A regular meeting of the Adams County Board of Supervisors was held with Chairman Eldon Orthmann
was presiding. Roll call members present, Michael Stromer- District 1, Glen Larsen—District 2, Lee
Hogan- District 3 ,Scott Thomsen—District 4, Dale Curtis- District 5,Chuck Neumann—District 6, Eldon
Orthmann—District 7.
Motion by Hogan, seconded by Stromer that this is an open public meeting of the Adams County Board
of Supervisors. Roll Call;Ayes:Stromer, Larsen, Hogan,Thomsen, Curtis, Neumann, Orthmann. Nays:
None.
Orthmann stated that minutes from the June 19, 2018 meeting have been circulated and will stand
approved unless there is a correction.
No corrections were suggested minutes approved by unanimous consent.
Public notice of this meeting has been given by publication in the Hastings Tribune and by posting.An
agenda was available to the board members and was kept continuously current and posted in the
County Clerk's office,the main courthouse lobby and the Adams County website.The following is the
agenda of items to be heard, no modifications were made to the agenda after 9:30 a.m.the business

Chairman Orthmann opened the meeting for comments from the public. No public comments were
made.
Motion by Stromer,seconded by Neumann to open the public hearing to hear comments for or against
the proposed Adams County Floodplain resolution Roll Call;Ayes:Stromer, Larsen, Hogan,Thomsen,
Curtis, Neumann, Orthmann. Nays: None.
Public meeting opened at 9:45 a.m.
Chairman Orthmann inquired it anyone wished to speak for or against the adoption of the Adams
County Floodplain Resolution.
Adams County Roads Superintendent, Dawn Miller, provided the Board with a summary of the
resolution for the creation of floodplain districts.
No other comments were made during the public hearing.
Motion by Curtis, seconded by Larsen to close the public hearing on thefloodplain resolution. Roll Call;
Ayes:Stromer, Larsen, Hogan,Thomsen,Curtis, Neumann, Orthmann. Nays: None.
Motion by Neumann, seconded by Thomsen to approve Resolution 2018-07-03.04 to adopt the creation
of floodplain districts in Adams County. Roll Call;Ayes:Stromer, Larsen, Hogan,Thomsen, Curtis,
Neumann, Orthmann. Nays: None.
Dawn Miller presented the Board with an agreement and resolution for the 2018 fracture critical bridge
inspection between Adams County and the Nebraska Department of Transportation. Miller has
reviewed the agreement and resolution and is recommending approval.
Motion by Hogan,seconded by Larsen to approve the agreement and resolution between Adams County
and the Nebraska department of transportation for the 2018 fracture critical bridge inspection. Roll Call;

Your county has a fracture critical bridge(s)scheduled for inspection and,If necessary,load re-rating. The State of Nebraska,
Department of Transportation(NDOT)has arranged for the inspection and any necessary load re-rating of all fracture critical bridges due
for inspection in 2018. To ensure uniformity of Inspection procedures,NDOT has,on the behalf of your county,hired consultants to
conduct these fracture critical bridge inspections and load re-ratings. Your county's structure(s)have been assigned to JEO.
Enclosed are two copies of an agreement between your county and the NDOT for the 2018 Fracture Critical Bridge Inspections
in your county. Please sign and execute both agreements,Including a signing resolution and return to the Local Projects Section at the
NDOT.
The cost for the bridge inspections In your county Is estimated to be$1,231.41. Soft match credit will be used for counties that
have available and eligible soft match balances for the 20%local share. For those counties not utilizing soft match credit,your county will
be billed 20%of the cost(5246,28)of the inspections. If for any reason,you do not want your soft match credit used to pay the county
share for the inspection,you must notify the Local Project Section in writing prior to signing of the agreement.
A list of the bridges to be inspected in your county are included with the agreement.Please note that it is the county's
responsibility to clean these bridges of debris as appropriate for these inspections.

STATE OF NEBRASKA DEPARTMENT OF ROADS
STATEWIDE 2018 FRACTURE CRITICAL BRIDGE
INSPECTIONS AND LOAD RE-RATINGS
THIS AGREEMENT,entered into by and between Adams County,Nebraska,hereinafter
referred to as the"County",and the State of Nebraska,Department of Transportation,
hereinafter referred to as the"State".
WITNESSETH
WHEREAS,certain bridges on county roads in said County have been designated as
being eligible for Surface Transportation Program(STP)Funds by the Department of
Transportation,Federal Highway Administration,hereinafter call FHWA,in compliance with
Federal laws pertaining thereto,and
WHEREAS,STP Funds have been made available by Title 23 of the United States code,
providing for the inspection and load re-rating(load re-rating is not necessary if bridge condition
remains the same)of the fracture critical bridges on its public roads,and
WHEREAS,the Federal share payable on any project provided for by the above
mentioned code shall not exceed eighty(80)percent of the eligible engineering for bridge
inspection and load re-rating costs thereof,and
WHEREAS,regulations for carrying into effect the provisions of the above mentioned
code provide that the Federal share of the cost of such project shall be paid only to the State,
and
WHEREAS,the County's share of the proposed project shall be twenty(20)percent of the
actual project costs and this share may be funded with County's Soft Match Balance,and
WHEREAS,the State is willing to obtain Federal approval of the proposed work and
Federal funds for the proposed project,with the understanding that no State funds including
State-Aid Bridge funds are to be expended on this project,and
WHEREAS,the County has earmarked or will be using a portion of the County'Soft
Match Balance to pay all project costs not paid for by Federal funds;such costs based on
twenty(20)percent County participation are currently estimated to be$246.28,but such costs
may increase or decrease due to variations between the estimated and actual project costs,and

WHEREAS,the County desires the inspection and load re-rating(if necessary)of the
fracture critical bridges on its public roads, as evidenced by the Resolution of the County Board
dated the day of , 2018,attached hereto, identified as Exhibit'`A", and
hereby made a part of this agreement, and
NOW THEREFORE, in consideration of these facts,the parties hereto agree as follows:
SECTION 1. The State and the County agree that the Federal share payable on this project
shall not exceed eighty(80)percent of the eligible engineering for bridge inspection and load re•
rating(if necessary)costs thereof.
SECTION 2. The State hereby agrees to present this project to the FHWA for its approval, if
necessary, and the County understands that no State funds will be expended for this project.
SECTION 3. The State agrees to cause to be performed the inspection and load re-rating (if
necessary)of the fracture critical bridges that are due for inspection in 2018 in the County. The
State will continue to have jurisdictional responsibility for all public bridges on the State highway
system. Further,the State will be responsible for arranging for the inspection by consultants,fol
the county, on their fracture critical bridges. It is the intent of the parties that this agreement
does not shift to the County any jurisdictional responsibility for bridges on the State highway
system,and does not shift any duty to the State for jurisdictional responsibility of any bridges oft
of the State highway system.
SECTION 4. The proposed work of the Consultant shall be performed in accordance with the
following publications:
1. AASHTO Manual for Bridge Evaluation(MBE) First Edition 2008.
2. AASHTO Standard Specifications for Highway Bridges, 17th Edition, 2002(LFD)
3. Minimum Design Standards,2008, Board of Public Roads Classifications and Standards.
4. Safety Inspection of In-Service Bridges, 2004
5. Fracture Critical Techniques for Steel Bridges, 2006
6. Bridge Inspection Program Manual,2010
7. Coding Guide for Structure Inventory and Appraisal, published by the State, March 2002.
8. AASHTO LRFD Bridge Design Specifications,4th Edition, 2007
SECTION 5. The total cost of this work is currently estimated to be$1,231.41,with the
County's twenty(20) percent share being$246.28. Both parties recognize this is a preliminary
estimate and the final costs may well be higher or lower. Costs incurred by the State with
respect to the entire project shall be considered as a part of the total cost of the project to be
paid out of County and Federal funds. It is also understood that the costs incurred by the State
attributable to this project,will not include any administrative cost or expenses of State

administrative officials. The final settlement between the State and County will be made
following final audits and when final costs have been determined by the State.
SECTION 6. It is further understood that the County's share of the total project costs shall be all
costs not paid for by Federal funds. Therefore,if the Federal government refuses to participate
in the project or any portion thereof,the County is responsible for full project payment with no
cost or expense to the State in such project or portion thereof. Should the project be
abandoned before completion,the County will pay all costs incurred by the State prior to such
abandonment.
IN WITNESS WHEREOF,the parties hereto have caused these presents to be executed
by their proper officials thereunto duly authorized as of the dates below indicated.

assist County in the development and construction of an LPA Federal-aid transportation project;
Whereas: The project construction has been tentatively accepted and the State,on LPA's
behalf, has recommended that the project is ready for final acceptance;
Whereas: The LPA Program Agreement requires the county to review and formally approve
State's recommendation that the project is ready for final acceptance;
Whereas: County has reviewed the State's recommendation and agrees that the project has
been constructed according to the plans, specifications and any change order(s)and that the

Miller stated the agenda item relating to the Ayr Shop Subdivision and declaring the property as surplus
would need to be deferred until the Adams County Planning and Zoning Committee have an opportunity
to review the case.
Adams County Treasurer, Melanie Curry, presented the Board with the proposed 2018/2019 budget for
the Adams County Treasurer's office in the amount of$629,902.85.

All county office budgets will be reviewed by the Adams County Budget Committee and approved at a
later date.
Adams County Treasurer, Melanie Curry, requested a motion from the board to approve$100.00 in the
long/short fund for the Adams County Treasurer.

Adams County Maintenance Supervisor,Thomas Reichert, presented the board with the proposed

Adams County Sheriff, Gregg Magee,was called to the meeting to review for possible approval a law
enforcement agreement between Adams and Grant Counties. Magee stated that he was unaware of
such agreement and requested to defer action until a later providing him a change to review the
document.
Motion by Stromer, seconded by Curtis to approve the claims and direct the county clerk to pay them
