Board Minutes
Courthouse, Adams County,Tuesday November 17, 2015 at 9:30 a.m.
A regular meeting of the Adams County Board of Supervisors was held as public notice given with
Chairman Neumann presiding. Roll Call Members Present: Michael Stromer- District 1; Mike Weeks -
District 2; Jennifer Czekai-District 3; Scott Thomsen -District 4; Dale Curtis -District 5; Chuck Neumann -
District 6; Eldon Orthmann-District 7
Motion by Weeks, seconded by Curtis that this is a meeting on the Adams County Board of Supervisors
and public notice of this meeting has been given by publication in the Hastings Tribune and by posting.
An Agenda was available to the members and an agenda was kept currently amended and posted in the
County Clerk's Office, Roll Call, Stromer, Czekai, Thomsen, Curtis, Neumann, Weeks, Orthmann. Nays:
none
The Chairman announced the locations of the open meetings law and agenda in the room and asked if
there were any conflicts of interest with any agenda items.
Minutes of the previous meeting were approved as circulated.

Spoke on behalf of the US MARC in Clay Center that he would like Legal Counsel to write
a resolution supporting US MARC
Judy Mignery address the Board during public comments stating that November 17, 2015 was National
Healthy Lunch Day and distributed flyers with healthy choices for lunch.
Jackie Norris requested a final signature from the Board Chairman for the Victims/Witness Grant that
will be providing a part time assistant and a computer for the assistant. Motion by Curtis and seconded
by Stromer for the Chairman to sign final agreement for the Victims/Witness Grant. Roll Call, Ayes:
Stromer, Weeks, Czekai, Thomsen, Curtis, Neumann, Orthmann. Nays: none
Dawn Miller requested a signature from the Board Chairman on the Certificated of Compliance for
Maintenance Agreement #116A with the Nebraska Department of Roads. Motion by Weeks seconded
by Czekai for the Chairman to sign the Certificate of Compliance. Roll Call: Ayes, Stromer, Weeks,
Czekai, Thomsen, Curtis, Neumann, Orthmann. Nays: None
Dawn Miller opened bids for the Hastings Southeast Overlay, the bids are as follows:
Vontz Paving: $457,694.04
Werner Construction: $587,049.60
Miller proposed to the Board to accept and award the bid by Vontz Paving for the Hastings Southeast
Overlay Project. Motion by and seconded by to accept and award the bid to Vontz Paving for the
Hastings Southwest Overlay. Roll Call: Ayes, Stromer, Weeks, Czekai, Thomsen, Curtis, Neumann,
Orthmann. Nays: None
Mark Wilcox with Wellness Partners in McCook, Nebraska presented the Board of Supervisors with the
overall progress for the last 2 years for those who participated in the Adams County Wellness Program,
we had a 72% participation for this year with weight being our biggest issue.
Motion by Weeks and seconded by Orthmann to meet as a Board of Equalization to hear motor vehicle
exemptions and tax list corrections. Roll Call: Ayes, Stromer, Weeks, Czekai, Thomsen, Curtis, Neumann,
Orthmann. Nays: None
The Board met as a Board of Equalization at 10:33 a.m.
Motion by Weeks seconded by Orthmann to exit Board of Equalization and resume regular session. Roll
call: Ayes, Stromer, Weeks, Czekai, Thomsen, Curtis, Neumann, Orthmann. Nays: None
Regular session resumed at 10:37 a.m.
Neumann discussed with Board about using the services of eCivis, the Board decided to find out what
cost is involved, references. Thomsen and Neumann will do the follow-up
Nuemann, schelduled a workshop for December 1, 2015 at 1:30 p.m. in the Board of Supervisors Room.
Security, fire drills, record keeping and United Way will be discussed.
Motion by Curtis seconded by Thomsen to move into closed session for the protection of needless harm
to the reputation of an individual, to hear an appeal of a denied County burial request. Roll Call: Ayes
Stromer, Weeks, Czekai, Thomsen, Curtis, Neumann, Orthmann. Nays: None.

Motion by Weeks, seconded by Orthmann to resume regular session. Roll Call: Ayes, Stromer, Weeks,

Regular session resumed at 11:00 a.m.
The Chairman stated the closed session to hear an appeal of Denied County Burial, Individual was not
present for the closed session therefore claim stands as denied.
Thomsen presented to Board a claim to pay off the loan with Adams County Bank for the 601 Rhode
Island building out of Inheritance Fund, for the amount of $72,642.41. Curtis stated that he was not
comfortable taking funds out of Inheritance due to the 2017 taxable property being lower. Weeks and
Neumann did not agree with Thomsen and after more discussion motion was made Thomsen to pay off
the Loan with Adams County Bank for the amount of $72,642.41 seconded by Orthmann. Roll Call: Ayes,
Thomsen, Stromer, Orthmann. Nays: Czekai, Neumann, Weeks, Curtis. Motion failed.
Motion by Czekai to enter into closed session for the protection of Public Interest seconded by Weeks.

The Chairman stated that the closed session was for Protection of Public Interest and no action was
taken.
The Board along with Brandy Johnson had a Power Point Tele Conference with Bryan Dykes of
Tennessee regarding the Negative Secondary Effects of Adult Establishments.
Johnson the County's Legal Defense Attorney spoke to Board regarding pending litigation in the US
District Court Case No. 4:15cv3068
Johnson discussed with the Board regarding proposed zoning regulation amendments relating to adult
establishments. Motion by Czekai, seconded by Weeks to advance the Zoning Proposal to the Adams
County Planning and Zoning Commission for study and recommendations. Mignery stated that the
meeting will be held December 7, 2015. Roll Call: Stromer, Weeks, Czekai, Thomsen, Curtis, Neumann,
Orthmann. Nays: None
Johnson discussed with the Board the proposed Ordinance 15-0001 governing public nudity, and lewd or
lascivious behavior. Motion for the County Clerk/Deputy to publish Ordinance 15-0001 and to set the
Public Hearing date for the first reading on December 15, 2015 at 10:00 a.m. Roll Call: Ayes, Stromer,
Weeks, Czekai, Thomsen, Curtis, Neumann, Orthmann. Nays: None
Motion by Weeks seconded by Czekai to direct the County Clerk to pay them out of the respective
funds. Roll Call: Stromer, Weeks, Czekai, Thomsen, Curtis, Neumann, Orthmann. Nays: None
Motion by Czekai seconded by Stromer to accept the miscellaneous receipts. Roll Cali: Stromer, Weeks,
Czekai, Thomsen, Neumann, Orthmann. Nays: None
Motion By Weeks seconded by Czekai to approve the officers reports from Register of Deeds, County

The Adams County Board of Supervisors met as a Board of Equalization to hear motor vehicle exemption
request, real estate corrections and miscellaneous tax list corrections. Board Members present were:
Michael Stromer— District 1, Mike Weeks — District 2, Jennifer Czekai- District 3, Scott Thomsen — District
4, Dale Curtis — District 5, Chuck Neumann — District 6, Eldon Orthmann — District 7.
Motion by Weeks, seconded by Orthmann to meet as a Board of Equalization to hear motor vehicle
exemptions request and tax corrections. Roll CaII: Ayes, Stromer, Weeks, Czekai, Thomsen, Curtis,
Neumann, Orthmann. Nays: None.
Board of Equalization was opened at 10:33 a.m.
Jackie Russell, Adams County Assessor presented the Board tax corrections for the following parcels:
010007296 for tax years 2013 and 2014 and parcel 010000390 for tax year 2014.
Motion by Thomsen, seconded by Orthmann to approve the tax list corrections as presented by Russell.
Roll Call: Ayes, Stromer, Weeks, Czekai, Thomsen, Curtis, Neumann, Orthmann. Nays: None.
Melanie Curry, Adams County Treasurer presented the Board with 2 motor vehicle exemptions for Good
Samaritan Society, Curry stated she had reviewed the applications and recommends approval. Motion
by Thomsen, seconded by Stromer to approve the vehicle exemptions for Good Samaritan Society as
presented by Curry. Roll Call: Ayes, Stromer, Weeks, Czekai, Thomsen, Curtis, Neumann, Orthmann.
Nays: None
Motion by Curtis, seconded by Orthmann to approve the miscellaneous tax list corrections: Roll CaII:
