HomeMy WebLinkAboutSP01-17-12COURTHOUSE HASTINGS NEBRASKA Tuesday, January 17, 2012 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Thomsen, Curtis, Neumann, Orthmann, Saathoff and Woodman. Hynes was absent. Motion by Curtis, seconded by Orthmann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Thomsen, Curtis, Neumann, Orthmann, Saathoff and Woodman. Nays, none. Hynes, absent. The Chairman announced the locations of the open meetings law and agendas in the room and also asked if there were any conflicts of interest with any agenda items. Minutes of the previous meeting were approved as circulated. Thomsen attended a Planning meeting, an ASAAP meeting and the Buildings and Grounds Committee meeting this morning. Saathoff attended a Chamber Governmental Affairs meeting on the 5th, a Senior Action meeting yesterday and the Roads Committee meeting this morning. He and Hynes also did a driving tour of some County bridges. Neumann attended a Midland Area Agency on Aging meeting on the 5th, a South Heartland District Health Dept meeting on the 11th and the Buildings and Grounds Committee meeting this morning. Curtis attended an Extension Board meeting on the 5th and told the Board they are invited to the annual 4-H Soup Supper to be held on the 29th of January. He also attended a Library Board meeting on the 9th. Orthmann attended the MAAA meeting on the 5th, a Combined Services meeting and Senior Services meeting on the 11th, an Adams County Convention and Visitors Bureau meeting on the 12th and the Buildings and Grounds Committee meeting this morning. Woodman attended the Combined Services meeting on the 11th and the Roads Committee meeting this morning. Dr. Michele Bever, Executive Director of South Heartland District Health Dept presented the department’s annual report. Michael Mead, Attorney with Whelan and Scherr informed the Board regarding a property dispute in Pauline. He represents property owners Bob and Cynthia Malesker. The dispute is over an alley way owned by Adams County. It seems that the property owner on the other side of the alley has adversely taken possession of the alley as his own. Mead stated in his conversations with the County Attorney’s office that the County has no plans to vacate this alley. Southern Power District also currently has an easement on the alley. Adam Pavelka, Attorney with Sullivan and Shoemaker represents Larry Smidt, the other property owner who is using the alley as an extension of his property. The Board was of the consensus that they have no intentions of vacating the alley. The matter will be settled between the attorneys or in court. Harold Johnson, Maintenance Supervisor, reported that one bid has been received for replacement of windows at the Annex. He also reported that in conversation with Jan Fox of the Nebraska Energy Office that they intend to return the remaining $30,000.00 plus dollars in the grant to the County for reimbursement of the County’s expenses for the work done through the grant. Motion by Neumann, seconded by Orthmann to award the bid from Howards Glass for replacement of 16 windows at the Annex in the amount of $28,326.00 contingent on the return of the money from the Nebraska Energy Office. Chip Volcek, Emergency management Director, requested Board approval to purchase a new 2012 Chevrolet Equinox for the Emergency Management Agency through a lease purchase agreement with the NACO Leasing Program. Motion by Neumann, seconded by Orthmann to approve the purchase of a 2012 Chevrolet Equinox for Emergency Management Agency from state bid for $23,693.00 contingent on whether or not a local dealer can provide the same vehicle at the same price. Roll call, ayes: Thomsen, Curtis, Neumann, Orthmann, Saathoff and Woodman. Nays, none. Hynes, absent. Motion by Curtis, Seconded by Orthmann to approve and authorize the Chairman to sign Resolution 12-01-17.1 authorizing the signing of lease purchase documents for the purchase of the 2012 Chevrolet Equinox for Emergency management. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County Clerk’s office. At 10:45 AM the Board conducted a public hearing for changes to the County Zoning Regulations regarding outdoor storage containers. Judy Mignery, Planning Director, presented information regarding hearings held by the Planning Commission and read the resolution into the record. No one appeared to speak to the issue and the Chairman closed the hearing. Motion by Thomsen, seconded by Saathoff to approve Resolution 12-01-17.2 amending the County Zoning Regulations for the use of outdoor storage containers. Roll call, ayes: Thomsen, Curtis, Neumann, Orthmann, Saathoff and Woodman. Nays, none. Hynes, absent. Complete Resolution on file in the County Clerk’s office. Kent Gilbert, Hastings Fire Chief, offered information to the Board regarding the Interlocal Agreement with the County and City for ambulance service effective march 1, 2012. Chairman Woodman asked if the agreement contained any references to transporting prisoners in County jail at no cost to the County. Gilbert said he wasn’t sure about any reference to that in the Interlocal Agreement but felt that something could be arranged. There would not be that many transports from jail. Motion by Neumann, seconded by Thomsen to approve and authorize the Chairman to sign the Interlocal Agreement with the City of Hastings for ambulance service effective March 1, 2012with the addition of transporting prisoners from County jail at no cost to the County. Roll call, ayes: Thomsen, Curtis, Neumann, Orthmann, Saathoff and Woodman. Nays, none. Hynes, absent. Chip Volcek asked the Board to declare the old EMA vehicle as surplus equipment. Motion by Saathoff, seconded by Orthmann to declare the EMA vehicle, 2002 Ford Explorer as surplus equipment to be placed for sale. Roll call, ayes: Thomsen, Curtis, Neumann, Orthmann, Saathoff and Woodman. Nays, none. Hynes, absent. Lynn Hanson, Noxious Weed Director, presented the annual Noxious Weed Report. Motion by Neumann, seconded by Thomsen to approve and authorize the Chairman to sign the annual Noxious Weed Report as presented and to place on file with the State. Roll call, ayes: Thomsen, Curtis, Neumann, Orthmann, Saathoff and Woodman. Nays, none. Hynes, absent. Dawn Miller, Highway Superintendent, presented two agreements with the Nebraska Dept of Roads for approval. Motion by Curtis, seconded by Orthmann to approve and authorize the Chairman to sign Resolution 12-01-17.3 giving authorization to the Chairman to sing agreements with NDOR for Project BR2038(1), 42nd St Bridge. Roll call, ayes: Thomsen, Curtis, Neumann, Orthmann, Saathoff and Woodman. Nays, none. Hynes, absent. Complete resolution on file in the County Clerk’s office. Motion by Saathoff, seconded by Neumann to approve and authorize the Chairman to sign Resolution 12-01-17.4 authorizing the Chairman to sign agreements with NDOR for inspection of Fracture Critical Bridges. Clerk Lewis told the Board that there were only two employees participating in the Valic deferred compensation plan and it is necessary to have at least 5 employees participate in a payroll deduction plan to make it cost effective for the County. She said those two employees have been contacted and made arrangements to continue their deferrals through another deferred compensation program. She asked the Board to approve a resolution to terminate the Valic plan. Motion by Neumann, seconded by Orthmann to approve and authorize the Chairman to sign Resolution 12-01-17.5 terminating the County’s participation in the Valic Deferred Compensation Plan. Motion by Orthmann, seconded by Curtis to approve claims and authorize the County Clerk to pay the dame from their respective funds. Motion by Saathoff, seconded by Thomsen to approve Miscellaneous Receipts for the month of December in the amount of $462,279.98. Motion by Neumann, seconded by Saathoff to accept officer’s reports for the month of December from the Sheriff, District Court Clerk, Register of Deeds and County Clerk. There was a brief discussion of the planning meeting for the Central District Spring Meeting in March as Adams County is the host county. The meeting will be Thursday, January 19, 2012 at 9:00 AM in the Garden Café Sun Room. Supervisors Woodman, Saathoff, Curtis and Orthmann plan to attend. Motion by Thomsen, seconded by Neumann to move to Executive Session for personnel matters. Roll call, ayes: Thomsen, Curtis, Neumann, Orthmann, Saathoff and Woodman. Nays, none. Hynes, absent. Entered Executive Session at 12:10 PM. Motion by Orthmann, seconded by Curtis to return to regular session. Roll call, ayes: Thomsen, Curtis, Neumann, Orthmann, Saathoff and Woodman. Nays, none. Hynes, absent. Returned to regular session at 12:37 PM. The chairman announced that the only discussion was fir personnel and no actions were taken in Executive Session. Motion by Curtis, seconded by Orthmann to continue the same committee assignments as were in 2011. Roll call, ayes; Thomsen, Curtis, Neumann, Orthmann, Saathoff and Woodman. Nays, none. Hynes,.
