Regular meeting of the Adams County Board of Supervisors met as per recess of October 26, 1953.
George Anderson, Chairman presiding.
Roll call, members present: Anderson, Gangwish, Hohlen, Lightner, Maltman, Utecht and Woodman.
Motion by Maitman, seconded by Hohlen, that we purchase a Burroughs Adding Machine ror the office
of the County Treasurer ror '656.00. Roll call, all voted aye. motion carried.
Motion by Maltman, seconded by Hohlen, that the County Judge be authorized to buy a new typewriter
not to exceed $150.00. Roll call, all voted aye. Motion carried.
Motion by Maltman, seconded by Gangwish, that the Clerk of the District Court be authorized to
purchase a new typewriter not to exceed $127.50. Roll call, all voted aye. Motion carried.
Motion by Utecht, seconded by Woodman, that the County Attorney be instructed to start probation
in the Amelia Andrews estate to secure funds paid from OAA. Roll call, all voted aye. Motion
carried.

Motion by Utecht, seconded ay Hohlen, that the reports of the County Judge, (2) County Clerk,
Sheriif, County Jail, County Library, Register of Deeds, Clerk of the District Court and County
Clerk Car Title be accepted and placed on rile. Roll call, all voted aye. Motion carried.
Motion by Maltman, seconded by Woodman, that Mr. Woodman be authorized to buy a gas heater
installed not to exceed $300.00. Roll call, all voted aye. Motion carried.
Motion by Maltman, seconded by Utecht, that the following resolution be adopted.
RESOLUTION:
Resolved, that the Home for the Aged persons located at G. Street and Kansas Avenue, Hastings,
owned by Adams county and operated under lease by Mrs. Neva Wolfe be officially named the Adams
County Nursing Home. Roll call, all voted aye. Motion carried.
Motion by Maltman, seconded by Utecht, that the Easement of the Lincoln Telephone and Telegraph
Company at the following location: East L feet of 150 feet, south of the North 50 feet of West
Hair (04) of Block 23, Lowman's North side Addition in the City of Hastings, Adams County,
Nebraska,be granted. Roll call, all voted aye.Motion carried.
'The rollowing letter of hiached E. Hunter, County Attorney was read and placed on file:
An opinion has been requested concerning the obligation of the county to maintain private farm
crossings over county road ditches. The sole and only obligation of the county to the owner of land
abutting a countv road is to pay damages for the original taking or aondemnntinn nr innH nneinirnH

It is therefore my opinion that Adams County is not liable or obligated to construct, erect,
or maintain any private farm crossings over ditches along county roads. I do not mean to say
that in a proper case, as a matter of policy, consideration should not be given to a reasonable
amount of grading to permit the landowner to have access to his land. However there has been
called to my attention that certain landowners are now insisting that the county maintain and
repair bridges and culvert crossings. This we have no obligation to do. If there are any
situations where county labor or materials were used in constructing bridges or culverts wholly
located on private property and not as crossing over ditches adjacent to county roads, then we
most certainly have no obligation to maintain these bridges or culverts. The fact that they were
illegally put in does not mean that we have taken upon ourselves an obligation to maintain. This
same ruling would apply to crossings over ditches along township roads over which the county has
no control: and no obligation except as may arise by contract in a proper case.
Any such agreements that have been made in the past were illegal when made, are void and do not
place any burden or obligation on the county at this time.

fund and the County Clerk be instructed to issue warrants for the same. Roll call, ail voted aye.

Motion by Woodman, seconded by Hohien, that we direct the County clerk to withhpld from
wages, as as per authorization filed with the County Board their monthly premium,from those who
desire to participate with the Blue Cross and Blue Shield Plan and remit to the Blue Cross and
blue Shield Plan in one lump sum, as L. B. 54, 1949 Session of Legislature. Roil call, all voted

Motion by. Gangwish, seconded by Utecht that the following Inventories oe accept and placed on
file, County Assessor, Clerk of the District_Court, Register of Deeds, uounty Clerk, County
Attorney, County hxtension Agent and County Treasurer. Roll call, ail voteid aye. Motion carried.
Motion by Lightner, seconded by Gangwish, that we adopt the following resolution "BE IT RESOLVED,
that the County board of Supervisors sell to the following purchaser the following described
property:
Lots 21 to 2j Incl. Block 2, Lots 9 to 11 Incl. Block 4, Lots 13 to 16 incl. and Lot 21, Block 5,
all of block 6, Lots 1 to 5 Incl. and 100 16, 22 to 24 incl. Block 7, and all of block 8, in
Wood and McCloudis Addition to the City of Hastings Adams uounty, Nebraska to the First Trust
Company of York Nebraska for the sum of $1200.00 and that the 'hairman of the County board ,of
Supervisors be hereby authorized to execute and deliver quit claim deeds to said purchaser.

Regular meeting of the Adams County board of Superisors net as per recess of December
1y53. George Anderson, Chairman presiding.
Roll call, members present: Anderson, Gangwish, Hohien, Lightner, Maltman, Utecht and
Woodman.
At 11:15 M. the Board resumed with the following members present: Anderson, Gangwish
Hohlen, Lightner, Maltman and Woodman. Absent: Utecht.
Motion by Maltman, seconded by Lightner, that we transfer 1473.02 from the Inheritance
Tax Funds to the General Fund to be expended for Relief purposes. Roll call, ail voted aye.
Motion carried.
Motion by Gangwish, seconded by Hohien, That we adOpt the following resolution:

RESOLUTION:
Whereas, There are unanticipated financial requirements in connection with the equippi4g
of the Adams Qounty Rest Home which requirements are essential to the preservation and
maintenance within said county of public administration of justice, public safety, public
welfare and public health, and:
Whereas, there are funds in the General Find of said county available to meet said
requirements
Now therefore, be it Resolved that an emergency exists for said reason and that the sum
of $1400.00 should be transferred from the General Fund to the Adams uounty Nursing Home
Fund as a temporary loan for the purpose of meeting the emergency created by such
anticipated reouirements, said loan to be repaid -from any funds availabel for such purpose.
Roil call, all voted aye. Motion carried.
Motion by Woodman, seconded by Hohlen, that we adopt the following resolution:
RESOLUTION:
"Whereas, There are unanticipated financial requirements in connection with the equipping

welfare and public health., and:
Whereas, there are funds in the General Fund of said county available to meet said
requirements

that the sum of $73.02 should be transferred from the General Fund to the County Poor Farm
as a temporary loan for the purpose of meeting the emergency created by such anticipated
requirements, said loan to be repaid from any runds available for such purpose, Roil call,
all voted aye. Motion carried.
Motion by Lightner, seconded by Gangwish, that we adopt the following resolution:
RESOLUTION:
BE IT RESOLVED that the .;ounty of Adams, Nebraska, enter into a contract with Harold Hoskins
and Associates of Lincoln, Nebraska, providing for the furnishing of engineering and right
of way services by said firm to Adams County, Nebraska; said services to be performed in
connection with the construction of 23.7 miles of Federal Aid Secondary highway in Adams
County said services and the contract providing therefor to be approved by the proper

Be it rurther resolved that the Uhairman of the Board:or Supervisors of Adams County,
Nebraska, be authorized and directed to do all things necessary to execute and deliver
said contract or contracts, the acts or said Chairman in executing such agreements being
hereby ratified and confirmed. Roll call, all voted aye. Motion carried.
