A regular meeting of the Adams County Board of Supervisors was held with Chairman Eldon Orthmann
presiding. Roll call members present, Michael Stromer- District 1,Glen Larsen—District 2, Lee Hogan-
District 3,Scott Thomsen—District 4, Dale Curtis- District 5,Chuck Neumann—District 6, Eldon
Orthmann—District 7.
Motion by Neumann, seconded by Stromer that this is an open public meeting of the Adams County
Board of Supervisors. Roll Call;Ayes:Stromer, Larsen, Hogan,Thomsen,Curtis, Neumann, Orthmann.
Nays: None
No corrections were suggested, minutes approved by unanimous consent.
Public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An
agenda was available to the board members and was kept continuously current and posted in the
County Clerk's office,the main courthouse lobby and the Adams County website.The following is the
agenda of items to be heard, no modifications were made to the agenda after 9:30 a.m.the business
day prior to this meeting.

Orthmann- January 7,2020-Attended an Adams County Building and Grounds Committee meeting
Chairman Orthmann opened the meeting for public comment.
County Court Judge Magistrate,Tom Hawes, addressed the Board regarding concerns of the walkways
up to the main courthouse building being cleared of snow and/or ice by 8:00 a.m.
Maintenance Director,Tom Reichert was in attendance and stated salt is thrown out by 8:00 a.m.
however some heat is needed to activate it, in shady areas or times in which the temperature does not
climb enough, some areas can still remain slick.The maintenance department has also experimented
with some pretreatment however that can get washed away with additional rain or snow received.
No additional public comments were made and public comment closed.
Chairman Orthmann inquired if there was any old business to address before the board proceeds with
reorganization for the year 2020.
No old business was addressed.
Chairman Orthmann requested a motion that the Adams County Board of Supervisors adjourns sine dine
for 2019 and appoint the Adams County Clerk as the temporary chairman to proceed with the
reorganization for 2020.
Motion by Curtis,seconded by Larsen to adjourn sine dine and appoint the clerk as temporary chairman
for reorganization of the board. Roll Call;Ayes:Stromer, Larsen, Hogan,Thomsen, Curtis, Neumann,
Orthmann. Nays: None
County Clerk, Ramona Thomas, requested nomination for the 2020 Adams County Board Chairman.
Supervisor Charles(Chuck) Neumann nominated Lee Hogan for the 2020 Chairman position.
Clerk Thomas called for additional nominations twice.
No additional nominations were received.
With no additional nominations received,clerk Thomas inquired if anyone would like to make a motion
that nominations cease and a unanimous ballot be cast for Lee Hogan.

Motion by Neumann, seconded by Larsen that nominations for the 2020 chairman cease and a
unanimous ballot be cast for Lee Hogan. Roll Call;Ayes:Stromer, Larsen, Hogan,Thomsen, Curtis,
Neumann, Orthmann. Nays: None
Chairman Hogan requested nominations for the 2020 Adams County Vice Chairman.
Supervisors Scott Thomsen nominated Supervisor Dale Curtis for the 2020 Vice Chairman
Supervisor Eldon Orthmann nominated Supervisor Chuck Neumann
No additional nominations were received.
A closed vote was conducted (§84-1413) and the votes collected by the county clerk.
Four(4)votes were cast for Supervisor Neumann,three (3)votes cast for Supervisor Curtis.
Chairman Hogan inquired if there is any requested changes to the committee representation for 2020.
No reassignment of committees were made and committee assignments will remain the same for 2020.
Motion by Curtis,seconded by Stromer to approve Wells Fargo, Heritage Bank, Pinnacle Bank,Adams
County Bank, NPAIT, Five Points Bank, US Bank, Heartland Bank and the Bank of Doniphan as
depositories for 2020. Roll Call;Ayes:Stromer, Larsen, Hogan,Thomsen,Curtis, Neumann, Orthmann.

A RESOLUTION TO UPDATE AND ADOPT THE FUTURE LAND USE PLAN
MAP AND THE OFFICIAL ZONING MAP OF ADAMS COUNTY,
NEBRASKA; AND TO PROVIDE WHEN THIS RESOLUTION SHALL BE IN
FULL FORCE AND EFFECT
WHEREAS the duly appointed Planning Commission of Adams County, Nebraska has
assisted in the preparation of an updated zoning map with amendments,reviewed the information,
held the required public hearing on January 6th, 2020 with proper notice given, and has given a
recommendation to update and approve the official zoning map to the County Board;and
WHEREAS the County Board of Supervisors had given public notice as required by the
Nebraska State Statutes, of a hearing held the 7th day of January, 2020 in the Adams County
Courthouse on the proposed update to the Official Zoning Map;and
WHEREAS the public hearing has been held pursuant to said notice and all statements
received at the hearing have been duly considered by the County Board of Supervisors.
NOW,THEREFORE,BE IT RESOLVED,by the Board of Supervisors of Adams County,
Nebraska,that:
An Amendment to the Comprehensive Plan to Update the Future Land Use Plan and a
complete update to the Official Zoning Map of Adams County is approved.
FURTHER IT BE IT RESOLVED,that this Resolution shall be in full force and effect from
and after passage,approval and publication or posting required by law and all other resolutions and
sections in conflict are hereby repealed.
There were no members of the public present wishing to speak during the public hearing.
Motion by Curtis,seconded by Stromer to close the public hearing and resume regular session. Roll Call;

Adams County Sheriff,John Rust, presented the Board with a list of service fees charged by the Adams
County Sheriff's office. Rust is requesting approval of the fees per the state auditor's recommendation.

BE IT FURTHER RESOLVED that as stated in Adams County Resolutions 74-13 and 76-1-6,the position of

for 2020
This is a management fee proposal for HR Total Solutions LLC(Consultant)to conduct
compensation administration activities related to the Step Program for the Adams County
Board of Supervisor's Personnel Committee(Committee)to include:
o Manage Step Plan activities as required to include:
• Update compensation survey data from other counties
• Prepared reports and statistics on Step Program
• Research annual cost of living data
• Make step adjustments as required for calendar year 2020
o Research compensation issues and make recommendations
The fee will be invoiced by HR Total Solutions LLC at the completion of the final July 1 STEP
work product and paid by Adams County by the 30e of the month invoiced.The Agreement can
be terminated by either party at any time with 30 day notice.

Out of scope tasks,not related to the Adams County Step Program will be billed at a rate of
$50/hour. Examples of out of scope tasks might Include creating job descriptions,advising and
creating programs for the Committee on Employee Relations issues/problems. Out of Scope

Chairman Hogan started discussion regarding the position of the Adams County Surveyor.Counties have
the option of adopting a resolution to continue to elect a county surveyor, or the issue may be sent to a
vote of the public.
Extensive discussion took place regarding the Adams County Surveyor position, including if a benefit
package would continue to be offered.
Chairman Hogan directed Deputy Attorney Bergin to daft resolutions for available options regarding the
surveyor position,to be considered during the February 4, 2020 Board meeting.
Clerk Thomas was instructed to place the agenda for the February 4, 2020 meeting.

County Surveyor Elections
Legislation was enacted in 2014 to require the election of county surveyors in all counties under 150,000
unless certain actions are taken.This requirement does not apply if the steps below have been taken or
if the office of county surveyor has been consolidated with the office of the county engineer,clerk,
assessor,clerk of the district court,or register of deeds.(See Neb.Rev.Stat.§22-417.)
In counties with an elected surveyor as of January 1,2020:
The county board may,following a public hearing,adopt a resolution to continue to elect the county
surveyor.The resolution must be adopted prior to February 1, 2020.The question is not submitted to
voters and the office of county surveyor continues to be an elected position.
If the county board does not adopt a resolution to continue to elect the county surveyor,the question of
electing a county surveyor must appear on the general election ballot in November 2020.
• If a majority of votes cast are against the election of the office of county surveyor,the elected
office ceases to exist at the end of the term of the incumbent and the office becomes an
appointed position.The appointee serves the same four-year term as an elected surveyor.
• If a majority of votes cast are in favor of the election of the office of county surveyor,the office
continues to be elected.
In counties with an appointed surveyor:
The question of electing a county surveyor must appear on the November 2020 general election ballot
in counties with an appointed surveyor.
• If a majority of votes cast are against the election of the office of county surveyor,the office
remains an appointive position.
• If a majority of votes cast are in favor of the election of the office of county surveyor,the office
is filled through election at the next statewide general election in November 2022.
For all counties after 2021:
Beginning in 2021,the question of electing a county surveyor can be placed before voters at the next
statewide general election by county board action or a petition.
• If the county board wants to place the issue on the ballot,it must adopt a resolution on or

• If a petition process is used,it must be signed by at least 10 percent of the registered voters in

Deputy Attorney Bergin presented the Board with a Quit Claim Deed for property that Banana Farms LLC
purchased from Adams County by sealed bid. Bergin has reviewed the document and is requesting
approval as the bid for the property was accepted during the December 3, 2019 meeting.

Supervisor Thomsen stated there have been several discussions regarding the replacement of the boiler
in the main courthouse building.

Supervisor Thomsen started discussion on allowed signage within the Adams County owned buildings. It
was brought to the Board's attention by a county employee that a sign supporting the Army National

opens the door for any entity to place signage in the courthouse.
The Board directed Deputy Attorney Bergin to draft a resolution in regards to allowed signage in county
buildings.The resolution will be considered during the next regular meeting.
