HomeMy WebLinkAboutSP07-17-12COURTHOUSE HASTINGS NEBRASKA Tuesday, July 17, 2012 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Motion by Saathoff, seconded by Orthmann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room and also asked if there were any conflicts of interest with any agenda items. Minutes of the previous meeting were approved as circulated. Thomsen attended an ASAAP meeting on July 10th and the Buildings and Grounds meeting this morning. The new safe for the treasurer’s office is arriving Friday. Saathoff attended a Senior Action meeting on the 16th, a Roads Committee meeting on the 16th and a tour at Hayland on the 10th for the site that the co op wants to move the railroad. Hynes also attended the tour at Hayland on the 10th, a Combined Services meeting on the 11th and a Roads Committee meeting on the 16th. Neumann attended a South heartland District health Dept meeting on the 11th, a Midland Area Agency on Aging advisory board meeting on the 121th and the Buildings and Grounds meeting this morning. Curtis judged the pie contest at the Library and a Library Board meeting on the 9th, an Ag Society meeting on the 10th, the 4-H fashion show and an Extension Board meeting on the 12th. Orthmann attended a Combined Services Committee meeting on the 11thh and also a Senior Services meeting, an Adams County Convention and Visitors Board meeting on the 12th and the Buildings and Grounds meeting this morning. Woodman attended the tour at Hayland, the Combined Services meeting on the 11th and the Roads Committee meeting on the 16th. Motion by Thomsen, seconded by Neumann to approve and authorize the Chairman to sign contracts with Windstream for long distance minutes and PRI. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. County Clerk Lewis presented an application received from the Nebraska Liquor Commission for a manager at the Elks BPOE Lodge 159 for Selena Longoria. Motion by Orthmann, seconded by Curtis to approve the application from Elks BPOE Lodge #159 of 3050 E South Street, Hastings, Nebraska naming Selena Longoria as manager. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Judy Mignery, Planning Administrator presented an application for D & N Subdivision for Board approval. Motion by Saathoff, seconded by Thomsen to approve D & N Subdivision, case 12-07.1, applicants Dale and Nancy Strasburg. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Dawn Miller, Highway Superintendent presented a resolution and contract from Nebraska Dept of Roads for project Ayr, Northeast. Motion by Saathoff, seconded by Hynes to approve and authorize the Chairman to sign Resolution 12-07-17 authorizing the Chairman to sign the contract with Nebraska Dept of Roads for project Ayr, Northeast. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete resolution on file at the County Clerk’s office. Motion by Neumann, seconded by Curtis to approve claims and authorize the County Clerk to pay the same from their respective funds. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, Seconded by Orthmann to accept Miscellaneous Receipts for the month of June in the amount of $1,566,866.27. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Curtis, seconded by Hynes to accept officers reports for the month of June from the County Clerk, Register of Deeds, District Court Clerk and Sheriff. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann< Saathoff and Woodman. Nays, none. At 10:00 AM the Chairman opened a public hearing for the possible closure of Riverview Ave. Phil Smidt, Chairman of Little Blue Township told the Board that the Little Blue Township Board was unanimously opposed to closing the road. Melvin Haba, property owner on the west side of the road, stated he would prefer to have the road stay open all the way through. It is difficult for him to access his calving shed in bad weather through his yard. He asked the Roads Committee to look at the road before closing it. He also stated that culverts would be preferred and would give dirt to the county for the culverts. He also stated that SilverLake Rd has problems with bridges and Riverview could possibly be access around Silverlake. He would like to maintain it as a township road but gravel trucks have a difficult time turning around since the road is not a through road. His second preference would be to close the north structure on the road and leave the south end open. Don Hubl stated he has a quarter section on the east side of the road on the south end and wants a ½ mile access from the north but would prefer ¾ mile access. If the County needs dirt they could have some from his property off a railroad right of way. Leonard Haba questioned why it is so difficult to get the Corps of Engineers to change the channel of a creek. He does not live on the property but his family does and they need access to their calving shed. Phil Smidt asked about a gentlemen’s agreement from years ago between the townships and the county for maintenance and gravel. Chairman Woodman replied that those gentlemen were long gone. No one else appeared and the hearing was closed at 10:23 AM. Clay County will also hold a public hearing on the possible closure next week. It will be after their hearing that a decision will be made about closing Riverview Ave. Lee Hogan of the Adams County Ag Society presented the Society’s request for budget for the upcoming year. He stated they would not be asking for anymore funding than they had the past year and that they are still looking a constructing a new building. Motion by Orthmann, seconded by Saathoff to move to Board of Equalization for motor vehicle exemption applications and Tax List Corrections. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Board of Equalization at 10:35 AM. District Judge Stephen Illingworth presented his revised budget request to the Board for approval. The salary for the bailiff had been adjusted based on the hiring of a new employee. Motion by Curtis, seconded by Hynes to move to Executive Session for mental health discussion and county burial request. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Executive Session at 11:00 AM. Also present were County Attorney Donna Fegler Daiss, Timory Naples, Public Defender Art Toogood and Bob Wolfe. Motion by Neumann, seconded by Orthmann to return to regular session. Returned to regular session at 11:50 AM Motion by Curtis, seconded by Saathoff to approve the application for County burial assistance. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Board heard a budget request for the Extension Office budget from Extension Educator Ron Seymour. The Board recessed at 12:15 PM and reconvened at 1:15 PM. The Board continued their meeting hearing budget requests from Road and Weed Depts., Assessor, Treasurer, Public Defender, County Attorney, County Court, Convention and Visitors Bureau, Sheriff, Jail and 911. The Board adjourned at 4:15 PM. Witte Deputy COURTHOUSE HASTINGS, NEBRASKA Tuesday, July 17, 2012 The Adams County Board of Supervisors met as a Board of Equalization with Chairman larry Woodman presiding for the purpose of hearing motor vehicle exemption applications and approving Tax List Corrections. Roll call members present: Thomsen, Curtis, Neumann, Hynes, Ortmann, Saathoff and Woodman. Also present were County Clerk Lewis, Attorney Naples and Treasurer Davis. Motion by Neumann, seconded by Hynes to approve a motor vehicle exemption application for the Salvation Army for an enclosed cargo trailer. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Orthmann, seconded by Saathoff to approve a motor vehicle exemption application for South Central Behavioral Services for 2001 Chrysler Minivan, 2006 PT Cruiser, 2009 Toyota Camry, 2007 Toyota Sienna and 2008 Toyota Highlander. The application from Midland Area Agency on Aging was deferred until next meeting as the application was not complete.
