Motion by Curtis,seconded by Larsen that this is an open public meeting of the Adams County Board of Commissioners. The Adams County Republican Party Chairman, Debbie Carlstrom, addressed the board regarding a vacancy on the ballot due to the resignation of Adams County Treasurer, Melanie Curry.The Republican Party has until September 1, 2022 to submit an affidavit to the Adams County Clerk with the name of their selected candidate to fill the vacancy.The Adams County Board is required to appoint a replacement for the treasurer position no later than August 15, 2022. Carlstrom expressed her desire to work with the board in hopes the same candidate appointed will be the candidate selected to fill the vacancy on the ballot in November. Thomas Johnson, residing on west DLD Road,addressed the board regarding concerns of noxious weeds in his area.Johnson stated that neighboring property owners do not control the noxious weeds and he has made multiple calls to the weeds department with no results.Johnson also expressed concern over the condition of DLD Road not being maintained properly, and stated it had not been maintained in the last five weeks. Chairman Hogan stated that members of the roads committee will inspect DLD Road and make any necessary recommendations to the roads department. Commissioner Curtis stated he will be absent for the July 2, 2022 board meeting. No additional public comments were made and public comment was closed. Kerry-Ann Block with ASAAP, provided the board with an update from the ASAAP office and budget. assistance request of$10,000.00. There was no action on Block's budget assistance request as all budget requests will be reviewed by the budget committee during later budget meetings. No action was taken on Spilinek's request as all budget assistance requests will be reviewed by the Adams County Budget Committee and a recommendation will be made to the board at a later date. Adams County Planning and Zoning Director,Judy Mignery, presented the board with a Resolution 2022- 06-07.01, an amendment to the interlocal agreement between Adams County and Adams County Villages for planning and zoning commission funding. Mignery has reviewed the agreement and is requesting board approval. Motion by Stromer, seconded by Patterson to approve the chairman signing Resolution 2022-06-07.041; [an interlocal agreement] with the villages. G FOR AMENDMENT TO INTERLOCAL COOPERATION AGREEMENT of ADAMS COUNTY,NEBRASKA and THE VILLAGES OF AYR, HOLSTEIN,JUNIATA, ICENESAW, PROSSER AND ROSELAND, NEBRASKA WHEREAS,BY VIRTUE OF AN INTERLOCAL AGREEMENT for joint rural and urban planning previously was made and entered into between Adams County,Nebraska and the Villages of Ayr,Holstein,Juniata,Kenesaw, Prosser and Roseland,Nebraska,and pursuant to which agreement an area planning and zoning commission was formed,which commission is known as the Adams County Area Planning Commission,and which Commission consists of representatives officially appointed by the governing body of the County and each participating Village. WHEREAS,funds are appropriated and provided for use by the Planning Commission out of the General Funds of each participating public agency according to the following procedure.Each participating public entity shall provide funds according to the percentage of population which each participating public entity bears to the total population of the participating public entities.As to Adams County,the population shall consist of the total of the population of the rural unincorporated area of Adams County. All participating Villages shall receive credits to the amount due from each Village for theVillage's staff assistance in the administration of the zoning and subdivision ordinances and other zoning regulations. WHEREAS,The population data used to determine the percentage distribution of the Planning Commission's budget shall be the official population of each public agency established by the latest Census conducted and published by the United States Bureau of the Census. The Applicant would like to add an addition to the south side of the house at 45' from the property line. According to the Adams County Zoning Regulations adopted in August,2010, Section 3.04 item 1. Any structure or portion thereof may be altered to reduce its nonconformity but no such nonconforming structure may be enlarged or altered in any way which would increase its nonconformity, except that structures located in the AG District may be allowed by conditional use permit to be enlarged or extended with due consideration of the following: a)a permit may be authorized for an expansion of an existing non-conforming structure, if the proposed expansion(including any other expansions) does not exceed fifty percent(50%)of the square footage of the original structure in existence prior to the adoption of the regulations. Non-conforming grain bin storage facilities may be expanded up to 200% of the existing facility in existence at the time of the adoption of these regulations. b) Such CUP may only be allowed to continue an existing non-conformity(without increasing the degree of non-conformity)and shall not allow for the creation of new non- conformities. The permit shall not be allowed for multiple non-conformities. The degree of non-conformity shall mean that the request shall not further reduce a setback or increase a height requirement or encroach into an area designated as a sight triangle. c)The consideration of the CUP effects on adjacent property, traffic and environment shall be considered. d)The County's Transportation Plan and one and six-year plan shall be considered. e)The density of land use within the existing zoning district and that of adjacent properties shall be considered, f)The degree of hardship upon the applicant which would be caused by failure to grant such a permit shall also be considered.The requested addition is 16'x28' or 448 sq feet. The existing house is 1,221 sq feet including porches. Property owner Stan Mohlman was present to answer questions and briefly stated plans for the addition to his property. December 31.2026—Project Construction must be completed. 4.4 Laws and Bid Letting County is required to comply with all laws applicable to the development,design.letting and construction of County's bridge or culvert project on a local road or street.County shall be responsible for assuring that its contractor has sufficient training,experience. labor and equipment to properly complete the work. Further,prior to County awarding a contract to a construction contractor.County shall provide to State all needed documentation about all bids received. 4.5 Financial County shall solely be responsible for the following project costs: a. Planning,preliminary engineering including obtaining environmental permits,final design,right-ofiway,bid letting,construction engineering.operation,maintenance and all other project phases with the exception of bridge construction costs.which will be eligible for CBMP funding. b. All expenses not paid by State under this agreement(the parties understand that all grading and roadway construction costs outside the limits of the bndge will not be paid by State with the exception of guardrail). Project No.STWD-CBMP(6) Page 5 of 8 State Control No.00974E LPA Control No.00974E(s) Agreement No.BL2218 County Bridge Match Program 640 IPage 4.6 Failure to complete construction as designed If County does not complete the construction of this project as described or shown on the approved plans.specification and estimates or as amended by any approved change orders.County shall notify State and may be required by State.in its sole discretion,to repay State any funds provided by State for the project.State will not participate in the costs of any change order proposed by County unless County presents to State 1)the details of the proposed change order.and 2)a detailed explanation of the reasons for the change order,and State determines,in its sole discretion.that the change order will be funded as a part of this project. 4.7 Maintenance and Environmental Commitments Upon project completion,County shall own the bridge and have jurisdictional responsibility over the bridge.County shall maintain the constructed improvements and continue to meet environmental commitments at its own expense,and agrees to make provisions each year for such costs.County will release and hold harmless State,from any suits brought against State arising out of County's design,construction,operation,and maintenance of or related to the project. 4.8 Change of Scope County understands that there are limited funds available for this bridge construction and that State reserves the right.in its sole discretion,to decline funding for any scot*change@ proposed by County for the bridge. 4.9 Indemnification County agrees to hold harmless.indemnify,and defend State horn all claims and liability due to the error,omission,or negligence of County or those of County's agents or employees arising out of County's project and the terms of this agreement. SECTION 6.STATE'S RESPONSIBILITIES State shall be solely responsible for the following: 6.1 Submittals State shall accept the documents submitted by the County under Section 4.3.Timeline for Required Submittals. 6.2 Financial State's total financial obligation for the project shall be as specified in Section 3. State shall pay its share of the project to County,based on the following schedule: a. Upon County's award of a construction contract or submittal of invoices for materials or rental equipment-70 percent of State's share.For projects being constructed with County's own forces,this initial payment will be 70 percent of the State's funding split specified in Section 3. b. A suspension may also be imposed by State for any of the reasons listed in the Termination subsection below,or for any significant change in the scope of the project that has not been previously approved by State. Failure to correct the deficiencies identified in a suspension will be grounds for the loss of funding for the project and for termination of this agreement. 6.2 Termination This agreement may be terminated for the following reasons. a. State and County,by mutual written agreement,may terminate the agreement at any time. b. State may terminate this agreement for the following reasons: 1. Failure of County to provide the submittals or meet deadlines as set out in this agreement. 2. County's failure to cause the project to be constructed according to the approved project plans and specifications. 3. Loss of ora lack of available funds for the project. 4. County's breach of a provision of this agreement. c. Prior to State terminating this agreement.State shall provide written notice to County of the basis for termination and,when applicable,provide the County sixty(60)days to properly resolve all issues identified by State. d. County may terminate the agreement by providing written notice of termination to State,subject to subsection e below. e. Whenever the project is terminated for any reason.County shall be solely responsible for all costs associated with County's project and County shall promptly repay all previous payments made by State 6.3 Review and Audit State reserves the right,but not the duty,to review County's work related to this project and reserves the right to complete a financial audit of County records for the project.County shall repay State any funds determined by audit to not be eligible or participating for this project. SECTION 7. DRUG-FREE WORKPLACE County shall have an acceptable and current drug-free workplace policy on file with State.
