A Public Hearing to receive comments in support of opposition of the proposed 2023/2024 Adams
County Budget was conducted with a quorum of Adams County Board of Commissioners present.
Motion by Patterson,seconded by Johnson that this is an open public meeting of the Adams County
Board of Commissioners. Roll Call,Ayes:Stromer, Larsen, Hogan,Johnson, Reams, Neumann, Patterson
Nays: None Absent: None
The Pledge of Allegiance was performed.
Chairman Hogan inquired if there were any conflicts of interest. No conflict of interests were disclosed

Adams County Budget Committee member,Judy Mignery presented the following in regards to the
proposed 2023/2024 budget:

The Beginning Balance for FY 2023-20241s$29,791,320.
The County is requesting a$1,250,000 Cash Reserve.
The amount of the Property Tax request for FY 2023-2024 for General is$13,630,402.
The amount of the Property Tax request for FY 2023-2024 for Library is$215,263.
The amount of the Property Tax request for FY 2023-2024 for Jail Bonds is$3,215,581
The amount of the Property Tax request for FY 2023-2024 for Highway Bonds is$645,273
The total Expenses for FY 2023-2024 is$62,454,606.
The Total Revenue for FY 2023-2024 is$44,750,087.
The tax requirement is$17,706,519.
The total assessed Value of property for FY2023-2024 is$4,625,658,351. This differs from
FY2022-2023 by 9.399%.
The tax rate which would levy the same amount of property taxes as FY 2022-2023,when
multiplied by the new total assessed value of Property for FY 2023-2024 would cause a tax rate
of 0.391715%per$100.
The tax rate the Board of Commissioners proposes to adopt based on request for FY 2023-

Budget committee member Ron Kucera stated offices with more than an 8%asking over last year were
asked to voluntarily reduce their budget from their original budget request presented on July 18, 2023.
No additional comments regarding the budget were made.

Chairman Hogan opened the meeting to receive comments from the public.
Anna Watkins of 3625 W Prairie Lake Rd stated she has had ongoing communication with the roads
committee regarding her request for a driveway at her newly constructed home.Watkins provided a
sealed handout for the board to review.
No additional public comments were received.

Adams County Planning and Zoning Director,Judy Mignery, presented proposed plans for data centers
in the county and read the following into the record:

RE: Case#23-08.3—Amend the Adams County Zoning Regulations for Data
Centers and provide definitions
Zoning Administrator's Comments: Planning Commission feels it is important to review the
Zoning Regulations of Adams County.Changes in technology have led the planning commission
to make updates to the Zoning Regulations of Adams County for Data Centers.
RESOLUTION NO.
A RESOLUTION,AMENDING ARTICLE 2,ARTICLE 4,AND ARTICLE 8 TO
PROVIDE REGULATIONS FOR DATA CENTERS IN ADAMS COUNTY;
PROVIDING FOR REPEAL OF CONFLICTING SECTIONS;AND PROVIDING
FOR EFFECTIVE DATE.
WHEREAS,pursuant to Neb.Rev.Stat.Section 23-174.10,as amended,any county
which has adopted a county zoning regulation muy make such regulations as may be
necessary or expedient to promote the public health,safety,and welfare;and
AND WHEREAS,the Adams County has adopted zoning regulations and the Adams
County Board of Commissioners desires to adopt regulations for Data Centers within
Adams County;and
AND WHEREAS,the Adams County Planning and Zoning Commission conducted a
public hearing on the following regulations on ,2023;
AND WHEREAS,the Adams County Board of Commissioners conducted a public
hearing on said regulations on ,2023.
NOW,THEREFORE,BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF
COMMISSIONERS OF ADAMS COUNTY,NEBRASKA,THAT:
SECTION 2.03.ARTICLE 2 of the Adams County Zoning Regulations of Adams
County,Nebraska,shall be amended to read as follows:
DATA CENTER shall mean a centralized repository for the storage,management,processing,conversion,
data mining,and dissemination of data and information which may also house equipment that supports
communications network infrastructure without actually being part of the physical network.A data center
may house equipment that includes,but is not limited to,computers,servers,data storage devices,and
related equipment.A data center may include,but shall not be limited to,accessory uses that include
offices for data center staff and accessory structures that include water storage tanks,cooling towers,
network systems, fuel storage tanks, guardhouses and security offices, storage, chillers, electrical
transformers,and engine generators.Accessory uses shall not include retail sales,telephone call centers,or
customer service operations.Typical uses include data processing centers and server fame.
SECTION 4.12.03, ARTICLE 4 of the Adams County Zoning Regulations of Adams
County,Nebraska,shall be amended to read as follows:

Section 8.13 Data Centers
Data Centers and their accessory structures aro allowed by conditional use permits in the 1-1 and 1-2
Industrial Districts with the following criteria
1. Compliance with Section 8.11,Performance Standards for Industrial Uses
2. Compliance with 4.20.05,Criteria for Appearance:
3. Holder of the approved CUP shall submit an annual retort to the County Zoning office
detailing compliance with the standards and criteria listed in I and 2 above based upon a
minimum of semiannual measurements of noise,liquid waste,heat,and light.
4. Consideration of available infrastructure capacity and impacts on the infrastructure.
5. Consideration of employment density with available land zoned industrial in the county.
6. The premise shall always be maintained in a neat and orderly condition.The area is to be
fenced and always secured.The buildings and/or containers on the site will always be
maintained in a clean and orderly condition.
7. Noxious weeds on the premises shall be controlled pursuant to sate and local laws and
regulations.
8. Noise level cannot exceed more than 20 decibels above the normal ambient noise level at'A
mile from the data center.Maximum decibel levels shall be limited to a maximum on-hour
limit of 55 dba front the property line of any existing dwelling,platted residential area,public
park,recreational area,church cemetery,religious area,school,or historical site within Si mile
of the data center.
9. Any change of ownership of the structures,data mining operation,or land requires notification
to the Adams County Zoning Department.
10. In the event the data mining center discontinues operation for a period of more than twelve
consecutive months,all equipment shall be removed,and the property shall be restored to its
original condition at the owner's expense.
11. Data Center shall not be within one half mile from an existing residential structure,public park,
cemetery,house of worship,or hospital without obtaining an impact easement from said owner
of the entity.
NOW,THEREFORE BE IT RESOLVED,by the County Board of Commissioners of
Adams County,Nebraska that the regulations pertaining to Data Centers are hereby
approved.
FURTHER IT BE RESOLVED,that this Resolution shall take effect and be in full
force from and after its passage,approval,and publication or posting as required by law
and all other resolutions and sections in conflict are hereby repealed.

Mignery stated the Adams County Planning and Zoning Committee has approved the plans for data
centers in the county and she is now seeking county board approval.
Motion by Neumann, seconded by Reams to adopt Resolution [2023-08-15.03]for data center

Adams County Clerk of the District Court,Amanda Bauer, presented a law enforcement agreement
between Adams County and Custer County. Bauer has reviewed the document and is requesting board
approval.

INTERLOCAL AGREEMENT FOR COOPERATIVE
LAW ENFORCEMENT SERVICES
BY AND AMONG
THE COUNTY OF ADAMS AND THE COUNTY OF CUSTER
THIS AGREEMENT is made and entered into this i 7 day of (k).—v.,,L, ", 2023, by
and between the County of Adams and the County of Custer,both being bodieslpolitic and
corporate and political subdivisions of the State of Nebraska,hereinafter referred to collectively
as the"Parties"and individually as a"Party". WITNESSETH:
WHEREAS,each county by and through its county attorney is responsible for
commencement and appearance at mental health board proceedings, when necessary, for subjects
believed to be mentally ill and dangerous as defined by the Nebraska Mental Health
Commitment Act(hereinafter referred to as the Act) and whose legal residence is within said
county; and
WHEREAS,actions pursuant to the Act require each county by and through the Clerk of
the District Court to issue all notices, appointments,warrants, subpoenas, or other process in
conjunction with proceedings commenced pursuant to the Act and to file and preserve all papers
connected with any inquest by the mental health board; and
WHEREAS, each county is responsible for the costs associated with conducting a mental
health board hearing pursuant to the Act, including but not limited to the cost of convening the
mental health board, ensuring a record of the proceedings, and transporting subjects to inpatient
facilities, as needed, following commitment; and
WHEREAS, each county is responsible for the costs associated with the appointment of
counsel for any indigent person who is the subject of a petition under the Act and independent
evaluations by physicians or practicing psychologists of the subject's mental condition; and
WHEREAS, it is necessary for subjects who are placed in emergency protective custody
pursuant to the Act by law enforcement officers located in Custer County to be taken to an
appropriate and available medical facility for evaluation as required by the Act; and
WHEREAS,the petition to commence a case under the Act may be filed in any county of
the judicial district where the subject is found, or in any county of the judicial district where the
alleged behavior of the subject occurred which constituted the basis for the allegation that the
subject is a mentally ill and dangerous person, or in any other county as ordered by district judge
for good cause; and
WHEREAS, pursuant to Section 71-919 of the Nebraska Revised Statutes, expenses
incurred by Adams County, on account of a mentally ill and dangerous person placed into
emergency protective custody by a law enforcement agency of Custer County shall be the
responsibility of Custer County; and

WHEREAS,pursuant to Section 83-351 of the Nebraska Revised Statutes,expenses
incurred by Adams County.on account of a mentally ill and dangerous person whose legal
settlement is in Custer County shall be the responsibility of Custer County;and
WHEREAS,if it is determined that a mental health board proceeding need be
commenced,following evaluation of the subject by mental health professionals,and it is more
efficient and cost effective for Custer County to enter into an agreement with Adams County for
the commencement,filing,and conducting of hearings in Adams County for cases arising under
the Act;and
WHEREAS,subjects of mental health board proceedings must be escorted to hearings
before the Mental Health Board and then,when applicable,transported to places of commitment
as ordered by the Mental Health Board,and
WHEREAS,the Interlocal Cooperation Act(Neb.Rev.Stat.section 13-801,et.seq.)
provides that units of local government of the State of Nebraska and Nebraska State Agencies
may enter into agreements for the joint and cooperative exercise of powers,privileges,or
authority capable of being exercised by either agency;and
WHEREAS,Neb.Rev.Stat.section 13-801 provides that any one or more public
agencies may contract with any one or more public agencies to perform any governmental
service,activity,or other undertaking which each public agency entering into the contract is
authorized by law to perform;and
WHEREAS,Counties are public agencies as defined by Neb.Rev.Stat.section 13-801;
NOW,THEREFORE.the Parties mutually covenant and agree as follows:
1. Purpose. The purpose of this agreement shall be to provide generally for payment of
fees and expenses associated with the proceedings commenced,proceedings filed,and
hearings convened wherein the subject of such action has been placed in emergency
protective custody by law enforcement in Custer County specifically as follows:
(A) The commencement of mental health board proceedings by the filing of a petition
as provided in the Act wherein the subject of such action has been placed in
emergency protective custody by law enforcement in Custer County and the
appearance before the Mental Health Board of the Tenth Judicial District shall be
carried out under the terms of this agreement by the Adams County Attorney or
any duly qualified and appointed Deputy County Attomey;and
(B) The issuing of all notices,appointments,warrants,subpoenas,or other process in
conjunction with proceedings commenced pursuant to the Act and the filing and
preservation of all papers connected with any inquest by the mental health board
shall be carried out under the terms of this agreement by the Clerk of the District
Court of Adams County wherein the subject of such action has been placed in
emergency protective custody by law enforcement in Custer County;and
(C) The representation of indigent persons who are the subject of proceedings
commenced pursuant to the Act,and who have been placed in emergency
protective custody by law enforcement in Custer County,shall be carried out under
the terms of this agreement by the Adams County Public Defender,an Adams
County Deputy Public Defender.or any person duly qualified and appointed by the
Adams County Public Defender,except in those cases in which the Public
Defender's Office has a conflict of interest. If such a conflict does exist,a
qualified and competent attomey will be appointed to represent said indigent
person;and
(0) The cost associated with convening the mental health board and ensuring a record
of the proceedings shall be paid by Custer County pursuant to the terms of this
agreement.
2. Term. This agreement shall commence July 1,2023,and shall renew annually thereafter
on January 151,unless notice is provided by any Party to withdraw from this agreement.
3. Fees.Custer County agrees to pay Adams County the following amounts for each case
commenced by the Adams County Attorney's Office wherein the subject of said
proceeding has been placed in emergency protective custody by law enforcement in Custer

4. Billing statements. Billing statements to Custer County will be submitted by the Clerk
of the District Court of Adams County on behalf of Adams County to:

5. Method of Payment. Custer County agrees to remit payment to the Clerk of the District
Court of Adams County at the following address within thirty(30)days of receipt of the

6. Expenses. Adams County agrees to provide personnel,office supplies,and telephone
service as typically required for the commencement of these type of cases and accordingly
for conducting hearings. Attomeys of the Adams County Attorney's Office and the
Adams County Public Defender's Office or appointed attorneys are qualified by
education,training,and experience to undertake the representation of such parties in a
timely and workmanlike fashion and are licensed to practice law in the State of Nebraska.
Transportation of persons in protective custody to and from hearings,to and from the
evaluation site,and to appropriate treatment facilities shall be the responsibility of Custer
County. Costs or expenses incurred by law enforcement from Custer County in
performing transportation duties or in testifying before the mental health board will be the
responsibility of Custer County. Should it become necessary for the Adams County
Attorney to incur expenses for expert fees or other needs not customary for these types of
cases,the Adams County Attorney will notify the County Clerk and County Attorney of
Custer County for prior approval of said expenses. Due to the limited time frame by
which a hearing before the mental health board must be conducted,Custer County agrees
to provide direction within forty-eight(48)hours of the request;failure to act on said
request within this time period will be deemed an approval of said request. Expenses of
this nature which are incurred but for which prior approval has not been obtained or
requested as set forth herein will not be the responsibility of Custer County. Should the
subject or the subject's counsel desire an independent professional evaluation pursuant to
Neb.Rev.Stat.section 71-949,the costs associated with said evaluation shall be the
responsibility of Custer County. The costs,reasonable fees,and expenses associated with
said independent evaluation shall be fixed as provided by Nebraska law.
7, Suspension and Termination of this Agreement. This agreement and any services
provided for herein may be suspended or terminated by either Party for noncompliance by
the other Party of any terms or conditions contained herein. Written notice of such
suspension or termination shall be given to the persons set forth in paragraphs 4 and 5
listed above by certified mail and shall be effective upon receipt of said notice by the non-
terminating Party. Any amounts due and owing to Adams County as of the date of
suspension or termination shall be due and payable within ten(10)days of the effective
date of suspension or termination of this agreement.
8. Withdrawal. Any Party may withdraw from this agreement at any time,with or without
cause,upon providing to the other Party a written notice of such withdrawal given not less
than sixty(60)days prior to the effective date of the withdrawal. Such notice shall be
given to the persons set forth in paragraphs 4 and 5.
9. Limitations. This agreement applies only to services provided by the Adams County
Attorney's Office,Adams County District Court,and the Adams County Public
Defender's Office and any appointed attorneys as set forth herein and for individuals
placed in emergency protective custody by law enforcement in Custer County for
evaluation as provided by Nebraska law. This agreement does not bind or imply the
rendering of services by any offices outside the scope of this agreement.
10. Liability. It is agreed that in the course of the performance of this Contract by the stated
officials of Adams County,such officials or their duly appointed and qualified designee
shall be acting as an agent of Custer County.
11. Modification. This agreement may be modified by written agreement of the parties.

Adams County Emergency Management Director, Ron Pughes, requested moving radio equipment and
back up power to the new location of the Adams County Emergency Management office.
Commissioner Reams asked how old the equipment was and the cost involved with relocating it.
Further action on Pughes' request was deferred pending information on the cost involved.
Adams County Clerk, Ramona Thomas, presented the board with an appeal to a general assistance
application that was denied due to assets of the deceased being over$1400.00.
Thomas stated the family had appealed the decision but it has been confirmed with Apfel Funeral Home
that a payment agreement exists between the family and the funeral home and the cremains have been
released to the family.

WHEREAS,Nebraska Revised Statute 77-1632 and 77-1633 provide that the Governing Body of Adams County passe
by a majority vote a resolution or ordinance setting the tax request;and
WHEREAS,a special public hearing was held as required by law to hear and consider comments concerning the
property tax request;
NOW,THEREFORE,the Governing Body of Adams County resolves that:
1. The 2023-2024 property tax request be set at:

A regular meeting of the Adams County Board of Equalization was held in conjunction with the Adams
County Board of Commissioner's meeting with Chairman Lee Hogan presiding.
Members present; Michael Stromer—District 1, Glen Larsen—District 2, Lee Hogan—District 3 Harold
Johnson—District 4,Tim Reams-District 5, Chuck Neumann—District 6,Joe Patterson—District 7.
Motion by Patterson, seconded by Stromer to meet as a Board of Equalization [to review and take action
on motor vehicle exemptions and tax list corrections] Roll Call,Ayes:Stromer, Larsen, Hogan,Johnson,

Entered Board of Equalization at 10:00 am
Adams County Treasurer,Virginia Long, presented the board with motor vehicle tax exemption
applications submitted by Hastings College and Midland Area Agency on Aging. Long has reviewed the
applications and confirms the entities meet the criteria for exemption and is recommending approval.
Motion by Stromer,seconded by Neumann to approve the motor vehicle tax exemptions as presented
by Long. Roll Call,Ayes:Stromer, Larsen, Hogan,Johnson, Reams, Neumann, Patterson Nays: None

Deputy County Assessor,Janet Kopisch, presented the board with tax list corrections for parcels
010009537 and 010002590.The county assessor has reviewed the correctinos and is recommending
