part of the lot. She asked for permission to make the correction back to 2005. Motion by Curtis, seconded by Saathoff to approve correction of property ID # 182-930 owned by Jerry and Kay Thomas and Orville Kothe for tax years 2005, 2006, 2007, 2008, 2009 and 2010.
