Courthouse, Adams County, Tuesday January 5, 2016 at 9:30 a.m.
A regular meeting of the Adams County Board of Supervisors was held as public notice given with
Chairman Neumann presiding. Roll Call Members Present: Michael Stromer- District 1; Mike Weeks -
District 2; Jennifer Czekai-District 3; Scott Thomsen -District 4; Dale Curtis -District 5; Chuck Neumann -
District 6; Eldon Orthmann-District 7
Motion by Czekai, seconded by Weeks that this is a meeting on the Adams County Board of Supervisors.
Roll Call, Ayes: Stromer, Czekai, Thomsen, Curtis, Neumann, Weeks, Orthmann. Nays: none
Public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An
agenda was available to the Board members and was kept continuously current and posted in the
County Clerk's Office, the main courthouse lobby and the Adams County website. The following is the
agenda of items to be heard, no modifications were made to the agenda after 9:30 a.m. the business
day prior to this meeting.

The Chairman announced the locations of the open meetings law and agenda in the room and asked if
there were any conflicts of interest with any agenda items.
Minutes of the previous meeting were approved as circulated.
Board members attended the following events and committee meetings and gave a brief report:

Chairman Neumann took this time to compliment how smooth the security system
seems to be running
Chairman Neumann opened the meeting for comments from the public.
There were no public comments made
Chairman Neumann began the process of the reorganization of the County Board for the 2016 calendar
year.
Chairman Neumann inquired if there is any old business that needs to be addressed.
No old business was stated
Siting no new business, Chairman Neuman declared the Board be adjourned sine die for the 2015 year
and appointed the County Clerk, Ramona Thomas as temporary chairperson for the purpose of
gathering nominations for the 2016 chairperson
Clerk Thomas inquired if there was a request for a secret ballot for the purpose of electing leadership
within the Board.
Thomsen stated yes
Clerk Thomas asked if there were nominations for the 2016 Adams County Board Chairman.
Supervisor Mike Weeks nominated Charles "Chuck" Neumann
Clerk Thomas inquired if there were additional nominations
Supervisor Thomsen nominated Eldon Orthmann
Weeks moved that nominations cease, motion seconded by Czekai. Roll Call: Ayes; Stromer, Weeks,
Czekai, Thomsen, Curits, Neumann, Orthmann Nays: None
Secret ballots were distributed, Clerk Thomas announced the results: Neumann — 3 ; Orthmann —4
Eldon Orthmann presided over the meeting as Chairperson
Orthmann requested nominations for the position of Vice -chair of the Adams County Board of
Supervisors for year 2016.
Supervisor Scott Thomsen nominated Dale Curtis
Supervisor Chuck Neumann nominated Mike Weeks
Secret ballots were distributed and the results read by Clerk Thomas: Dale Curtis — 4 ; Mike Weeks — 3
Orthmann requested a motion to name the following banks as Adams County depositories:

Bank of Doniphan
Motion by Curtis to approve naming the stated banks as Adams County depositories, seconded by
Czekai. Roll Call: Ayes; Stromer, Weeks, Czekai, Thomsen, Curits, Neumann, Orthmann Nays: None
Orthmann requested a motion to authorize the County Treasurer to deposit funds in the following local

Motion by Neumann, seconded by Stromer to approve the authorization of the County Treasurer to
deposit funds in the local banks named by Neumann. Roll Call: Ayes; Stromer, Weeks, Czekai, Thomsen,
Curtis, Neumann, Orthmann. Nays: None
Orthmann requested a motion to give consent to the County Treasurer to deposit 100% of capital stock
and surplus in any of the previously named banks.

Orthmann requested a motion to designate the Hastings Tribune as the legal newspaper for Adams
County and the Adams County website, www.adamscountv.org, for the publication of notices of
meetings, public bids, County Board agendas and County Board minutes.
Motion by Czekai, seconded by Curtis to designated the Hastings Tribune and the Adams County
websites as stated by Orthmann. Roll Call: Ayes; Stromer, Weeks, Czekai, Thomsen, Curtis, Neumann,
Orthmann. Nays: None
Supervisor Stromer left the meeting
Orthmann started discussion on Resolution 2016-01-05.02; that would amend the Adams County
Wellness plan participation policy. Heath Lemke, president of the twelfth district F.O.P was available and
spoke as to why the F.O.P was requesting changes to the policy
Extensive discussion took place regarding the current wellness policy and the proposed amendments to
the policy.
Orthmann suggested the matter be heard later in the meeting in closed session as to protect the
reputation of an individual(s)
Motion by Weeks, seconded by Czekai to open the Public Hearing for the proposed 42nd Street road
closure between section 29 and section 32 in the West Blue Township. Roll CaII: Ayes; Weeks, Czekai,
Thomsen, Curtis, Neumann, Orthmann. Nays: None Absent/Not Voting: Stromer

Adams County Road Superintendent Dawn Miller stated the reason for the Public Hearing and presented
Resolution 2015-12-01.02 signed on December 1, 2015 setting the date, time, and reason for the Public

not currently maintained by the County nor is it currently in use as a public roadway, and
WHEREAS, the construction of the 2014 42ntl St. to Showboat BNd. Truck Route has moved the
42"a N. public roadway allgnment south and off the previous section line alignment with the
purchase of new roadway right-of-way, and
WHEREAS, the Highway Superintendent has recommended that the Adams County Board of

WHEREAS, State Statute 1)39-1724 requires a Resolution setting the time, date and place for the
public hearing be published once a week for three (3) consecutive weeks In the legal newspaper
of the County, along with formal notification be sent to all adjacent landowners abutting on
said described roadway and as the described roadway lies within the zoning jurisdiction Of the
City of Hastings, formal notification shall be sent to the Hastings Planning Director and the
Public Works Director, at which time all persons Interested in said road to be dosed/vacated
may appear and be heard,
NOW THEREFORE MN HEREBY DETERMINED AND ORDERED that the Adams County Board of
Supervisors of Adams County, Nebraska, will hold a Public Hearing at 10:00 a.m.
on January 5, 2016, in the Supervisors' room at the Adams
County Courthouse in Hastings, Nebraska, at which time an persons

Chairman Orthmann addressed the room and inquired if anyone wished to speak for or against the
proposed road closure.
David Utecht, chairman of West Blue Township approached the Board. Utecht indicated that the
township has not discussed this matter but understood they had four months to decide if they wish to
take ownership of the section of road to be closed. Utecht will present this matter to the West Blue
Township Board and advise Adams County of their decision.
Motion by Curtis, seconded by Weeks to close the Public Hearing for the 42nd Street road closure. Roll
Call: Ayes; Weeks, Czekai, Thomsen, Curtis, Neumann, Orthmann Nays: None. Absent/Not Voting:
Stromer
Public Hearing closed and regular session resumed at 10:23 a.m.
No action will be taken on the proposed road closure until the County receives notification from West
Blue Township.
Director of the Hastings Public Library, Amy Hafer, provided the Board with a library update, including
the number of rural residence utilizing the library and bookmobile, as well as the library's move to the
museum during the library's renovation project.
Clerk Thomas requested the Board make a motion to formally recognize and designate Dawn R. Miller as
the designated Adams County Highway Superintendent for calendar year 2016.

designated Adams County Highway Superintendent for calendar year 2016. Roll CaII: Ayes; Weeks,

Clerk Thomas presented the Board with a letter sent from the Nebraska Auditor of Public Accounts,
advising the Board of an upcoming audit, and agreement of the terms of the audit.

BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF ADAMS COUNTY,
NEBRASKA that:
The Wellness Criteria adopted by the Board of Supervisors on June 9, 2015, shall be amended in
the following respects:
1. The criteria which states "Participate in the blood draw/screen" shall be amended to state
"Participate in the blood draw/screen conducted by Adams County, or provide to Wellness
Partners a copy of the results of a blood draw/screen conducted by the employee's own health
care provider on or before October 1 of each year."
2. The Motion of the Board of Supervisors which refers to the amount of county funds which
would be placed in the employee's HRA account shall be amended to state "$504.00 for the year
2016 for employees who have met the four wellness criteria during 2015, $252.00 for the year
2016 for employees who have not met the four wellness criteria during 2015, and $504.00 per
year for employees who meet the four wellness criteria during 2016 for the year 2017 and each
subsequent year.

Dawn Miller and Judy Mignery presented the Board with corrections that needed to be made to the
2015/2016 budget per the State Auditor's request. Miller and Mignery advised the Board they will make
the necessary corrections and submit the forms to the auditors. Miller and Mignery will keep the Board
updated if any additional action needs to be taken.
Judy Mignery spoke on behalf of the Adams County Wellness Committee requesting the county continue
to fund the YMCA Lose to Win Program for those employees and spouses that wish to participate.
Previously the county paid 100% of an employee's participation fee and 50% of an employee's spouse
fee. Employees would be required to sign an agreement stating that if they did not complete the
program, they would need to pay the entire entry fee.

The Adams County Board of Equalization met on January 5, 2016 at 10:30 a.m. to review and possibly
approve motor vehicle exemption applications and tax list corrections.. Roll Call Members Present:
Michael Stromer- District 1; Mike Weeks -District 2; Jennifer Czekai-District 3; Scott Thomsen -District 4;
Dale Curtis -District 5; Chuck Neumann -District 6; Eldon Orthmann-District 7. Also present were Adams
County Deputy Attorney, David Bergin; Adams County Clerk, Ramona Thomas; Adams County Assessor,
Jackie Russell; Adams County Treasurer, Melanie Curry.
Motion by Czekai, seconded by Weeks to meet as a Board of Equalization for the purpose of hearing

On September 28, 2015, Mr Elias requested that the mobile home on hit
proPeM have the taxes accelerated in order to sell and remove the mobile
home from his property. (Yaks for mobile homes are not released by the
treasurer's office until taxes are paid In full). The mobile home would need to
be operated from the property value and given 8 new parcel number to do so.
The owner then contacted our office stating that the sale had fallen through
and we would not need to accelerate the taxes. Therefore, the mobile home
did not need IOLL status and due to ceNwl error, the mobile home value was
omitted from the 2015 tax roll. Correcting to add value back to the tax roll.
