A regular meeting of the Adams County Board of Supervisors was held as public notice given with
Chairman Neumann presiding. Roll Call Members Present: Michael Stromer- District 1; Mike Weeks -
District 2; Jennifer Czekai-District 3; Scott Thomsen -District 4; Dale Curtis -District 5; Chuck Neumann -
District 6; Eldon Orthmann-District 7
Motion by Orthmann, seconded by Weeks that this is a meeting on the Adams County Board of
Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and
by posting. An Agenda was available to the members and an agenda was kept currently amended and
posted in the County Clerk's Office, Roll Call, Ayes: Stromer, Czekai, Thomsen, Curtis, Neumann, Weeks,
Orthmann. Nays: none
The Chairman announced the locations of the open meetings law and agenda in the room and asked if
there were any conflicts of interest with any agenda items.
Minutes of the previous meeting were approved as circulated.

Chairman Neumann opened the meeting for comments from the public.
Bill Boyer with Murphy Tractor spoke during public comment, to introduce himself to the Board and
express his hope in working with the county in the future.
Judy Mignery spoke during public comment, on behalf of the Adams County Wellness Committee.
Mignery reminded everyone that Wellness Partners would be conducting short wellness meetings at the
Adams County Roads Department as well as at the Adams County Office Building on December 9,10 and
11.

Adams County Planning and Zoning Director, Judy Mignery, presented the Board with Planning and
Zoning Case #15-12.1, Plans for the Dave and Misty Gartner Subdivision. Mignery has reviewed the
application and the case had been approved by the Adams County Planning and Zoning Board. Mignery
is requesting County Board approval.

Administrator's Comments: This proposed Subdivision is a 4.43 acre subdivision in the SE V.
Section 1, T8N, RI OW. The proposed subdivision contains an existing house, storage buildings,
Grain Bin, well and septic system. It also contains a large tower. The applicant would also like
to construct an irrigation service building on the parcel. The parcel does not fall within the
boundaries of the 100 year flood plain. All requirements of the existing County and Village
Subdivision Regulations and the Zoning Regulations have been met.

conforming residential structure in the Ag District;

Administrator's Comments: The Applicant has an existing Residence in the SW '44 of Section
35-T5N-R9W. According to the Assessor records the house was built in 1928. The applicant
would like to reconstruct an addition that is on the west side of the residence. This addition does
encroach into the setback space for the agriculture district. According to the Adams County
Zoning Regulations adopted in August, 2010, Section 3.01 item 3.01.04, "Notwithstanding other
provisions of this Section, a lawfully established residential use rendered non -conforming by
adoption of this Resolution or amendment thereto may be enlarged, altered or reconstructed,
provided that 1. Such residential use shall comply with Section3.04 of this Resolution, 2. This
provision shall not be construed to include more than one use on a lot and shall be applicable so
long as such use remains otherwise lawful." Section 3.04 item 3.04.01 states "Any structure or
portion thereof may be altered to reduce its nonconformity but no such nonconforming structure
may be enlarged or altered in any way which would increase its nonconformity, except that
structures located in the AG District may be allowed by conditional use permit to be enlarged or
extended with due consideration of the following: a) a permit may be authorized for an
expansion of an existing non -conforming structure, if the proposed expansion (including any
other expansions) does not exceed fifty percent(50%) of the square footage of the original
structure in existence prior to the adoption of the regulations. Non -conforming grain bin storage
facilities may be expanded up to 200% of the existing facility in existence at the time of the
adoption of these regulations. b) Such CLIP may only be allowed to continue an existing non-
conformity (without increasing the degree of non -conformity) and shall not allow for the creation
of new non -conformities. The permit shall not be allowed for multiple non -conformities. The
degree of non -conformity shall mean that the request shall not further reduce a setback or
increase a height requirement or encroach into an area designated as a sight triangle. c) The
consideration of the CUP effects on adjacent property, traffic and environment shall be
considered, d) The County's Transportation Plan and one and six year plan shall be considered.
e) The density of land use within the existing zoning district and that of adjacent properties shall
be considered. f) The degree of hardship upon the applicant which would be caused by failure to
grant such a permit shall also be considered."

Administrator's Comments: The Applicant would like to build an Irrigation Service business
in Dave & Misty Gartner Subdivision, in the SE '4 of Section 1-T8N-RI OW. The Adams
County Zoning Regulations adopted in 2010 will allow this use with a Conditional Use Permit.
The tract also falls in the Highway Corridor Overlay District. With the adoption of the 2010
comprehensive plan update, Adams County established basic site and building development
criteria for this Overlay District These criteria include but are not limited to landscaping,
building material selection, lighting, and road development. The purpose for the regulations of
the Overlay District is to provide for a cohesive and properly developed corridor and entrance
into Adams County. These are in addition to the underlying zoning district of the property. The
underlying district is Agriculture.
Chairman Neumann addressed the room to inquire if anyone wanted to speak for or against the
proposed Conditional Use Permit as read by Mignery.

Motion by Weeks, seconded by Czekai to close the Public Hearing on Case #15-12.2, a Conditional Use

Public Hearing for Case #15-12.2 closed at 9:55 a.m.
Motion by Thomsen, to approve case number 15-12.2 as presented by Mignery.
Brief discussion occurred regarding the addition to a fence on the property if children reside there.
Thomsen amended his motion to approve case #15-12.2, with the addition that a fence must in
constructed if a child(ren) sixteen years of age or younger, reside at the property. Roll Call: Ayes:

Brandy Johnson with the Vincent Valentino Law Office, addressed the Board to conduct a full reading of
proposed County Ordinance 15-0001, governing public nudity and lewd and lascivious behavior,
pursuant to Neb. Rev. Stat. §23-190. Johnson read the following into the record:

Pursuant to Neb. Rev. Stat. §23-I88. Notice is hereby given that a public hearing of the Board of Supervisors,
Adams County Nebraska will be held at 10:00 am, Tuesday December 15, 2015 in the. Board of Supervisors room,
Adams County Courthouse. This hearing is open to the public.
This is a public hearing before Adams County Board of Supervisors Adams County Nebraska, regarding proposed
Ordinance 15-0001, an Ordinance to establish a law regarding public nudity and lewd or lascivious behavior; to
establish a penalty and provide a method of enforcement; and to provide for an effective date.
All Interested parties are invited to attend this public hearing at which tirne the public will have an opportunity to be
heard regarding proposed Ordinance 15-0001.

ORDINANCE NO. 15-0001
AN ORDINANCE 10 ESTALLSII A LAW REGARDING PUBLIC NUDITY AND LEWD
OR LASCIVIOUS BEHAVIOR; TO ESTABLISR A PENALTY AND PROVIDE A
METHOD OF ENFORCEMENT; AND TO PROVIDE FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Neb. Rev. Stat, §23-104, the County has the power to do all acts in relation
to the concerns of the County necessary to the exercise of its corporate powers;
WHEREAS, pursuant to Neb. Rev. Stat. §23-103, the powers of the County as a body are exercised
by the Adams County Board of Supervisors ("County Board");
WHEREAS, it is the intent of the County Board to enact an Ordinance;
WHEREAS, pursuant to Neb. Rev. Stat. §23-t 87, the County may regulate, through an ordinance,
violations of the public peace and good order of the County by lewd or lascivious behavior and/or public
nudity; and,
WHEREAS, the Adams County Board has held public meetings and hearing on the matter, after
giving due notice as required by law.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF TILE
COUNTY OF ADAMS, NEBRASKA:
SECTION 1. Statement of Intent:
It is the intent of this Ordinance to promote the public health, safety, welfare, peace and order of
the County. It is also the intent of the County to further the government's interest in avoiding the harmful
secondary effects of public nude conduct and lewd or lascivious behavior such as prostitution, sexual
assaults, and criminal activity. See, e.g., Barnes v. Glen Theatre, Inc., 501 U.S. 560 (1991); Pap's A.M. v,
City of Erie, 529 U.S. 277 (2000); Ways v. City of Lincoln, 331 F.3d 596 (8th Cir. 2003). The Legislative
record documents and the Board's legislative findings concerning negative secondary effects, which are
found in Section 8.10 of the County Zoning Resolution, are incorporated herein by reference. This
prohibition on public nude conduct and lewd or lascivious behavior is not intended to extend to any
expression of opinion or the performance of a bona fide play, ballet, or drama which may not be prohibited
under the First Amendment to the Constitution of the United States or by Article I, §5 of the Constitution
of the State of Nebraska. The provisions of this Ordinance have neither the purpose nor effect of imposing
a limitation or restriction on exercises of free speech that are protected by the First Amendment.
SECTION 2. Definitions: For purposes of this Ordinance, and where not inconsistent with,lhe
context of a particular section, the defined terms, phrases, word, abbreviations, and their derivations shall
have the meaning given in this section. When not inconsistent with the context, words in the present tense
include the future -tense, words used in the plural number include words in the singular number and words
in the singular number include words in the plural number. The word "shall" is always mandatory, and not
merely directory.
a) Nude, nudity, or a state of nudity means the showing of the
human male or female genitals or pubic area with less than a fully opaque covering,
the showing of the female breast with las than a fully opaque covering on any part
of the areola and nipple, or the showing of covered male genitals in a discernibly
turgid state.
b) Public place means all spaces owned by or open to the general
public, whether or not an admission or cover charge is levied for entrance thereto;
and public streets, sidewalks, alleys, or other public thoroughfares, and areas in or
such close proximity thereto, as to be observed by the public traveling on such
street, sidewalk, or other thoroughfare.
SECTION 3. Nudity. Pmhilijlelj:
It shall be unlawful for a person to, knowingly or intentionally, in a public place or in any
place open to the public, appear nude or in a state of nudity.
SECTION 4. Sexual Contact. Prohibited:
a) It shall be unlawful for any employee or performer (including
amateur performers) in any business or commercial establishment to have any
sexual contact with any other employee, performer, person, or patron for gratuity,
pay or other remuneration, direct or indirect, or in conjunction with or as part of
any performance or entertainment in any business or commercial establishment.
b) It shall be unlawful for any person or patron to have sexual contact
with any employee or performer in any business or commercial establishment.
c) For the purposes of this section, sexual contact shall mean the
intentional touching between any person, patron, a performer, or employee
involving contact by or with a patron's, performer's, or employee's sexual organ,
buttock(s), or breast(s), whether covered or not, or kissing, when such contact can
reasonably be construed as being for the purpose of sexual arousal or sexual
gratification of either party or any observer.
d) It shall be unlawful for any person purposely or knowingly to
solicit, induce, or attempt to induce another person to engage in an act or acts
prohibited hereunder.
e) 11 shall be unlawfltl for the owner, lessee, proprietor, or manager
of any business or commercial establishment to knowingly allow any person on
the premises of such business or commercial establishment to engage in an act or
acts prohibited hereunder.
SECTION 5. Exceptions:
a) No person shall be in violation of this Ordinance for breastfeeding
a child.
b) This Ordinance shall not apply to children under the ago of twelve
years old.
c) No person shall be in violation of this Ordinance for appearing
nude or in a state of nudity in any dressing/changing room, locker room, restroom
facility, or hospital, clinic, or other similar medical facility in which appearing
nudc or in a state of nudity is necessary for health-related purposes.
d) No person shall be in violation of this Ordinance for appearing
nude or in a state of nudity in the presence of a licensed physical therapist, licensed
massage therapist, licensed athletic trainer, or licensed cosmetologist, engaged in
performing the functions authorized under the license held.
e) This Ordinance shall not apply to models that are part of a nude
modeling studio that is part of a proprietary school licensed by the State of
Nebraska; or a college or junior college or university supported entirely or in part
by public taxation; or a private college or university which maintains and operates
educational programs in which credits are transferable to a college, junior college,
or university supported entirely or party by taxation.
0 This Ordinance shall also not apply to the exhibition, presentation,
showing or performance of any play, ballet, drama, tableau, production or motion
picture in any theater, concert hall, art center, museum, school, institution of higher
learning or other similar establishment which is primarily devoted to such
exhibitions, presentations, shows or performancesas a form of expression of
opinion, communication, speech, ideas, information, art or drama.
SECTION 6. Penalty:
Any person found to be in violation of this Ordinance shall be guilty of a crime, punishable by a
maximum of a five hundred dollar fine.
SECTION 7. Effective Area:
This Ordinance is effective in Adams County, including any unincorporated towns or villages, but
it shall not be effective within the corporate boundaries Hastings, Ayr, Holstein, Juniata, Kenesaw, Prosser,
Roseland, or Trumbull; nor shall it be effective within the area outside of the corporate boundaries of
Hastings, Ayr, Holstein, Juniata, Kenesaw, Prosser, Roseland, or Trumbull, in which those cities and
villages have been granted and are exercising powers by ordinance on a similar subject matter.
SECTION 8: Effective Date:
This Ordinance shall take effect and be in force fifteen days after its passage, approval, and
publication, as provided by law.

Public Hearing to hear comments in regards to the proposed ordinance 15-0001 was opened at 10:10

Chairman Neumann addressed the room an inquired if anyone would like to speak for or against
proposed County Ordinance 15-0001.
Chairman Neumann requested to leave his seat and address the Board as a member of the Public to
speak in favor of the passing of County Ordinance 15-0001.
No other members of the public wished to speak.

Motion by Curtis, seconded by Czekai to table action on proposed County Ordinance 15-0001 until a
recommendation from the Adams County Planning and Zoning Board is received.
Attorney Brandy Johnson provided the Board with a status update regarding proposed zoning regulation
amendments initiated at the November 17, 2015 Planning and Zoning Board meeting, relating to adult
establishments.
Motion by Weeks, seconded by Czekai to approve the appointment of Danny Trausch to the Planning
and Zoning Board to represent the Roseland area. Roll Call: Ayes: Stromer, Weeks, Czekai, Thomsen,
Curtis, Neumann, Orthmann. Nays: None
Motion by Orthmann, seconded by Czekai to enter closed session for the protection of the public
interest — for the purpose of discussing strategy regarding threat of litigation and pending litigation with
the County's defense counsel relating to Harrington vs. Seward County, et. Al., US District Court Case No.
4:15cv3068.. Roll Call: Ayes: Stromer, Weeks, Czekai, Thomsen, Curtis, Neumann, Orthmann. Nays:

Discussion occurred regarding the setting of the salary for the Adams County Public Defender's position
as the position will be on the 2016 election ballot.
The Adams County Personnel Committee will meet and have a recommendation by the January 5, 2016
meeting.

determining incentive payments.

Reference 39-2501 through 39-2505 Neb. Rev. Stat. In addition to this annual certification of superintendent to the

program integrity to the Board of Public Roads Classifications and Standards es part of the Annual Reporf/SSAR

The Adams County Board of Equalization met on December 15, 2015 at 11:00 a.m. to review and
possibly approve annual motor vehicle exemption renewals and tax list corrections.. Roll Call Members
Present: Michael Stromer- District 1; Mike Weeks -District 2; Jennifer Czekai-District 3; Scott Thomsen -
District 4; Dale Curtis -District 5; Chuck Neumann -District 6; Eldon Orthmann-District 7. Also present
were Adams County Deputy Attorney, David Bergin; Adams County Clerk, Ramona Thomas; Adams
County Assessor, Jackie Russell; Adams County Treasurer, Melanie Curry.
Motion by Weeks, seconded by Czekai to meet as a Board of Equalization for the purpose of hearing
annual motor vehicle exemption requests and tax list corrections. Roll CaII: Ayes: Stromer, Weeks,
Czekai, Thomsen, Curtis, Neumann, Orthmann. Nays: None
Adams County Treasurer, Melaine Curry, presented the Board with the annual renewals of motor vehicle
exemption requests. Curry has reviewed the applications and is requesting the Board approval all
submitted applications.
Motion by Curtis, seconded by Weeks to approve the annual renewals for motor vehicles exemptions as
presented by Curry. Roll Call: Ayes: Stromer, Weeks, Czekai, Thomsen, Curtis, Neumann, Orthmann.
Nays: None
Adams County Assessor, Jackie Russell presented the Board with a list of tax list corrections. Russell has
reviewed these corrections and requested the approval of the Board.
