A regular meeting of the Adams County Board of Supervisors was held with Chairman Lee Hogan
presiding. Roll call members present, Michael Stromer District 1,Glen Larsen—District 2, Lee Hogan-
District 3,Scott Thomsen-District 4, Dale Curtis-District 5,Chuck Neumann—District 6, Eldon
Orthmann—District 7.
Motion by Orthmann, seconded by Stromer that this is an open public meeting of the Adams County
Board of Supervisors. Roll Call;Ayes:Stromer, Larsen, Hogan,Thomsen,Curtis, Neumann, Orthmann.
Nays: None
Chairman Hogan requested approval of the June 2, 2020 meeting minutes.
Motion by Larsen,seconded by Curtis to approve the meeting minutes from June 2, 2020. Roll Call;
Ayes:Stromer, Larsen, Hogan,Thomsen,Curtis, Neumann,Orthmann. Nays: None
Public notice of this meeting has been given by publication in the Hastings Tribune and by posting.An
agenda was available to the board members and was kept continuously current and posted in the

2020 meeting and provided a brief report:
Thomsen June 2,2020—Attended a justice center committee meeting
June 3,2020—reported that the treasurer's office had opened after several weeks of
being closed to walk in traffic due to the COVID-19 pandemic. However the office was
forced to close again due to a treasurer's office employee testing positive for the Corona
Virus.The tentative opening date for the treasurer's office is Thursday,June 18th

Orthmann- June 16,2020—Attended an Adams County Safety Committee meeting
Neumann- June 4, 2020—Attended a Midland Agency on Aging board meeting via phone
June 9,2020—Attended a Combined Services Committee meeting
June 10,2020—Attended a Wellness Committee meeting where Mary Lanning Hospital
proposed a wellness plan for the county and a request was received from the sheriff's
department to install a vending machine in the basement of the main courthouse

June 9, 2020—Had a meeting with Deputy Attorney David Bergin and Chairman Lee

Larsen- All committee meetings were cancelled due to the COVID-19 pandemic but did tour
some of the county's rural roads with Chairman Hogan.

Chairman Hogan opened the meeting to hear comments from the public.
Deputy County Attorney David Bergin spoke during public comment to thank Rachel Ormsby for
switching blood draw times with him for the Adams County Health Fair.
No other public comments were received and public comment was closed.

Adams County Highway Superintendent, Dawn Miller, presented a request received by Chrisella Lewis,
of Alma, Nebraska for a permanent road closure of 1.5 miles of Winchester Ave to Old Sod Road in
Adams County. Lewis owns property in this area.

SETTING DATE&TIME FOR PUBLIC HEARING
for South Winchester Avenue Closure J Vacation
WHEREAS,the Adams County Board of Supervisors received a request for the closure
/vacation of a portion of unimproved South Winchester Avenue,and
WHEREAS,the Alms County Highway Superintendent has inspected and further
recommends to the Adams County Board of Supervisors that this described and
unimproved segment of South Winchester Avenue closed/vacated,and
WHEREAS,a public hearing in required to hear public comments on the possible
closure/vacation of this unimproved segment of roadway known as South Winchester
Avenue.further described as:
Starting 33 feet north of the common corner at the south end between Sections 32
& 33,T6N-R12W.Adams County,thence north on section line 5.247 feet,and
ending at the common corner at the north end of said Sections 32 and 33,Adams
County,Nebraska(see attached map); and
WHEREAS,said segment of unimproved road has been abandoned for all maintenance
purposes for over 20 years,
BE IT NOW RESOLVED,that in accordance with Nebraska Revised Statute#39-1724
directing that a public hearing be held in regards to possible road closure/vacation and
that the date shall be on Tuesday.July 21. 2020 ( a.m.in the Board of
Supervisors' room,Adams County Courthouse.Hastings,Nebraska.

Miller presented bridge construction bids for Project C1-490 @ br. 03020 on Oregon TrailY2 west
of Showboat; County Bridge Match Program funding site.This is a joint project with Nuckolls
County. Bids were reviewed by both Miller and representatives from Nuckolls County. Miller
stated the recommendation is to award the project to the low bidder;Theisen Construction for
a total amount of$741,602.48 of which $415,570.00 is the responsibility of Adams County.

III.REPORTS

IV.STIPULATIONS AND RESTRICTIONS

- Owners(WS form 12B)or a Work Initiation Document for Management of Wildlife Damage on
Urban Properties(WS Form 12C)will be executed between APHIS-WS and the landowner,lessee,
administrator before any APHIS-WS work is conducted.
c.APHIS-WS will use only APHIS-WS employees and APHIS Volunteer Program participants. All
APHIS-WS employees and APHIS volunteers have successfully met APHIS firearm safety standards.

V.COST ESTLIIATE FOR SERVICES
The cooperator will reimburse APHIS-WS for expenses incurred,not to exceed 511,450.29.Costs include;

LETTER OF AGREEMENT
I. Purpose
This Letter of Agreement supersedes the Letter of Agreement in effect between the parties hereto for the
period of July 1,2018 through June 30,2020. Regional Governing Board for Region 3 Behavioral
Health Services,hereinafter referred to as Region 3,enters into the following agreement with Adams
County,hereinafter referred to as County.This agreement shall become effective for the period of July
1,2020 through June 30,2022.
The Behavioral Health Service Act(Mental Health Commitment Act)mandates that people alleged to
be mentally ill and dangerous shall not be placed in jail but shall be referred to hospital facilities.The
Act also mandates that counties shall be responsible for implementing the provision of this law by
contracting with facilities located in first class cities either in or outside the county.

Since the County belongs to Region 3 by supporting it with tax match, and has a representative on its
governing board and since Region 3 has the planning and administrative capacity to manage emergency
protective custody services, it is proposed that Region 3 continue the responsibility to act on behalf of
the County by contracting with Mary Lanning Healthcare (MLH), the primary facility to provide
Emergency Protective Custody services, or to Richard Young Behavioral Health (RYBH) as the
principal overflow facility,both institutions capable of providing temporary emergency psychiatric care
for individuals brought to said facilities by law enforcement from County.
Therefore,Region 3 and the County enter into an agreement for the purpose of ensuring proper care of
those who are alleged to be mentally ill and dangerous,under the conditions described in the Behavioral
Health Service Act(Mental Health Commitment Act).
11. Responsibilities of.Region 3
Region 3 shall be responsible for coordinating the Emergency Protective Custody (EPC) service by
working with MLH,RYBH,law enforcement agencies,mental health commitment boards and others in
its service area.Region 3 and MLH or RYBH shall follow the provisions as set forth in the contract for
EPC services.
Region 3 shall be responsible to oversee the financial and programmatic practices of the
EPC program housed at MLH and RYBH as set forth in the contract between Region 3 and said
hospitals.
Region 3 and MLH or RYBH shall be responsible for the cost of the emergency protective custody
services of those medically stable indigent individuals EPC'd from County as set forth in the contract
between Region 3 and MLH and RYBH.
III. Responsibilities of the County
County shall work with Region 3 to secure local tax funds to match state funds
needed for EPC services.
County shall work with Region 3 by encouraging its law enforcement agencies to
refer alleged mentally ill and dangerous persons to MLH to care for such persons. The
County shall also encourage its law enforcement agencies to follow prescribed EPC
procedures and carry out these procedures in a timely manner.
County shall work with Region 3 by encouraging its county attorney and appropriate mental
health commitment board to conduct necessary Mental Health Board hearings within 60 hours(2.5 days)
after the 36 hour determination made by MLH or RYBH that in their judgment an individual is found to
be mentally ill and dangerous.
County shall be responsible to adhere to all relevant confidentiality and privacy laws and regulations,
have in place reasonable administrative, technical, and physical safeguards to ensure security and
confidentiality of Protected Health Information, and a corrective action plan will be developed by the
County to address and remediate any breach of confidentiality.
IV. Other Provisions
This agreement may be modified by mutual consent if all signatories are in agreement and its terms are
subject to change, in accordance with amendments applicable to state statutes, regulations, and/or
available funding.

Reason for Correction
Property on Jan 1 was orignially all market land(3.96 AC)with building value,but owner
combined this parcel with an additional 5.84 AC that included an outbuilding site acre and a
Metal Building from parcel ID 010003718 which was also classified as Ag Land(grass)on Jan
1. Therefore,we need to change the land classification on this parcel and since this parcel
already had a 2nd acre of land,the outbuilding site value from 010003718 does not have the
same contributory value for this parcel and we can not come back to the orignal Jan 1st value
as statute intends for splits and combos filed after January 1st. Therefore,we are correcting
the current year value to reflect the combo appropriately by our set land values and not over
inflate the value of the land on this parcel.

Lifehouse Church representative,Alton Jackson,addressed the board regarding the church's failure to
file a form 451 for tax exemption of their tax exempt property.Jackson stated that a form 521 was filed
for the church by their attorney, Dave Fisher.Jackson also stated that the current COVID-19 pandemic
has caused a decrease in donations and the tax burden may be too great for the church to handle.
Jackson stated that many exemptions have been made in light of the pandemic.Jackson also stated the
church faced another hardship with a fire that occurred shortly after they took ownership of the
property and is having issues with insurance covering the damage.
Lifehouse Church representative Paige Mackey also addressed the board. Mackey also cited the form
521 that was filed and the document denotes the entity is non-profit. Mackey cited other deadlines are
publically published in the newspaper. Mackey stated they were unaware of any additional form to be
filed after the form 521. Mackey stated the church has paid first half of the taxes due$22,382.50 by May
1, 2020.
Jackson and Mackey are requesting the Adams County Board of Supervisors considers forgiving the
property taxes for Lifehouse Church for 2019.
Supervisor Neumann stated he would like to find a way to grant an exemption for Lifehouse Church.
Brief discussion occurred among board members.
Assessor Russell was asked to speak on the issue. Russell form 521 is a transfer statement and was filed
by Lifehouse Church. However a tax exempt entity must seek a tax exemption by way of a form 451
which was not filed by the deadline. Russell stated she has no power to correct anything at this point if
the board should choose to make an exemption, and Russell is unaware if the board has the power to
make an exemption in this scenario.
Deputy Attorney David Bergin was asked his opinion. Bergin informed the board that in addition to the
complications outlined by Russell,the state auditor's office may have a finding against the board. If the
board chooses to grant exemption and the decision is reversed at the state level,the county would be
obligated to pay the tax amount or collect it from Lifehouse Church.
Discussion/debate again occurred among board members.
Motion to provide the exemption for Lifehouse Church was made by Neumann,the motion was
seconded by Orthmann.
Supervisor Larsen requested to hear the motion again.
Neumann stated it was a motion to approve the exemption for Lifehouse Church.
Chairman Hogan asked if there was any more discussion.
Brief comments were made by Supervisors Neumann and Hogan.
Chairman Hogan called for a vote on the motion to provide the exemption for Lifehouse Church. Roll
Call:Ayes; Larsen, Hogan, Neumann, Orthmann. Nays:Stromer,Thomsen, Curtis
Board of Equalization was adjourned by unanimous consent and regular session resumed at
approximately 10:30 a.m.
