A regular meeting of the Adams County Board of Commissioners was held with Chairman Lee Hogan
presiding.
Motion by Patterson, seconded by Johnson that this is an open public meeting of the Adams County
Board of Commissioners. Roll Call,Ayes:Stromer, Larsen, Hogan,Johnson,Curtis, Neumann, Patterson
Nays: None
Chairman Hogan inquired if there were any conflicts of interest. No conflicts were disclosed.
Roll was taken, roll call members present, Michael Stromer-District 1, Glen Larsen—District 2, Lee

Chairman Hogan stated minutes from the June 7, 2022 meeting have been circulated to board members
and requested a motion to approve the minutes if there are no corrections.

Chairman Hogan opened the meeting to receive comments from the public.
No public comments were received,and public comment was closed.
Adams County Public Defender, Christina Thornton, requested the board approve the employment of
Evangeline Thornton as a temporary employee in the public defender's office.Thornton is seeking
approval as required by county nepotism policies.
Motion by Johnson, seconded by Neumann to approve the employment of Evangeline Thornton under

Adams County Highway Superintendent, Dawn Miller, requested the board set a date and time for a
public hearing on the possible closure of two bridges; one on Oregon Trail Road and one on Osage
Avenue.
RESOLUTION NO.
SETTING DATE&TIME FOR PUBLIC HEARING
For the possible CLOSURE of said described road sections
WHEREAS,the Adams County Highway Superintendent has reviewed the conditions and
expense to repair or reconstruct the bridge(s)in the immediate area(s)of an active rail crossing,
and
WHEREAS,the Adams County Highway Superintendent has contacted the BNSF Railway
Company,hereinafter referred to as"BNSF"',to research the feasibility of working within the
railroad right-of-way area(s)for repair or reconstruction,along with the possibility of permanent
closure of the rail crossings)near the bridges(s)to be repaired or reconstructed,and
WHEREAS,the Adams County Highway Superintendent has received Highway-Rail Grade
Crossing Closure Agreements from BNSF for consideration of permanent closure at the rail
crossings described herein,that would further extend to the County's and BNSF bridges)that
are in need of reconstruction,does recommended that the Adams County Board of
Commissioners hold a public hearing to hear public comments as to the possible closure/vacation
of the described segment of roadway,inclusive of public rail crossing and bridge(s),and further
described below:
On Oregon'Trail Rd west of Marian Ave;Section 10&15,T6N-RIOW
Beginning at the west side of the BNSF right-of way,inclusive of rail crossing US DOT
No.070794B and continue east approximately 300 feet,ending cast of the County bridge
C000103015; and
On Osage Ave north of Sundown Rd;Section 19&20,T6N-RI OW
Beginning at the south side of the BNSF right-of-way,inclusive of rail crossing US DOT
No.070299M,and continue north approximately 300 feet,ending north of the BNSF
owned bridge 0000102715
Therefore,1W I7'NOW RESOLVED,that in accordance with Nebraska Revised Statute#39-
1724 directing that a public hearing be held in regards to possible road closure/vacation and that

Motion by Neumann, seconded by Stromer to set a public hearing for August 2, 2022 at 10:00 am to
hear comments for or against the possible closure of the two bridges identified in resolution 2022-06-

Adams County Treasurer, Melanie Curry, requested the board consider accepting a revised resignation
date from her. Curry originally submitted a resignation letter effective June 30, 2022. Curry would like to
adjust the date to July 31, 2022 to allow for more time to train her deputy,Virginia Long.
Motion by Patterson, seconded by Stromer to approve the adjusted resignation date for Treasurer Curry

Jerad Reimers with Congressman Adrian Smith's office provided the board with an update from
Congressman Smith's office.
Kyle Brown with the USDA Wildlife Control office, presented the board with a new service contract for
2022/2023.The contract total for the year will be$13,096.96.

Pursuant to Cooperative Service Agreement No.21-73.31.5318RA entered between Adams County
(Cooperator)and the United States Department of Agriculture,Animal and Plant Health Inspection Service,
Wildlife Services(APHIS-WS).This Work Plan defines the objectives,plan of action,resources,and budget
for the Wildlife Damage Management program to be conducted from July I.2022 through June 30.2023.

-Ilse objective of the work to be performed by the Wildlife Specialist(s)assigned to the Cooperator is for the
management of damage or damage threats caused by wild and feral mammals to agricultural interests,other
private and public property and for the protection of human health and safety.The APHIS-WS employees)
will be adequately equipped to manage wildlife to reduce or alleviate property damage.
II.PLAN OF ACTION
APHIS-WS will assign one Wildlife Specialists)that will respond to nuisance wildlife problems within
Adams County.APHIS-WS will provide a vehicle.supplies and equipment for the project.Cost-sharing,
This agreement will support a cooperatively funded position cost-sharing with,but not limited to,Adams
County,other counties,cities,private individuals,and Federal government..
APHIS-WS will conduct Wildlife Damage Management operations in and around Adams County to
minimize wildlife damage caused a variety of wildlife species.In cooperation with county,municipalities,
and state agencies,WS will help reduce the probability of transmission of plague and rabies for human
populations though collection of carnivore blood samples,and management of mammal populations that are
vectors of rabies and plague.Direct efforts will be made to manage losses to agriculture,crops and livestock
from damage and predation caused by wild and feral animals..Direct effort will be made for the protection of
residential area front damage and predation by wild animals,

III.REPORTS
APHIS-WS will provide periodic reports of activities and accomplishments at the request of the Cooperator.
IV.STIPULATIONS AND RESTRICTIONS
a.Operations will be conducted by APHIS-WS with input from Adams County and shall be under the
direct supervision of APHIS-WS listed below.
b.Wildlife Damage Management A Work Initiation Document for Wildlife Damage Management(WS
Form 12A),a Work Initiation Document for Wildlife Damage Management-Multiple Resources
Owners(WS fonn 12D)or a Work Initiation Document for Management of Wildlife Damage on
Urban Properties(WS Form l2C)will be executed between APHIS-WS and the landowner,lessee,
administrator before any APHIS-WS work is conducted.
c.APHIS-WS will use only APHIS-WS employees and APHIS Volunteer Program participants. All
APHIS-WS employees and APHIS volunteers have successfully met APHIS firearm safety standards.
d. 'the program will be supervised by Jerry Feist,;E District Supervisor(308-252-2319)and monitored
by Timothy Veenendaal,NE State Director(402-334-2342).
V.COST ESTIMATE FOR SERVICES
The cooperator will reimburse APHIS-WS for expenses incurred,not to exceed$!3,09696.Costs include
salary/benefits,pooled job costs and overhead. Any equipment and supplies purchased under the terms of
this agreement will remain the property of APHIS-WS.

NOTE:In accordance with the Debt Collection Improvement Act(DCIA)of 1996,bills issued by WS are
due and payable within 30 days of receipt.The DCIA requires that all debts older than 120 days be
forwarded to debt collection centers or commercial collection agencies for more aggressive action. Debtors
have the option to verify,challenge and compromise claims,and have access to administrative appeals
procedures which are both reasonable and protect the interests of the United States.

Dan Rutt and Dave Reynolds with Horizon Recovery presented the board with a budget assistance
request in the amount of$7500.00.
No action was taken on Rutt's request as all budget assistance requests will be reviewed by the budget
committee and presented to the board for approval.
South Heartland District Health Director, Michele Bever, presented the board with a $2500.00 budget
request for the SHDHD immunization clinic.
No action was taken on Rutt's request as all budget assistance requests will be reviewed by the budget
committee and presented to the board for approval.

Commissioner Curtis requested the board consider not renewing the office space rental contract with
the Nebraska Department of Health and Human Services. County offices continue to outgrow their
space and the space is needed for these county offices. Curtis recommended requesting the Adams
County Attorney draft a letter advising DHHS that the contract will not be renewed.
Motion by Curtis, seconded by Neumann to approve not renewing the rental contract with DHHS and

BALANCE BUDGET
WHEREAS:due to unanticipated requirements essential to the administration of justice,
the preservation of public health,welfare and safety there exists an emergency in the
budget appropriation of certain funds within the General Fund. There is not sufficient
money appropriated to complete business for the balance of the fiscal year,and
WHEREAS:there is sufficient unused appropriated monies in the General Fund,the total
expenditures have not exceeded the budget appropriated, and it is essential to the
government of Adams County and the welfare of the people of Adams County that
certain offices or miscellaneous funds be increased by emergency appropriation,
