Regular meeting of the Adams County Board of Supervisors met as per adjournment of December 13, 1943. John A. James, Chairman, presiding. Roll call, all members present: Bivens, Goble, Hohlen, James, Koch, Priebe, and Sergeant. Minutes of last meeting were read and approved. Motion by Priebe, seconded by Bivens, that we adopt the following resolution: "WHEREAS, it appears that in the as- sessment of the property consisting of improvements on leased grounds, that there was made an obvious error in list- ing the valuation of the said property as $4500.00 instead of $2700.00, and WHEREAS, it hereby appears that the total valuation of the property is $2700.00, and the County Board being satisfied that it was an obvious error, IT IS, therefore, the opinion and judgement of this Board that the said assessment should be corrected in ac- cordance with the true valuation and intent, and the County Assessor, the County Clerk, and the County Treasurer are therefore hereby directed to correct the said assessment and the records based thereon to show the said property as- sessed at $2700.00 instead of $4500.00 as it now appears." Roll call, all voted aye. Motion carried. Motion by Hohlen, seconded by Sergeant, that we adopt the following resolution: "WHEREAS, Harry Suchland, as guard- ian of the person and estate of Rose Suchland, an incompetent person, duly appointed by the County Court of Adams County, Nebraska, has filed in the District Court of Adams County, Nebraska, a petition for a license to sell the following described real estate belonging to the incompetent: Five -eights (5/8) of the West Half Ni) of Lot Four (4), Block Four (4) College Addition to Hastings, Nebraska, and, The West Seventy-two (72) feet of the Southwest Quarter (sw) of Block Five (5), Mc Intyre's Addition to Hastings, Nebraska, and, The South, Half of the Southwest Quarter (Si SW-) of Section Thirteen (13), Township Eight (8) North, Range Nine (9) West of the 6th P. M., Adams County, Nebraska, for the reason that there is no cash or personal property belonging to the incompetent and the income from the real estate is insufficient to care for and maintain the incompetent, to pay the taxes thereon, and the expenses and charges of the management of her estate; that the expense of the care of the incompetent at the Ingleside State Hospital, Ingleside, Nebraska, since she was committed there on August 24, 1942 in a sum in excess of $350.00 or any part of it has not been paid and she or her estate is liable therefor and for the accruing expense of maintain- ing her and caring for her in said institution; that any part of the proceeds of the sale of said real estate avail- able can be invested so as to produce a larger return than is realized from the real estate; that it is for the benefit of the incompetent and her estate that the real estate be sold and the proceeds thereof used for the pur- poses aforesaid, and, WHEREAS, the Board of Supervisors of Adams County, Nebraska, have investigated the matter and approve of the proposed sale and deem it necessary for the best interests of the incompetent. THEREFORE, BE IT RESOLVED, by the Board of Supervisors of said county that it deems such proposed sale proper and beneficial to the ward and her estate and it approves the same that a dopy of this resolution be certified by the County Clerk of said County to the District Court thereof." Motion by Koch, seconded by Bivens, that Adams County lease to The Central Nebraska Public Power & Irrigation Dis- trict for water rights to irrigate the irrigable portion of the following described land: SW2 Section 1-6-11, Adams County, Nebraska, and authorize John A. Motion by Sergeant, seconded by Koch, that the Building & Grounds Fund showing the necessity of increase of budget by reason of unanticipated requirements growing out of emergencies, we hereby increase the budget of said Building & Grounds Fund the sum of $5000.00, and which may be transferred to said fund out of the unappropriated funds for the balance of the year 1943. Motion by Hohlen, seconded by Bivens, that we adopt the following resolution: "BE IT RESOLVED, That the County Board of Supervisors sell to the following purchasers the following described properties: Lot 2, Block 4, Dawes & Foss Addition to the City of Hastings, to L. 0. Haried for $85.00; Lots 1 and 2, Block 3, West Lawn Addition to the City of Hastings, to Stella Phillips for $100.00; subject to taxes of record which were bid in by the County on county tax certificate foreclosure sales; and that the chairman of the County Board be hereby authorized to execute and deliver quit claim deeds to said purchasers." Motion by Hohlen, seconded by Sergeant, that John A. James be appointed as temporary chairman. Roll call, all voted aye. Motion carried. Motion by Bivens, seconded by Priebe, that we proceed to take an informal ballot for the appointment of a permanent chairman of the Adams County Board of Supervisors for the year of 1944. Roll call, all voted aye. Motion carried. An informal ballot was ordered and the chairman appointed Bivens and Goble as tellers with results as follows: First ballot - Koch 1, James 3, Sergeant 2, Hohlen 1. Second ballot - James 6, Hohlen 1. Motion by Bivens, seconded by Koch, that we suspend the rules and John A. James be declared duly appointed permanent chairman of the Adams County Board of Supervisors for the year 1944. Motion by Koch, seconded by Priebe, that we adopt the following resolution: "BE IT RESOLVED, That the County Board of Supervisors sell to the following purchasers the following described property: Lot Six and the North Half of Lot Seven, Raymond's Subdivision of the West 2/3 of Lots 2 and 5, Haire's Subdivision of part of the NE1; of the NVQ , of Section 12, Township 7, Range 10, West of the 6th P. M., City of Hastings, to La Vern W. and Helen C. Augustin for $1.00; and, that the chairman of the County Board be hereby authorized to execute and deliver a quit claim deed to said purchasers." Motion by Goble, seconded by Priebe, that we approve the following banks as county depositories: The Hastings National Bank and City National Bank of Hastings, Adams County Bank of Kenesaw, and Roseland State Bank of Roseland; also, approve the securities posted by the following banks as security for funds in the following amounts - Hastings National Bank $200,000, City National Bank $158,800, Adams County Bank $13,000, and Roseland State Bank $20,000. Motion by Sergeant, seconded by Hohlen, that we consent to the County Treasurer depositing up to 100% of the capital stock and surplus in any of the depository banks named - said deposits to be protected by the bonds as required by law. Roll call, all voted aye. Motion carried. Motion by Koch, seconded by Goble, that the wages of County employees for the year 1944 beginning February 1, 1944 be as follows: Road dragging 30¢ per mile, single man 45¢ per hour, man and team 60¢ per hour, man and two teams 70¢ per hour, three patrolmen and maintenance men $137.50 per month, extra patrolmen 45¢ per hour, and common labor 45¢ per hour. Roll call, all voted aye. Motion carried. Motion by Priebe, seconded by Sergeant, that the salary of the assistant in the County Superintendent's office be $100.00 per month, Janitor $80.00 per month, stenographer in County Attorney's office $110.00 per month, assistant in County Treasurer's office $110.00 per month, two assistants in County Clerk's office $110.00 each per month, Deputy Sheriff $140.00 per month, and tax collector $.1+0.00 per month. Motion by Hohlen, seconded by Sergeant, that the County Clerk be and is hereby authorized to issue warrants on the last day of each month to all county officers who are entitled to receive pay on county warrants as are fixed by law governing the different county offices and upon agreement with the County Board; also, that the chairman of the County Board be authorized to sign warrants; also, that this order is to apply to county employees who are to receive a monthly salary. Motion by Hohlen, seconded by Bivens, that we recommend to the Nebraska Liquor Commission the wholesale beer license for L. Phillips, doing business as the Country Club Distributing Company, located at 1434 N. Baltimore Avenue, out- side the City of Hastings. Roll call, Ayes: Bivens, Goble, Hohlen, James, Koch, and Priebe. Nay: Sergeant. Mo- tion carried. Motion by Priebe, seconded by Sergeant, that the applications of Annetta Thayer, Margaret Cornelius, Edna Mitchell, and Pose Mc Cauley for Mother's Pension be approved. Roll call, all voted aye. Motion by Priebe, seconded by Sergeant, that we adopt the following resolution: "Upon showing by Lawrence Dunmire, County Attorney, that he will shortly be called into Military Service, and upon his application for leave of absence during his military service, the same is hereby granted, and Charles E. Bruckman is hereby appointed as Acting County Attorney. The leave of absence and the appointment of an Acting County Attorney to be effective as of the date that Lawrence Dunmire shall enter Military Service, and the appointment shall further be subject to the said Charles E. Motion by Bivens, seconded by Hohlen, that the applications of Margaret Hinz and Helen De Bord for Mother's Pensions be approved. Roll call, all voted aye. Motion carried. Motion by Priebe, seconded by Goble, that we adopt the following resolution: "BE IT RESOLVED, That the County Board of Supervisors sell the following purchasers the following described property: South 2 Lot 7, and Lot 8, Raymond's Subdivision of the west 2/3 of Lots 2 and 5, Haire's Subdivision, City of Hastings, to Edward 0. Krepps and Marianne D. ANDWHEREAS;-said settlement is fair and reasonable and said award should be approved by the Court. NOW, THEREFORE BE IT RESOLVED by the Adams County Board of Supervisors that a stipulation to that effect here- tofore signed on the 15th day of August, 1944, be approved and that the minutes and records of the Board show that the approval has been given for the entering into Stipulation on behalf of Adams County for the payment of said mount of $636.85 in full settlement of all claims in reference to said roads and highways of Adams County, and in reference to said expense of grading and graveling of the 1/2 mile of roadway." Motion by Priebe, seconded by Sergeant, that we authorize the County Treasurer to strike from the tax list, personal taxes delinquent two or more years, in which due diligence has been exercised on his part for collection, in accor- dance with Sec. 77-1929, Comp. Motion by Sergeant, seconded by Bivens, that the following resolution be adopted: "Be it resolved that Whereas, the First Baptist Church of Nebraska purchased the following described property, to -wit: Lot 7, Shutt's Sub. of Block 9, Mc Intyre's Addition to the City of Hastings; now, therefore, be it resolved that said taxes assessed for the year 1944 be cancelled by the County Clerk as provided by law." Bieck, an insane person, duly appointed by the County Court of Adams County, Nebraska, has filed in the District Court of our said Adams County, his petition and application for license to sell the following described property, to -wit: The south 50 feet of the north 100 feet of Lot 2, Block 10, Hillside Addition to Hastings, Nebr- aska, said petition alleges that the cash on hand and personal property of said insane ward are insufficient to main- tain said ward, pay taxes, other charges and maintenance of said guardianship and that it is for the best interest of said ward that the described real estate be sold and proceeds therefrom used for maintenance and balance be prop- erly invested; and, Whereas, the Board of Supervisors of Adams County, Nebraska, have investigated said matter and approve said sale and deem it for the best interest of said ward; now THEREFORE, BE IT RESOLVED by the Board of Sup- ervisors of Adams County, Nebraska, that we deem such sale proper and beneficial to the estate of said insane ward and approve the same as necessary. BE IT FURTHER RESOLVED that a copy of this resolution shall be certified by the County Clerk of said county to the Judge of the District Court of Adams County, Nebraska, in writing." Traeger for $40.00, Lots 1, 2, 3, 4, 5, 9, and 10, Block 19, East Park Addition to the City of Hastings, to Frank Thiede for $190. 00; and, that the chairman of the County Board be hereby authorized to execute and deliver quit claim deeds to said purchasers." Motion by Priebe, seconded by Hohlen, that the monthly reports of the (2) Soldiers & Sailors Relief, County Judge, Sheriff, Clerk of the District Court, County Clerk Car Titles, and Register of Deeds be placed on file. Motion by Koch, seconded by Goble, that we adopt the following resolution: "BE IT RESOLVED, That the County Board of Supervisors sell to the following purchasers the following described properties: N1 Lot 7, and Ni Lot 8, Block 15, Dawes & Foss Addition, City of Hastings, to Ella C. Powers for $67.50, Lots 11 and 12, Block 7, Cole's First Addition, City of Hastings, to John Lampman for $70.00, Lots 12, 13, 14, and 15, Block 1, Hill Crest Subdivision to the City of Hastings, to Adam D. Kohl for $281.25, Lots 21 and 22, Block 2, Heller's Addition, City of Hastings, to William Bland for $35.00; and, that the chair- man of the County Board be hereby authorized to execute and deliver quit claim deeds to said purchasers."
