Regular meeting of the Adams County Board of Supervisors met as per adjournment of December 5th, 1934. Roll call, all members present: Bauer, Berg, Bowers, Goble, Marian, Ruhter & Shannon. Minutes of last meeting were read and. approved. At 12 o'clock Noon the board recessed until 1:15 when they again resumed with all members present. Motion by Bowers, seconded by Bauer, that the fourth quarterly reports of the Sheriff, Register of Deeds, F. E. Shannon Ghairman of the Adams County Farm, H. E. Marian Member of Soldiers & Sailors Relief Commission, and M. Fred Ruhter, Highway Commissioner, be placed on file. Roll call, all voted aye. Motion carried. Motion by Ruhter, seconded by Bowers, that the following claims be allowed on their respective funds and the clerk instructed to issue warrants for the same. Roll call, all voted aye: Motion carried. At 2 o'clock P.M. the meeting was called to order by the County Clerk, members present as follows: Berg, Bowers, Goble, Harm, Marian, Shannon & Shaw. Motion by Shannon, seconded by Bowers, that J. E. Marian be appointed as temporary chairman. Motion carried. Motion by Bowers, seconded by Berg, that we proceed to take an informal ballot for the appointment of a per- manent chairman. Motion carried. An informal ballot was ordered and the chairman appointed Shannon and Goble as tellers with results as follows: Marian 6. Motion by Shannon, seconded by Shaw, that the informal ballot be made formal and that J. F,. Marian be declared duly appointed chairman of the Adams County Board of Supervisors for the year 1935. Motion by Shannon seconded by Goble, that the following resolution be adopted: RESOLUTION. WHEREAS, it appears to the Board of County Supervisors that it is necessary and advisable to authorize a deposit of county funds in the various banks in excess of 50% of the paid up capital and surplus, and BE IT THEREFORE RESOLVED, That the County Treasurer of Adams County be and is hereby authorized to deposit in the following named banks which have heretofore been duly and legally selected as depositories for county funds, funds up to 100% paid up capital stock and surplus of the said banks in accordance with law: The Hastings National Bank, Hastings, Nebr., The City National Bank, Hastings, Nebr., the Adams County Bank, Kenesaw, Nebr., and the Roseland State Bank, Roseland, Nebr. Roll call, all voted aye. Motion carried. Chairman. Motion by Shaw, seconded by Bowers, that the County Clerk be and is hereby authorized to issue salary warrants on the 1st day of each month to all county officers, deputies and clersk in county offices who are entitled to receive pay on county warrants in such amount as are fized by law governing the different county offices, or upon agree- ment with the county board, also that the chairman of the board be authorized to sign such warrants, also that this order is to apply to county road employees who are to receive a monthly salary. Motion by Goble, seconded by Shannon, that we adopt the State Plans & Specifications for the year 1935 as official plans & specifications for wooden, steel and concrete bridges to be built in Adams County, Nebr. during the year. Roll call, all voted aye. Motion carried. At 12 o'clock noon the board recessed until 1:15 P.M when they again resumed with all members present. Motion by harm, seconded by Bowers, that the salaries of the county employees for the year 1935 be as follows: Road Dragging 300 per single mile, single man 250 per hr., man & team 400 per hr., man & two team 500 per hr., patrolman 400 per hr., maintenance men $70.00 per month. Roll call, all voted aye. Motion carried. Motion by Shannon, seconded by Berg, that the budget of expenses for the Adams County Farm Bureau for $2500 for the year 1935 be approved. Roll call, all voted aye. Motion carried. Motion by Shaw,,, seconded by Goble, that the bond of Robert Hendricksen, Justice of the Peace, Cottonwood Twp., and William Routh, Treas. of Cottonwood Twp. be approved. Roll call, all voted aye. Motion carried. Motion by Shaw, seconded by Shannon, that we reappoint Robert Hendricksen as a member of the Soldiers & Sailors Relief Commission for a term of three years. Roll call. all voted ave. Motion by °Lannon, seconded by Goble, that the following resolution be adopted: WHEREAS, owing to the crowded condition off the State Hospital at Ingleside, Nebraska, there being 1530 persons occupying the room and space which should properly and adequately accommodate 903 patients, and WHEREAS, such a condition is neither conductive to the public benefit now to the well being of the patients, and WHEREAS, under section 83-730 compiled Statutes of Nebraska 1929 the board of trustees of said institution may order the discharge or removal from the hospital of incurable and harmless patients whenever it is necessary to make room for recent cases, and in such cases such patients would be thrown back upon the public and to the counties from whence committed. NOW THEREOFRE, be it resolved by the county board of supervisors of Adams County, Nebraska, at a regular session thereof, that the Legislature be urged to make provisions at the present session for more adequate facilities and additional accomodations at the said state hospital at Ingleside, Nebraska; and to that end the Legislature be urged to adopt and pass House Roll No. 543, now pending in the Legislature, and that a copy of this resolut- ion be transmitted to each of the members of the Legislature from Adams County, and to Senator Stewart, and that they be urged to support said House Roll No. 543. Motion by Harm, seconded by Berg, that the following resolution be adopted: RESOLUTION WHEREAS, the law relative to the bonds required of County Supervisors (Section 12-119 C. S. Suppl. 1933) was amended by H. R. # 4 1935 Session, which became effective April 13, 1935, and provides: "Each County commissioner or Supervisor when the population of the county does not exceed twenty thousand, one thousand dollars; when the population is over twenty thousand and less than thirty thousand inhabitants, two thousand dollars; when the population is over thirty thousand and less than fifty thousand inhabitants, three thousand dollars; when the county population exceeds fifty thousand, five thousand dollars." WHEREAS, the population of Adams County, 1930 census was 26,275. NOW THEREFORE BE IT RESOLVED, that the bonds of the county supervisors of Adams County be in the amount of $2,000.00, effective January 3, 1936. THIS AGREEMENT made in triplicate and entered into this 6th day of December, 1935, by and between The Central Nebraska Public Power and Irrigation District, a municipal corporation, hereinafter called the District, and the County of Adams of the State of Nebraska, hereinafter called the county: WHEREAS, the District is composed of Gosper, Phelps, Kearney and Adams Counties, and is organized for the purpose of constructing an irrigation and hydro -electric power system, and WHEREAS, it is necessary for the District to construct canels for the use of the District which will cross highways other than State and Federal highways, in Adams County, at or near the following locations: as shown on attached Blue Prints and as to be determined in detail at a later date by the Bridge Committee of Adams County, and a Representative of the District. NOW, THEREOFRE, in consideration of the mutual agreements and promises hereinafter contained to be kept and performed by the parties hereto, it is agreed as follows: 1. The Lounty hereby grants to tae District the right to construct and maintain temporary crossings and bridges where necessary as hereafter agreed to between the County and the District, said temporary crossings and said bridges to be constructed and said temporary crossings to be thereafter maintained in accordance with the plans to be prepared by the District and approved by the County. 2. The District agrees to construct and maintain under the direction of the County and without cost to the County, temporary crossings where necessary as hereafter agreed to between the County and the District, the District to furnish all necessary materials for the construction of the grade and its surfacing, said materials to be approved by the County. 3. The District agrees to erect and maintain or cause to be maintained, all necessary detour and warning signs. 4. The County agrees to permit the District to close the road in the vicinity of each bridge under construction. 5. The District agrees to replace the highway in accordance with details and specifications to be furnished by the County and in a condition satisfactory to the County after the construction of each bridge and approach. 6. The District Agrees to hold the County harmless from all claims for damages of any nature which may occur on, or in connection with, bridges or culverts while being constructed, while being used, or while being re- placed, or any present or future damages arising out of changed drainage conditions, flood contitions, or of any other contingencies in connection with the construction of the bridges or approaches, and to defend any and all actions and pay any and all judgments, including court costs, witness and attorney fees to which the County may be subjected by reason of the permission and privileges granted to the District by this agreement. WHEREAS, therewas heretofore granted to the Natuarl Gas Districuting Company an easement and right to lay and construct a four inch metal natural gas pipe -line in and along the Highway running North and South between Sections 27 and 28, Township 7, North Range 10, West of the 6th P.M. in Adams County, Nebraska, from a point where the main line of the Nebraska Natural Gas Company crosses said Highway between said sections, thence South along said Highway to a point lying opposite the Southwest corner of the Northwest Quarter (N4) of Section 10, Township 7, Range 10, in said County and State, thence east on the highway as now constructed, to a point opposite the Northease corner of the West Half (w) of the West Half (Wi) of the Southwest Quarter (SSV) of said Section 10, thence south along the Highway as now constructed, to a point somewhat north of the intersection between said Highway and the D L D Highway; and, WHEREAS, the Natural Gas Distributing Company has made application for the approval of an assignment of said easement and all rights thereunder to Nebraska Natural Gas Company; and, WHEREAS, such application has met with the approval of the County Board of Supervisors of Adams County, Nebraska; NOW, TH REOFRE, BE IT RES^LV''Dby' the Board of County Supervisors that such application be and it by granted, subject to the following conditions and restrictions: here - 1. If it should hereafter become necessary, , in the opinion of this Board, to change the grade of said High- way, or in any manner change said Highway, and such pipe -line shall interfere with any of such changes, the Nebraska Natural Gas Company shall relay and reconstruct its lines to conform with such change, at its own cost and expense. 2. The Nebraska Natural Gas Company shall hold Adams County, Nebraska, harmless from any damages which may arise from the laying, construction or maintaining of said pipe -fine, or relaying or reconstructing of said pipe -line, and agrees to execute and deliver to said county before beginning any work contemplated herein, and indemnifying bond protecting the county from any loss, liability or damage resulting from the laying, maintenance and operation of said line. Be it resolved by the county board of Supervisors of Adams County, Nebraska, that the highway between, Section Nine (9) and Ten (10) in Township Seven (7), Range Ten (10), West of the Sixth (6) P.N. in Adams County, Nebraska. be closed at the point where it enters the north boundary of the Ingleside State Hospital grounds, and that traffic hereafter proceed over the road heretofore provided to the east of the point above mentioned, and thence around the ease side of the said hospital grounds. This action is taken at the instance and request of the hospital authorities and thestate board of control for the reason that traffic along said highway as it heretofore existed had a tendency to irritate and detrimentally effect patients in said hospital adjacent to said highway as it heretofore existed.
