E1204076LD COURTHOUSE, ADAMS COUNTY Tuesday, August 20, 2013 151 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman Chuck Neumann presiding. Roll Call members present were: Thomsen, Curtis, Neumann, Othman, Saathoff, Hynes and Weeks. Motion by Orthmann, seconded by Curtis, that this is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk's office. Roll call; Ayes: Thomsen, Curtis, Neumann, Orthmann, Saathoff, Weeks and Hynes. Nays: None. The Chairman announced the locations of the open meetings law and agenda in the room and also asked if there were any conflicts of interest with any agenda items. Minutes of the previous meeting were approved as circulated. Committee Reports: Orthmann attended the National Night Out event on the 6th of August, a Combined Services meeting on August 8th, an Adams County Senior Service meeting on the 14th and a Building and Grounds Committee meeting this morning. Curtis attended an AG Board meeting on the 13th of August. Weeks attended the Roads and Bridges Committee meeting this morning. Hynes attended a Joint Services meeting on the 8th and a Road and Bridges Committee meeting this morning. Saathoff attended the National Night Out event on the 6th, a pre -construction meeting at the Roads Department regarding the Hastings North East project on the 8th, a meeting with Deputy Attorney Dave Bergin, Dawn Miller, Carol Curry -Fisher and David Utecht regarding the reorganization of the West Blue Township Board, and the Road and Bridges Committee meeting this morning. Thomsen attended an ASAAP meeting earlier this month, a meeting with Verizon representatives regarding the proposed contract for renting tower space on the ACOB on August 19th, and the Building and Grounds Committee meeting this morning. Neumann attended a Combined Services and CASA meeting earlier this month as well as the Building and Grounds Committee meeting this morning. John Yoachim with Verizon Wireless spoke regarding the proposed rental agreement between Verizon and Adams County for the rental of tower space on the Adams County Office Building (ACOB). Adams County had discontinued negotiations with Verizon during the August 6th regular Board meeting. Mr. Yoachim stated that Verizon was prepared to honor requests made by Adams County in order to reestablish negotiations. A revised contract will be prepared and available for review at the September 3, 2013 regular Board meeting. David Bergin, Adams County Deputy Attorney, opened bids for court appointed secondary public defender services. One bid was submitted by Langvardt, Valle and James, P.C. in the amount of $95,000.00. A decision to approve the bid was delayed until later in the meeting so that Adams County Attorney Donna Fegler-Diass could be present to answer questions from the Board regarding the secondary public defender services. Supervisor Saathoff informed the Board of two individuals interested in serving on the West Blue Township Board. Currently the Board has two vacancies that need to be filled. Motion by Saathoff, seconded by Weeks to declare the two seats on the West Blue Township Board as vacant. Roll Call: Ayes; Thomsen, Curtis, Neumann, Hynes, Saathoff, Orthmann and Weeks. Nays: None. Motion by Saathoff, seconded by Weeks to appoint Dave Utick, West Blue Township resident, to the West Blue Township Board. Roll Call: Ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: None Motion by Saathoff, seconded by Orthmann to appont Carol Curry -Fisher, West Blue Township resident, to the West Blue Township Board. Roll Call: Ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Rich Cartier with the Hastings Planning Department presented the Board with three subdivision requests that require County approval for right of way on roads adjacent to the properties. Hollister Subdivision number one and number two are located on Idlewild Road, these are pivot corners that are being subdivided with the intention of building homes on each property. Cartier also presented a subdivision request for the Todd Burr Subdivision located on Highland Road. Mr. Burr had vacated a smaller plat and is now looking to expand the lot size. Motion by Weeks, seconded by Orthmann to move to Board of Equalization for the purpose reviewing motor vehicle tax exemption requests and for tax list corrections. Roll Call: Ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: None Board entered Board of Equalization at 10:02 a.m. Motion by Saathoff, seconded by Weeks to resume regular session. E1204076LD Board resumed regular session at 10:27 a.m. Motion by Thomsen, seconded by Saathoff to approve the right of way for Hollister subdivision number one. Roll Call: Ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: None Motion by Thomsen, seconded by Saathoff to approve the right of way for Hollister subdivision number two. Roll Call: Ayes; Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: none Motion by Thomsen, seconded by Saathoff to approve the right of way for the Todd Burr Subdivison. Roll Call: Ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: None Kaleena Fong, Director of the Adams County Visitors Center, requested Board approval to award the City of Hastings a $25,000.00 grant to use toward Duncan Field renovations. Money from the grant is collected from the city lodging tax. Motion by Thomsen, seconded by Orthmann to approve the City of Hastings being awarded a $25,000.00 Visitor Improvement Grant for renovations to Duncan Field. Roll Call: Ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: None Dawn Miller, Adams County Highway Superintendent, requested Board approval to declare unit 305, a 1996 Ford dump truck, and unit 326, a 2003 International 4200 cab and chassis, as surplus and place on public auction with Ruhter Auction Service on August 21, 2013. Motion by Curtis, seconded by Weeks to declare Adams County Highway Department unit 305 and unit 326 as surplus, and for sale on public auction with Ruhter Auction Service on August 21, 2013. Roll Call: Ayes: Thomsen, Curtis, Neumann, Hynes, Saathoff, Orthmann and Weeks. Nays: None Phil Lorenzen with Davidson and Associates presented the Board with a Reimbursement Resolution that would allow recovery of funds temporarily advanced for the proposed Highway 281 to Highway 6 truck route. The Board members clarified that the signing of the reimbursement resolution does not commit them to the project as bids will be opened on August 28th at 2:OOpm. It was suggested by Dawn Miller to place a reimbursement amount of $500,000.00 on the resolution. Motion by Saathoff, seconded by Weeks to approve the signing of the Reimbursement Resolution allowing the recovery of funds temporarily advanced for the proposed Highway 281 to Highway 6 truck route project. Roll call: Ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: None Resolution 13-8-20.01 Lorenzen also presented the Board with a resolution allowing the creation of a Rural Road Improvement District for the truck route project. A hearing date of September 17th at 10:00 am has been scheduled in regards to the Rural Road Improvement District and shall be advertised by posting notices within the district as well as three issues of the Hastings Tribune. Motion by Curtis, seconded by Orthmann to approve the signing of resolution 13-08-20.02 for the creation of a Rural Road Improvement District. Roll Call: Ayes; Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff, and Weeks. Nays; None Resolution 13-08-20.02 is on file in the Adams County Clerks Office. Donna Schmidt with the Adams County Probation Office requested the Board Chairman's signature on a labor and service contract with Windstream that would provide phone service to probation offices located in their newly rented office space. Motion by Thomsen, seconded by Weeks to approve Chairman Neumann signing the Windstream contract to obtain phone service in the new probation office location. Roll Call: Ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff, and Weeks. Nays: None Ramona Thomas, Adams County Clerk, presented the Board with a request from Jan Johnson, Register of Deeds. Johnson's request was that she be allowed to sell Adams County Plat books to local government entities at cost. Currently the books sell for $20.00 each and cost $11.00 to print. Motion by Weeks, seconded by Orthmann to allow the Register of Deeds to sell Adams County Plat books at cost to local government entities. Roll Call: Ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: None David Bergin requested the Board Chairman's signature on the Victim/Witness grant. This grant provides funds for the salary of the Adams County Victim / Witness officer, Jackie Rains. Motion by Curtis, seconded by Thomsen to approve Chairman Neumann signing the victim/witness grant. Roll Call: Ayes; Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: None David Bergin requested approval of an agreement with Boys Town for temporary shelter placement and services. Donna Fegler-Diass, Adams County Attorney was also present to answer any questions by the Board. The agreement states that Boys Town will provide temporary placement service at a rate of $150.00 per day. Fegler-Diass indicated that services from Boys Town are rarely utilized due to space limitations, however it would be wise to have the facility as an option at the proposed rate. Motion by Thomsen, seconded by Weeks to approve the Temporary Shelter Placement Agreement with Boys Town. Roll Call: Ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. E1204076LD Clerk Thomas presented the Board with a written request by Patty Peterson, with the Adams County Court, to rent the assembly room in the ACOB on October 6.2013. The rental fee for the assembly room is $25.00 Motion by Curtis, seconded by Orthmann to approve the request from Patty Peterson to rent the assembly room at the ACOB on October 6, 2013. Roll Call: Ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: None Clerk Thomas presented the Board with a written request from Robin Koozer, with the Hastings College Music Department, to allow Hastings .- College to use the parking lot of the ACOB as a staging area for the Melody Round Up Parade taking place on September 21, 2013. Motion by Weeks, seconded by Orthmann to grant the request by Hastings College to use the ACOB parking lot on September 21, 2013 for the Melody Round -Up Parade. Roll Call: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: None. Donna Fegler-Diass answered questions from the Board regarding the duties of a court appointed secondary public defender. The previous contract with Langvart, Valle and James was reviewed as well as their bid for continuing the secondary public defender services. Fegler-Diass advised the Board that she felt the County utilized court appointed secondary public defender services enough to justify the submitted rate of $95,000.00 a year as hiring these services with no contract in place costs $95.00 per hour. Motion by Thomsen, seconded by Saathoff to accept the bid from Langvardt, Valle and James for court appointed secondary public defender services at a rate of $95,000.00 per year. Nays: None The Court Appointed Secondary Public Defender Contract will be written and available to sign during the September 3, 2013 regular Board meeting. Motion by Hynes, seconded by Curtis to approve the claims and allow the Adams County Clerk to pay same amounts from their respected funds. Treasurer Davis presented the Board with motor vehicle tax exemption requests from Hastings Head Start, Goodwill Industries, Platte Valley Youth for Christ and Hastings College. Davis has reviewed each requested Board approval. Motion by Thomsen, seconded by Weeks to approve the motor vehicle tax exemption for Hastings Head Start.
