Tuesday, February 18, 2014
A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman Chuck
Neumann presiding. Roll Call members present were: Weeks, Thomsen, Hynes, Orthmann, Saathoff and Neumann.
Motion by Orthmann, seconded by Weeks, that this is a regular meeting of the Adams County Board of Supervisors and public
notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the
members and an agenda was kept currently amended and posted in the County Clerk's office. Roll call; Ayes: Weeks, Thomsen,
Hynes, Orthmann, Neumann, Nays: None. Absent: Curtis
The Chairman announced the locations of the open meetings law and agenda in the room and also asked if there were any
conflicts of interest with any agenda items.
Minutes of the previous meeting were approved as circulated.
During Public Comment, Chairman Neumann requested Board Member Orthmann and Board Assistant Judy Mignery give a
brief report regarding a proposed legislative bill that would eliminate the inheritance tax. Orthmann has spoken to Larry Dix
with NACO as well as Senator Les Seiler

Bob Parker and Todd Peters with Central Nebraska Collections spoke to the Board about the possibility of their agency assisting
Adams County on the collection of back taxes. Parker suggested that he speak with the Adams County Treasurer so that he can
present options to the Board during the March 4, 2014 meeting.
Parker also requested to be placed on the March 4, 2014 meeting agenda to address the Board regarding his views on
courthouse security.
Due to illness, the isolated land public hearing has been rescheduled by March 18, 2014.
Judy Mignery, Adams County planning and Zoning Director, requested the Board approve the appointment of Belva Junker to
the Planning and Zoning Commission.
Motion by Weeks, seconded by Saathoff to approve the appointment of Belva Junker to the Adams County Planning
Commission. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Orthmann. Nays: None. Absent: Curtis
Mignery requested Board approval on an administrative plat for West Fork North 3rd Subdivision located in all of Lot One (1),
West Fork North 2nd Subdivision, a subdivision located in the East Half of the Northeast Quarter (E %: NE 1/4) of Section Twelve
(12), Township Eight (8) North, Range Ten (10) West of the 6th P.M., Adams County, Nebraska.
Motion by Saathoff, seconded by Orthmann to approve plans for the West Fork 3rd Subdivision, as presented by Mignery. Roll
Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Orthmann. Nays: None. Absent: Curtis
Adams County Clerk, Ramona Thomas, presented the Board with resolution #2014-02-18.01 on behalf of the Adams County
Treasurer for the striking of uncollected distress warrants in compliance with State Statute 77-1738.
After brief discussion, the Board chose to wait until later in the meeting to consider resolution 2014-02-18.01, as the Adams
County Treasurer would be available later in the meeting to clarify questions the Board had regarding the uncollected taxes.
Clerk Thomas presented a request by Kathy Wetzel for the rental of the ACOB assembly room on 4/19/2014 for an 80th Birthday
party, Ms. Wetzel has been advised of the $25.00 rental fee.
Motion by Orthmann, seconded by Hynes to approve the rental request made by Kathy Wetzel. Roll Call: Ayes: Neumann,
Saathoff, Weeks, Hynes, Thomsen, Orthmann. Nays: None. Absent: Curtis
Chairman Neumann extended the public comment portion of the agenda, and Joe Budnick with the Adams County Probation
office addressed the Board regarding continued concerns of the lack of efficient office space available for the probation office.
Board member Thomsen stated that the Building and Grounds Committee has been exploring several locations for the
probation offices however factors such as location, size and cost have limited options.
Deputy Attorney Bergin requested the Board approve an inter -local agreement between Adams County and Blaine County for
law enforcement services, such agreements currently exist with Adams County and several•other surrounding counties.
Chairman Neumann questioned if this would result in a workload burden to Adams County, Berin stated that this would not be
an issue.
Motion by Saathoff, seconded by Weeks to approve the inter -local agreement between Adams County and Blaine County for

Motion by Weeks, seconded by Orthmann to accept the officer reports presented by the County Clerks office and the Register
of Deeds. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Orthmann. Nays: None. Absent: Curtis
At 10:30 Chairman Neumann requested a motion to open the advertised public hearing for the 1 and 6 year Adams County
Road Plan.
Motion by Orthmann, seconded by Weeks to open the Adams County 1 and 6 Year Road Plan, Public Hearing. Roll Call: Ayes:
Neumann, Saathoff, Weeks, Hynes, Thomsen, Orthmann. Nays: None. Absent: Curtis
Dawn Miller, Adams County Highway Superintendent, reviewed the 1 and 6 year road plan for Adams County. There are 41
projects on the six year plan and 20 projects on the one year plan.
There were no members of the public that spoke in regards to the plans.
Motion by Weeks, seconded by Orthmann to close the public hearing for the Adams County 1 and 6 year road plan. Roll Call:

The Adams County 1 and 6 year road plan is available for public inspection at the Adams County Roads Department as well as
the Adams County Clerk's Office.
At 10:45 a.m. Miller opened sealed gravel bids for the 2014 fiscal year. Miller read gravel bids for Adams County townships,
stock pile bids and pit bids from Consolidated Concrete, Deweese Sand and Gravel, and Mid Nebraska Aggregate.
Motion by Weeks, seconded by Orthmann to award the lowest bid for each project.. Roll Call: Ayes: Neumann, Saathoff,

The Board resumed regular session at 11:25 a.m
Bev Davis, Adams County Treasurer remained available to answer questions regarding the striking of uncollected distress
warrants. Davis outlined the process of issuing a distress warrant for unpaid taxes. After the issuance of distress warrants for
two consecutive years, and due diligence to collect delinquent taxes, the County Board has the authority by resolution to strike
such delinquent taxes from the tax list. However the striking of taxes from the tax list does not mean the County cannot
continue to try and collect the unpaid taxes.
Members of the Board questioned some of the larger amounts of uncollected taxes, especially those of a business that is still in
operation. Davis offered to investigate those properties and update the Board during the March 4th meeting.
The Board differed a decision on the signing of resolution 2014-02-18.01 until additional information can be collected by
Treasurer Davis.
The Board adjourned at 11:42 a.m.

Adams County Treasurer, Bev Davis presented the Board with motor vehicle tax exemption applications from Hastings Catholic
Schools, Head Start, Mary Lanning, and Evangelical Lutheran Good Samaritan Society. Davis has reviewed all applications and all
meet the requirements for tax exemption, Davis requested the Board's approval.
Motion by Saathoff, seconded by Orthmann to approve the motor vehicle exemption requests as presented by Treasurer Davis.

Adams County Assessor, Diane Hynes presented the Board with a tax list correction for property #284-3216 owned by South
Central Behavior Services. This property previously qualified as a tax exempt property, but due to a change in ownership, taxes
in the amount of $8815.00 will be assessed this year.

Hynes presented a request for a tax list correction on property #284-13740, owner Hastings College. Property 284-13740 was
purchased by Hastings College and now qualifies for a permissive exemption.
Motion by Saathoff, seconded by Thomsen to allow the tax list correction on property 284-13740 to reflect the permissive

Hynes presented a tax list correction for property # 132-1018344, owners Bradley and Annette McWhirter. In 2013 taxes were
assessed to the land value only, Hynes is requesting a correction to reflect the $179,460.00 of improvements to the property
and tax it accordingly for 2014.
Motion by Thomsen, seconded by Saathoff to approve the tax list correction on property #132-1018344 increasing the property

Hynes requested a tax list correction on property #284-50600, owner Charles Norris. Hynes is requesting taxes in the amount of
$333.95 ($167.43 for 2011 and $166.52 for 2012) be removed from the tax roll, as the mobile home was demolished in 2010.
Motion by Orthmann, seconded by Weeks to approve the requested correction to property #284-50600 to remove the taxes for
