Motion by Weeks, seconded by Stromer that this is an open public meeting of the Adams County Board of Supervisors.

Orthmann stated that minutes from the August 16, 2016 meeting have been circulated and will stand approved unless
there is a correction.

Chairman Orthmann opened the meeting for comments from the public.
Adams County Highway Superintendent, Dawn Miller,thanked Board members for their attendance at the informational
flood plain meeting on August 221. Miller informed the Board that she has been notified that some of the information
given was inaccurate and that corrected information will be made available at a later meeting.
Beth Baxter with Region 3 presented the Board with an update from the Region 3 office in Kearney and requested the
Board sign the agreement for Region 3 to provided behavioral services for Adams County.

and
ADAMS COUNTY
LETTER OF AGREEMENT
Purpose
This Letter of Agreement supersedes the Letter of Agreement in effect between the parties hereto for the
period of July 1, 2015 through June 30, 2016. Regional Governing Board for Region 3 Behavioral
Ilealth Services, hereinafter referred to as Region 3, enters into the following agreement with Adams
County, hereinafter referred to as County. This agreement shall become effective for the period of July
1,2016 through June 30,2018.
The Behavioral Health Service Act (Mental Health Commitment Act) mandates that people alleged to
be mentally ill and dangerous shall not be placed in jail but shall be referred to hospital facilities. The
Act also mandates that counties shall be responsible liar implementing the provision of this law by
contracting with facilities located in first class cities either in or outside the county.
Since the County belongs to Region 3 by supporting it with tax match, and has a representative on its
governing board and since Region 3 has the planning and administrative capacity to manage emergency
protective custody services, it is proposed that Region 3 continue the responsibility to act on behalf of
the County by contracting with Mary Lanning Healthcare (MLH), the primary facility to provide
Emergency Protective Custody services, or to Richard Young Behavioral Health (RYBH) as the
principal overflow facility,both institutions capable of providing temporary emergency psychiatric care
for individuals brought to said facilities by law enforcement from County.
Therefore, Region 3 and the County enter into an agreement for the purpose of ensuring proper care of
those who are alleged to be mentally ill and dangerous,under the conditions described in the Behavioral
Health Service Act(Mental Health Commitment Act).
IL Responsibilities of Region 3
Region 3 shall be responsible for coordinating the Emergency Protective Custody (EPC) service by
working with MLH, RYBH, law enforcement agencies, mental health commitment boards and others in
its service area. Region 3 and MLFI or RYBH shall follow the provisions as set forth in the contract for
EPC services.
Region 3 shall be responsible to oversee the financial and programmatic practices of the
EPC program housed at MLII and RYI3II as set forth in the contract between Region 3 and said
hospitals.
Region 3 and MLH or RYBH shall be responsible for the cost of the emergency protective custody
services of those medically stable indigent individuals EPC'd from County as set forth in the contract
between Region 3 and MLH and RYBH.
Responsibilities of the County
County shall work with Region 3 to secure local tax funds to match state funds
needed for IPC services.

County shall work with Region 3 by encouraging its law enforcement agencies to
refer alleged mentally ill and dangerous persons to MLI1 to care for such persons. The
County shall also encourage its law enforcement agencies to follow prescribed EPC
procedures and carry out these procedures in a timely manner.
County shall work with Region 3 by encouraging its county attorney and appropriate mental
health commitment board to conduct necessary Mental Health Board hearings within 60 hours(2.5 days)
of the 36 hour determination made by MLI-I or RYBH that in their judgment an individual is found to be
mentally ill and dangerous.
County shall be responsible to adhere to all relevant confidentiality and privacy laws and regulations,
have in place reasonable administrative, technical, and physical safeguards to ensure security and
confidentiality of Protected Health Information, and a corrective action plan will be developed by the
County to address and remediate any breach of confidentiality.
IV. Other Provisions
This agreement may be modified by mutual consent if all signatories are in agreement and its terms are
subject to change, in accordance with amendments applicable to state statutes, regulations, and/or
available funding.

Adams County Budget preparers; Dawn Miller,Judy Mignery and Ron Kucera, presented the budget and stated some
changes proposed by the Adams County Budget Committee.

Currently the proposed property tax request is$10,707,407.56. Miller stated the budget committee, in an effort to
lower the request,would like to cut all county office budgets by 1%, reduce the amount allotted to Hastings Economic
Development Corporation to$20,000.00 and lower the cash reserve amount from $750,000.00 to$500,000.00.

Extensive discussion followed regarding the amount budgeted for funding to HEDC.
Motion by Thomsen, seconded by Curtis to approve the 2016/2017 budget with the following corrections: reduce all
county offices budget by 1%, allocate $20,000.00 to HEDC and reduce the cash reserve amount to $500,000.00.

Weeks stated he was upset with the outcome of the vote.
Miller presented the Board with Resolution 2016-09-06.03 that would outline a policy for offices spending escrow funds.
The resolution states that all funds escrowed must be spent in the fiscal year in which the escrow account was created,
or the following year.All escrow funds unused during that time frame will be returned back to the general fund.

BE IT RESOLVED BY'JOE BOARD OF SUPERVISORS OF ADAMS COUNTY,
NEBRASKA that:
WIIEREAS,although the use of Escrow Accounts by elected officials and appointed
department heads is an appropriate budgeting tool for large purchases which must be made
frequently;and
WHEREAS,there is also a necessity to control the overall budget for Adams County by
preventing the buildup of large unused cash balances in the budget of each office;
THEREFORE,the Adams County Board of Supervisors hereby finds and decrees that:
I, Escrow Accounts which arc created in the Budget of any elected official or any appointed
department head shall be used during the fiscal year in which the escrow account is created,or
during the following fiscal year,
2. Any funds in an.Escrow Account which have not been used in the manner stated in paragraph
number I.shall revert to the Adams County General Fund at the conclusion of the second fiscal
year.

Adams County Emergency Management Director, Chip Volcek, provided an update on the flooding in southern Adams
County.Volcek indicated that the county has not sustained enough damage to qualify for State or Federal assistance.
Volcek stated the village of Ayr will be able to apply for some funding, and if more damage is received in the county
within a short time frame,funding may be available.
Adams County Highway Superintendent, Dawn Miller, provided a brief update on the road conditions where flooding
occurred. Miller stated all one year projects are on hold and the flood damaged roads are her department's top priority
with harvest traffic starting soon.
Motion by Stromer, seconded by Curtis to remove from table for possible action, plans for the Bruntz and Lyman-Richey

Mark Evans with the City of Hastings Planning Department, stated that no further progress has been made on the two
sub-divisions originally presented on August 16th. Adams County Planning and Zoning director,Judy Mignery, also stated
she still has not been provided a copy for review.
Adams County Deputy Attorney, David Bergin suggested deferring action on the sub-divisions until the Adams County
Planning and Zoning department has a chance to review the plans.
No action was taken on the Bruntz Sub-division and the Lyman-Richey Subdivision, pending review of the Adams County
Planning and Zoning Department.
Deputy Attorney Bergin presented the Board with Resolution 2016-09-06.01 that would implement a policy regarding
employee evaluations. Bergin stated that some modifications have been made to the original wording.
Bergin stated that Supervisor Thomsen suggested the wording in paragraph three, lines four and five should read:
"...that an employee shall not receive any, or any part of, the annual wage increase..."

BE IT RESOLVED,this 6th day of September,2016,the Adams County Board of Supervisors
hereby makes the following changes to the ADAMS COUNTY EMPLOYEE HANDBOOK
which became effective January 1,2012:
On page 8 of the Handbook,in the section entitled"PERFORMANCE EVALUATIONS",
paragraph 3 shall be repealed and reenacted to read as follows:
"The results of this review will be used to determine salary recommendations and to support
subsequent recommendations,if any,for promotion. The evaluation will become an official part
of the employee's personnel record. If an employee's immediate supervisor,whether such
supervisor is an elected official or an appointed department head,determines that an employee
