A regular meeting of the Adams County Board of Supervisors was held with Chairman Eldon Orthmann
was presiding. Roll call members present, Michael Stromer-District 1, Glen Larsen—District 2, Lee
Hogan- District 3 ,Scott Thomsen—District 4, Dale Curtis- District 5,Chuck Neumann—District 6, Eldon
Orthmann—District 7.
Motion by Curtis,seconded by Stromer that this is an open public meeting of the Adams County Board
of Supervisors. Roll Call;Ayes:Stromer, Larsen, Hogan,Thomsen, Curtis, Neumann,Orthmann. Nays:
None.
Orthmann stated that minutes from the November 20, 2018 meeting have been circulated and will
stand approved unless there is a correction.
No corrections were suggested minutes approved by unanimous consent.
Public notice of this meeting has been given by publication in the Hastings Tribune and by posting.An
agenda was available to the board members and was kept continuously current and posted in the
County Clerk's office,the main courthouse lobby and the Adams County website.The following is the
agenda of items to be heard, no modifications were made to the agenda after 9:30 a.m.the business
day prior to this meeting.

Board members attended the following community events and committee meetings since the
November 20, 2018 meeting and provided a brief report:
Thomsen- November 20,2018—performed a walk through at the former Wallace school that the
county recently purchased
November 27,2018—Served as Teen Court Judge
-Thomsen made the comment that he has requested more frequent updates from those
entities in which the county provides budget assistance
-Had numerous conversations with Deputy County Attorney, David Bergin, regarding
§29-2259 and what the county's obligation is in regards to purchasing computer
equipment for the District 10 Probation Office
December 3,2018—Attended an Adams County Planning and Zoning meeting
Thomsen made comments about possibly renting the common area in the former
Wallace school building similar to the ACOB building.
-Thomsen stated that the Adams County Extension Office will be moving in to the
former Wallace building next week,which lead to a comment about renaming the
building to denote it as an Adams County building.

November 28,2018—Participated in an emergency pandemic exercise conducted by
South Heartland District Health Department
Neumann stated he had received a call from Larry Woodman of Kenesaw,stating his
opinion on Adams County contributing funds to improvements of the Highway 6 and

Adams Central Road intersection.The comments from Woodman were not in favor of
county funds being spent as the school district chose to build the elementary school at
that location knowing the traffic issues it would cause.
Orthmann- December 4,2018—Attended and Adams County Building and Grounds Committee
meeting
Orthmann stated he had received the same call that Supervisor Neumann did,from
Larry Woodman of Kenesaw regarding the Adams Central and Highway 6 intersection
Chairman Orthmann opened the meeting for comments from the public.
Margaret Marsh of 1515 W 7th Street in Hastings, addressed the Board regarding her concerns over
placing an "In God We Trust"sign in the courthouse. Marsh stated it is not inclusive of all religions and
not appropriate for the courthouse.
Adams County Assessor,Jackie Russell,addressed the Board regarding the possibility of the courthouse
being closed on Monday, December 24.2018 for Christmas Eve.The Board stated it subject of possibly
closing the courthouse on December 24,2018 would be considered during the December 18, 2018
Board meeting.
Chairman Orthmann closed public comment.
Supervisor Thomsen left the room at 9:57 a.m.
Youth Task Force Director,Carissa Uhrmacher, requested the Board sign a memorandum of
understanding for juvenile services and county aid funding. Uhrmacher stated there is no fee due from
the county and that the county acts as a fiscal agent for the funds to run through.
Supervisor Thomsen returned to the meeting at 9:59 a.m.
Motion by Thomsen, seconded by Stromer,to approve the Chairman signing the Memorandum of
Understanding between Adams County and the Your Task Force. Roll Call;Ayes:Stromer, Larsen, Hogan,
Thomsen, Curtis, Neumann, Orthmann. Nays: None.
MEMORANDUM OF UNDERSTANDING
REGARDING JUVENILE SERVICES
COUNTY AID FUND +G
The Youth Task Force(YTP)is serving as the lead organization in the
ase cent,distribution,and evaluation of the State Community Based Juvenile
Justice Aid through the Nebraska Commission on Law Enforcement and Criminal:
Justice. 1t is the desire of the following counties: Webster,Clay,Adams,IsittekoBs,
Fillmore,Phelps,Kearney,Franklin,and Harlan to continue this arrangement for
the funding requested for 2019-2020.
On October 31,2001,the original four counties(Adams,Clay,Nuckolla,and
Webster)led by Clay County in the effort to work with juveniles from ages 12-18 at-
risk of on in the juvenile justice system. Assessments were made in 42 focus groups
to develop the We CAN Juvenile Services Plan during200I-2002..Five other
counties joined in 2013. The present Comprehensive County Juvenile Services Plan
has been updated with input from the Juvenile Justice Institute.,as well as
representatives from each of the nine counties for 2019-2021. All nine agree yearly
to participate in the plan and fending. Adams County became the lead county itt
2018.
Melanie Curry,Adams County Treasurer,serves as the fiscal agent. As
such,she will handle all financial transactions including income and expenses.
Carissa to rsnachcr,Project Director,writes application,facilitates'S!TF,handles an.
communication and makes contact with County Boards in each of the nine counties,
and Laura Stutte serves as Project Administrator.The project administrator awsi is
in overseeing contacts from local non-profits,businesses,and individual,}working
with juveniles in the nine county region and..

All quarterly reports arc submitted to the Nebraska Crime Commission and
JII. M011's and Special Conditions with each program are signed annually An
audit of all reports Is conducted.annually.
This memorandum of understanding is to be Signed by the County Board
Chair in each of the counties in order for said county to be a part of this regional
community based juvenile services grant that is duo in Lincgln,Nebraska December.

This Lease Agreement,hereinafter this"lease,"executed in duplicate,is by and between Adams County,
hereinafter known as"Lessor,"and Department of Administrative Services,State Building Division,an agency of

1.1 Common Areas—Definition.'Common Areas"are all areas and facilities outside the Demised
Premises and within the exterior boundary line of the bunding and grounds and interior utaity
raceways within the Demised Premises that are provided and designated by Lessor from tine to
time for the general non-exclusive use of Lessor,Lessee/Tenant Agency and other tenants of the
building and their respective employees,suppliers,shippers,tenants,contractors and invitees.
1.2 Common Areas—Lessee/Tenant Agency's Rights Lessor hereby grants to Lessee,for the benefit
of Tenant Agency and its employees,suppliers,shippers,contractors,customers and Invitees,
during the term of this Lease,the non-exclusive right to use,in common with others entitled to
such use,the Common Areas as they exist from time to time,subject to any rights,powers,and ;;ry
privileges reserved by Lessor under the terms hereof.
2.Term.

4.Termination.

WHEREAS,Adams County,Nebraska,a political subdivision of the State of Nebraska
(Adams County),the City of Hastings,Nebraska,apolitical subdivision of the State of Nebraska
(City of Hastings),and the State of Nebraska,Department of-Transportation(NDOT)are all
public agencies within the meaning of Neb.Rev.Stat. § 13-803(2),and thereby have the
authority to enter into an interlocal agreement pursuant to the Interlocal Cooperation Act(Neb.
Rev.Stat. §§13-801-13-837);and
WHEREAS,Adams County,the City of Hastings,and the NDOT have reached an
agreement regarding the sharing of costs for the detour route to be utilized during construction,
by NDOT,of the following road project:Project S-6-4(1022),C.N.41086,Hastings Southeast
(US-6),hereinafter referred to as"the Project";
NOW THEREFORE,in consideration of the foregoing recitals,Adams County,the City
of Hastings,and the NDOT hereby agree to share costs on the above-named Project in the
mariner stated subsequently set forth.
1. Adams County shall be the lead agency in regards to this Project and shall be in
charge of bidding the project,contractual work,and work directly with engineers.
2. The total cost of the Project is currently estimated to be approximately$1.2 million
dollars and shall be divided between the parties to this interlocal agreement as follows:
A. The NDOT agrees to pay the City and County the total sum of Six Hundred Sixty
Thousand Dollars($660,000.00)towards the cost of the Project as shown on the attached Exhibit
"A",payable Three Hundred Thirty Thousand Dollars($330,000.00)upon the award of the
construction contract by Adams County,and Three Hundred Thirty Thousand Dollars
($330,000.00)on or before August 1,2019.
B. Adams County,Nebraska and the City of Hastings,Nebraska,agree that the total cost
of the Project,including engineering costs,less the amount paid by the NDOT shall be split
equally between Adams County and the City of Hastings,which is currently estimated to be
approximately Two Hundred Seventy Thousand Dollars($270,000.00),which amount may
change based upon the bids received by Adams County for the Project and the final amount paid
and received from the NDOT.

City of Hastings hereby agree to share costs on the above-named Project in the manner stated

1. The City of Hastings shall be the lead agency in regards to this Project and shall be in

2. The total cost of the Project is currently estimated to be approximately$1.4 million
dollars and shall be divided between the parties to this interlocal agreement as follows:
A. Adams County agrees to pay the City of Hastings the sum which is currently
estimated to be approximately Two Hundred Seventy Thousand Dollars($270,000.00)towards
the cost of the Project with City of Hastings agreeing to pay the balance of the paving costs of
the Project. This estimate is based upon the previously mentioned interlocal agreement
contemporaneously entered into by the parties with the NDOT. Adams County's payment to the
City of Hastings shall be made according to the following schedule:

B. The parties agree and understand that Adams County's payment is an estimate and the
amount of said payment of may change based upon the bids received by the City of Hastings for
