A regular meeting of the Adams County Board of Supervisors was held with Chairman Eldon Orthmann
presiding. Roll call members present, Michael Stromer- District 1,Glen Larsen—District 2, Lee Hogan-
District 3, Dale Curtis-District 5,Chuck Neumann—District 6, Eldon Orthmann—District 7. District Four
Supervisor Scott Thomsen was absent.
Motion by Hogan,seconded by Stromer that this is an open public meeting of the Adams County Board
of Supervisors. Roll Call;Ayes:Stromer, Larsen, Hogan, Curtis, Neumann,Orthmann. Nays: None.
Absent:Thomsen
Orthmann stated that minutes from the August 6, 2019 meeting have been circulated and will stand
approved unless there is a correction.
No corrections were suggested minutes approved by unanimous consent.
Public notice of this meeting has been given by publication in the Hastings Tribune and by posting.An
agenda was available to the board members and was kept continuously current and posted in the
County Clerk's office,the main courthouse lobby and the Adams County website.The following is the
agenda of items to be heard, no modifications were made to the agenda after 9:30 a.m.the business

Adams County Deputy Attorney, David Bergin presented the Board with Resolution 2019-08-20.01,to
set a time for a public hearing to hear comments for or against the selling of land owned by Adams
County.

WHEREAS,the real property described in this resolution is owned by Adams County; and
WHEREAS,the Adams County Board of Supervisors hereby determines that the real property
described in this resolution is no longer required for county purposes.

Deputy Attorney Bergin also presented a contract between Adams County and Boys Town for
Temporary Shelter Placement and Services.The Adams County Attorney and Deputy Attorney Bergin
have reviewed the document and are requesting Board approval.

FATHER FLANAGAN'S BOYS'HOME
TEMPORARY SHELTER PLACEMENT AND SERVICE AGREEMENT
This agreement is made on August 1st, 2019 by and between Adams County hereinafter
referred to as"AGENCY,"and FATHER FLANAGAN'S BOYS'HOME a non-profit corporation hereinafter
referred to as"Boys Town."
1. STATEMENT OF PURPOSE. The agreement is made for the purpose of setting forth the
terms and conditions under which Boys Town will provide services to youth and families referred by
Agency. These services will include temporary shelter for juveniles in a safe, service-oriented and
supportive environment.
2. DURATION. This agreement shall commence on August 1st,2019 and shall terminate on
July 31st, 2021. Either party may terminate this Agreement at any time for any or no reason by
providing 30 days'prior written notice to the other party, provided all duties and financial obligations
pursuant to this agreement have been fulfilled by the termination date.

3. JUVENILE ADMISSION CRITERIA. Boys Town's Administrator shall have final authority and
sole discretion in determining whether a juvenile shall be admitted for services under this Agreement.
Only youth ages 10 to 18 may be placed under this Agreement. Boys Town reserves the right,in its
sole discretion,to deny placement and/or services to and/or otherwise remove any youth placed at
any Boys Town fadlity for any or no reason,which may include,but not limited to,the following: (a)
any youth who presents an imminent threat of causing bodily harm to self,staff,or resident of the
shelter;(b)any youth who is in need of immediate medical attention due to intoxication,drug usage,
injury or illness;or(c)any youth who exhibits physical or mental disabilities requiring an
accommodation that would fundamentally alter the nature of operation of the shelter program.
4. AGENCY'S RESPONSIBILITIES. The referring Agency shall be responsible for the following
action prior to the youth being placed at a Boys Town facility:
(a) Search the juvenile and effects before delivering the juvenile
(b) Provide the following information concerning the juveniles before or
at placement:
1. The juvenile's name;
2. The juvenile's last known address;
3. The parent's/guardian's name;
4. The parent's/guardian's last known address;
5. The parent's/guardian's last known telephone number;
6. The juvenile's health and insurance and physician contact information;
7. List of individuals that the juvenile can have contact with;
8. A narrative of the events and problems leading to the need for placement of the
juvenile;
9. Identification and phone number of primary contact person for gathering other
necessary information;and
10. A fully-executed Temporary Shelter Care Authorization,in the form attached
hereto as Exhibit A.
5. BOYS TOWN RESPONSIBILITIES. Boys Town agrees to provide the temporary shelter
services appropriate for each juvenile. Services include,but are not limited to,the following:
(a) An initial intake interview and behavioral assessment shall be conducted on all
• juveniles placed in the applicable Boys Town shelter by the Agency and,if required
by court order,a report submitted to the applicable court(s);
(b) A family assessment whenever possible;
(c) Shelter,bed and three meals per day;
(d) Individual and group counseling to define options and teach problem solving;
(e) Life skills development;
(f) Boys Town will communicate potential placement opportunities with the Agency
primary contact person;
(g) Advocacy efforts will be maintained with,if deemed appropriate in Boys Town's
sole discretion,the placed juvenile's family and/or school,and applicable courts and
social service agencies;
(h) Boys Town will provide Individual services in the area of educational and vocational
needs for the juvenile If appropriate;and
(I)Boys Town will recommend services for the juvenile and the juvenile's family and
assist with coordination of such services in the community.
6. PAYMENT. Agency agrees to pay Boys Town 5180.00 per day per youth placed in a Boys
Town Shelter pursuant to this Agreement. If,Boys Town's reasonable discretion,medical,
psychiatric,dental,pharmacy,optometry,or other similar services are needed during the youth's stay
at the Boys Town shelter,Boys Town's staff will discuss treatment recommendations and coordinate
with the Agency prior to obtaining treatment; provided,however,in the event of an emergency,Boys
Town may provide necessary services without first coordinating with the Agency.If the juvenile is
covered by private health Insurance,Boys Town will use reasonable efforts to give preference to
service providers covered under such insurance for the provision of such services. Boys Town will
follow all necessary procedures to access Medicaid and/or private health insurance induding,but not
limited to,pre-certification or pre-authorization.If emergency services are necessary,Boys Town will
obtain treatment first,and report the outcome to the Agency as soon as possible.The Agency shall
be primarily responsible for the payment of all additional services listed above rendered to each
youth placed at the Boys Town shelter under this Agreement,except to the extent such services are
reimbursed by the affected youth's private health Insurance and/or Medicaid.
It is understood by the parties that this agreement reflects an array of services beyond basic shelter
care. The per diem rate will be renegotiated at the end of each term. Claims for payment,induding
substantiating data,will be filed with the applicable Disbict or County Court.The probation officer,
district judge or county judge who enters such an order for placement at the shelter shall transmit a
copy of said order to Boys Town within 48 hours of placement.

7. CONFIDENTIALITY. Both Agency and Boys Town agree to protect confidential Information
obtained through execution of this agreement using reasonable and appropriate security controls.
Such confidential information shall not be disclosed by either party without the consent of the other
party and,as required by law,the consent of the subject of the information. Any unauthorized
disclosure of such confidential Information shall be reported to the information's owner without undue
delay. The disclosing party will take reasonable steps to mitigate the damage of an unauthorized
disclosure. Boys Town may aggregate and de-identify confidential Information provided through
execution of this agreement for research and improvements in quality of care.
Upon termination of this agreement,both parties shall return or destroy all confidential information
gained through execution of this agreement,except that which Is required to be maintained by law.
Confidential information that is required to be maintained by the receiving party should be secured in
a manner consistent with this agreement until it is no longer required to be maintained,after which It
should be returned or destroyed.
8. NOTICES. All notices envisioned under the terms and conditions of this agreement shah be
sent to the other party by first class United States mail addressed as follows:

9. ENTIRE AGREEMENT. This agreement shall constitute the entire agreement between the
Agency and Boys Town,not withstanding any written or oral agreements to the contrary. This
agreement may be only in writing,duly reviewed and approved by the respective parties and duly
executed.
10. PROTECTED HEALTH INFORMATION. Both parties are committed to complying with the
Standards for Privacy of Individually Identifiable Health Information under the Health Insurance
Portability and Accountability Act of 1996("HIPAA")and the Health Information Technology for
Economic and Clinical Health Act and regulations promulgated thereunder("HITECH"). The parties
shall comply with all applicable federal,state and local laws and regulations relating to the privacy of
subject health Information,including,but not limited to,the Standards for Individually Identifiable
Health Information,45 CFR Parts 160 and 164(the"HIPAA Privacy Regulation"). It is understood
and agreed that Boys Town and the Agency may not use or disclose Protected Health Information
("PHI"),as defined in the HIPAA Privacy Regulation,for purposes other than treatment,payment or
health care operations without first obtaining authorization from the individual concerned.
11. INDEMNITY. To the extent authorized by law,each party shall Indemnify,defend and
hold the other party and party's affiliates,trustees,directors,officers,agents,volunteers,and
employees harmless from all claims,suits,actions,negligence or omissions by the party and which
relate to the performance or operation of this agreement.
12. This agreement is executed and entered into in the State of Nebraska. This agreement
shall be construed,performed,and enforced in accordance with Nebraska law,including provisions
for conflict of laws. Venue for any action arising from this understanding shall Ile in Douglas County,
Nebraska.
13. If a court of competent jurisdiction holds that any term,provision,covenant or restriction
of this agreement is Invalid,void or unenforceable,the other terms,provisions,covenants and
restrictions of this agreement shall remain In force and effect.
14. The provisions of this agreement relating to confidentiality,records,mutual
indemnification and dispute resolution shall survive the termination of this agreement.
15.This agreement constitutes the entire agreement and represents the understanding
between the parties relative to matters addressed in this agreement The agreement contains no
restrictions,promises,warranties or undertakings other than those set forth.
16. Except as otherwise provided in this agreement,the parties may amend or modify this
contract only by a written document executed by both parties.

Clerk Thomas present the Board with a list of outstanding checks from the Adams County Imprest
Account and requested the Board approve the checks be cancelled and remitted to the State Treasurer
as unclaimed property.

Dear Sir;
1 am writing to request permission from the Adams County Board of Supervisors to use the
Adams County Office Building parking lot for the annual Hastings College Homecoming
Parade,Saturday,October 12,2019.
The Homecoming Parade will begin at 10:30 am.,and the parade route is the same as last year's
parade,with the reviewing stand and judges'stands located as indicated on the attached map.
Dismissal of the parade will take place in the same location as last year.
In past years,we have used the Adams County parking lot(located on 3rd St,just behind the
building),as the location to have the antique and classic cars meet.The parking lot is in a
convenient location and there is plenty of space for vehicles to park and maneuver around to be
added into the parade lineup.
The lot would be needed on the morning of Saturday,October 12th from 9:30 am until about
noon.Please let us know if we can use the lot as soon as possible,as alternative arrangements
will need to be made if the request is denied.

Adams County Highway Superintendent, Dawn Miller, presented the Board with Resolution 2019-08-
20.02,to place a yield sign at the intersection of 70th Road and Winchester Avenue.
RESOLUTION NO.
Regulatory Traffic Control Sign Placements
WHEREAS,in accordance with the standards set forth in the Manual on Uniform Traffic
Control Devices(MUTCD),as from time to time amended,and
WHEREAS,it is in the best interest of Adams County,Nebraska,to establish and maintain
proper and consistent signing in conformity with said manual,and
WHEREAS,the County Road/Bridge Committee requested the County Highway
Superintendent to review the traffic control devices presently in use at the named intersections,
and
WHEREAS,the County Highway Superintendent did review the accident information,traffic
-patterns and viewed each named intersection for visibility,clarity and obstructions, and
WHEREAS,the County Highway Superintendent recommends that the YIELD signs be placed
at the intersection described below:
West 70m St&North Winchester Ave-- Place the YIELD signs at the southwest corner
for the east bound traffic and the northeast corner for the west bound traffic on West 70th
Stat said intersection;or further located at the NE corner of Sec 20 and the SW corner of
Sec 16,T8N-R12W,Kenesaw Township. (see attached aerial&map)
THEREFORE,BE IT RESOLVED,that in accordance with the Manual on Uniform Traffic
Control Devices and per the County Highway Superintendent's review,study and
recommendations as described and listed herein,that the before stated Regulatory traffic control
signs be erected and enforced is now hereby directed and adopted within this Resolution by the
Adams County Board of Supervisors.

BE IT RESOLVED by the Board of Supervisors'of the County of Adams.Nebraska(the"County")
as follows:
Section 1. That the following Bonds of the County are hereby called for redemption on

of original issue—November 3.2014 in the principal amount of Two Million Five Hundred
Thirty Thousand Dollars($2.530.000).becoming due and bearing interest as follows:

Said Bonds are hereinafter referred to as the"Called Bonds." •

costs of issuance of the Bonds.
Section 2. Said Bonds shall be presented for payment at the office of BOKF. National
Association.in Lincoln.Nebraska as Paying Agent and Registrar(the''Paying Agent").
Section 3. A copy of this resolution shall be filed immediately with the Paying Agent not less
than thirty days prior to said date fixed for redemption.The Paying Agent is hereby directed to mail notice .
to all registered owners of the Notes to be redeemed not less than thirty days prior to the date fixed for
redemption in accordance with their authorizing resolution and to take all other actions deemed necessary
in connection therewith.

Edward Rief of 1240 N Laird Avenue in Hastings presented an appeal of a penalty assessed for a late
personal property tax filing. Rief stated his accountant had mailed the personal property tax filing and
payment however it was never received by the Adams County Assessor. Rief provided a log from his

assist him with an amicable resolution of the same.
Mr.Rief s accountants,Lutz,prepare and directly file the personal property tax returns for both
Edward Rief,personally,and his corporation,Rief Farms,Inc.each year. Lutz checked their
internal records and stated that both personal property tax returns were timely prepared and
mailed to your office on Mr.Rief s behalf. Your office has acknowledged receipt of Mr.Rief s
personal property tax return for Rief Farms,Inc. However,Mr.Rief s personal property tax
return seems to be missing.
Mr.Rief also stated that he did not receive notification from your office until your office
prepared the Notice of Failure to File Personal Property Return,dated July 2,2019,assessing
him with a 25%late fee. He does not understand why your office waited until after July 14 to
send out the notification instead of immediately after May 14 and before June 30'"and assessing
the lesser 10%late fee.
In light of the above mentioned circumstances,this letter is to request that you please waive the
late fee penalty on Mr.Riefs personal property tax return and allow him to re-submit Ns return
and pay his personal property taxes with your office with no penalty.

Therefore,we are requesting that the value attributable to the size of the road be removed from the tax roll from years
2018,2017,&2016 due to clerical error.
I hereby direct the Adams County Treasurer to accept this Official correction made for the above named party and description and to issue hislher
