A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Larson,
Neumann, Hynes Orthmann, Saathoff and Woodman.
Motion by Orthmann, seconded by Larson, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication
in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe,
Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
The Chairman announced the locations of the open meetings law and agendas in the room.
Minutes of the previous regular meeting were approved as posted.
Orthmann attended a special meeting of the Adams County Convention & Visitors Bureau Board on March 20th regarding a discussion of the incentive fund, a meeting of the South Central
Economic Development Board in Alma on March 27th and a Buildings and Grounds Committee meeting this morning.
Larson attended the Road Committee meeting this morning and the bid opening for the 2008 Overlay Projects at the Roads Dept last Thursday.
Neumann attended the Safety Committee meeting on the 18th and the Buildings and Grounds Committee meeting this morning.
Hynes also attended the Safety Committee meeting on the 18th, the Hastings Area Alcoholism Coalition meeting and a Library Board meeting on the 25th, an LEPC meeting on the 27th and
a Region III meeting last Friday as well as the Road Committee meeting this morning. He reported that our Region III funding requirement will increase about $28,000.00 next year and
Region III Director, Beth Baxter, is scheduled on the Board agenda for April 15th.
Saathoff attended the Chamber Government Affairs meeting on the 19th, an Ag Committee meeting on the 20th, Drug Court graduation in Grand Island on the 21st, a Chamber of Commerce Board
meeting on the 26th and an HEDC meeting on the 27th.
Kehoe mentioned the Brown Recluse spider incident at the Hastings North Fire Station. The City and County will coordinate their efforts in this matter. He also mentioned complaints
from cell phone companies in the news, reduction of 47% in federal government funding for drug enforcement and the letter from the county judge regarding fee increases for attorneys.
Woodman attended the bid opening at the Roads Dept on the 27th and the Road Committee meeting this morning.
At 9:45 the Board considered the application of Richard Giddens of 1428 MacArthur, Hastings NE for manager of the Elk’s Lodge. County Clerk Lewis reported she had received information
from the Sheriff stating there was no criminal history on the applicant.
Motion by Kehoe, seconded by Orthmann to approve the application of Richard Giddens of 1428 MacArthur, Hastings NE for manager of the Elk’s Lodge B.P.O.E. #159 located at 3050 E South
St, Hastings NE. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Loren Uden, Emergency Management Director, reported to the Board that Hastings College is requesting to rent space on the County/City tower. They will install a telephone line at the
site as well as a security system to the building. The College will pay $50.00 per month for the space. He asked the Board to approve the contract.
Motion by Kehoe, seconded by Larson to approve and authorize the Chairman to sign the contract with Hastings College for rental space on the County/City communications tower. Roll call,
ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Dawn Miller, Highway Superintendent, presented a list of equipment from the Roads Dept. asking that it be declared surplus equipment.
Motion by Larson, seconded by Neumann to declare the list of equipment as presented by Dawn Miller as surplus equipment to be placed at public auction on May 1, 2008 with Stock Auction
Co. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Motion by Neumann, seconded by Saathoff to move to Board of Equalization for real estate exemption, omitted property, correction of clerical errors and Tax List Corrections. Roll call,
ayes: Kehoe, Larson,
Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Board of Equalization at 10:00 AM.
The Board recessed at 10:29 & reconvened at 10:35 AM.
Dawn Miller presented the bids for the 2008 Overlay Projects for a total of 8.21 miles. She reported that two bids had been received however one bid arrived late and was not allowed.
The bid allowed was from Vontz Paving; however it did not meet the bid requirements as they could not meet the completion date of October 15, 2008 as required by the County and would
not be able to even start the projects before November 2008. The bid total was for $1,048,159.00, $128,932.08 is the City’s cost share and the remaining $920,490.43 being the County’s
cost share. She stated that this year’s Road budget for overlay only has $83,000.00 left and the department typically budgets $400,000.00 annually for overlay projects and the County
would still be short $400,000.00 for this bid. She also reported that she recently learned that federal surface transportation projects will be at a minimum in the future and the County
will not receive any federal aid revenue until 2011. She stated that if the County wants to proceed with these projects, it needs to be determined where the money comes from to pay
for the projects. Miller’s recommendation was to table the award of the bid until April 15, 2008 to see if the City of Hastings wants to participate in the projects or possibly re-bid
in September.
Motion by Larson, seconded by Saathoff to table awarding of the bid for the 2008 Overlay Projects until April 15, 2008. Roll call, ayes: Kehoe, Larson, Hynes, Orthmann and Saathoff.
Nays, Neumann and Woodman.
Larson left at 11:09 Am and returned at 11:12 AM.
Saathoff left at 11:15 AM and returned at 11:18 AM.
Attorney Shane Perkins distributed copies of the proposed Drug and Alcohol policy for approval by the Board. Several questions were asked about records keeping, training and budget
for the testing and training. Perkins told the Board he would research these matters and bring the policy back to the Board on April 15th.
Perkins also presented a proposed stipulation for approval by the Board for release of penalties and interest by 360networks, Inc and PathNet Operating Inc for payment of the taxes.
The stipulation was presented in a resolution and read into the record.
Motion by Saathoff, seconded by Neumann to approve and authorize the Chairman to sign Resolution 08-04-01 as read into the record to release interest and penalties owed by 360networs,
Inc. and PathNet Operating Inc. when payment of taxes is received. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution
on file in the County Clerk’s office.
Tom Hawes, Clerk Magistrate, asked the Board to allow him to place a credit in the amount of $2806.04 with Business World Products. Because of an oversight on his part he had made a
duplicate payment to them in that amount. Business World Products returned the check to the County Clerk’s office. Hawes stated the reason he wanted to place the check as a credit
with Business World Products was he knew that money would be returned to the General Fund and not to the County Court budget and he would need the money before the end of the fiscal
year. County Clerk Lewis told the Board that she had checked with the State Auditor’s office and they said the money should be returned to the General Fund. Chairman Woodman told
Hawes that each fiscal year the Board transfers funds to various County budgets and if the County Court budget would need additional funds, the Board would take care of that prior to
the end of the fiscal year. Hawes was satisfied with that as long as the Board understood why he may go over this year’s budget.
Motion by Neumann, seconded by Kehoe to approve claims and authorize the County Clerk to pay the same from their respective funds. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann,
Saathoff and Woodman. Nays, none.
Motion by Saathoff, seconded by Orthmann to move to Executive Session for discussion of litigation of the Kothe Bridge case and payments to Mary Lanning Memorial Hospital for EPC patients.
Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Executive Session at 11:43 AM.
Motion by Neumann, seconded by Hynes to return to regular session. Roll call, ayes: Kehoe, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Larson, absent. Larson left
at 11:55. Returned to Executive Session at 11:57 AM.
The Chairman announced that the only discussion in Executive Session was regarding the Kothe Bridge case and payments to Mary Lanning Memorial Hospital.
Motion by Saathoff, seconded by Hynes to accept the proposal from the insurance company to settle the Kothe Bridge case in the amount of $17,500.00. Roll call, ayes: Kehoe, Neumann,
Hynes, Orthmann, Saathoff and Woodman. Nays, none. Larson, absent.

The Adams County Board of Supervisors met as a Board of Equalization for the purpose of hearing real estate exemption applications, add omitted property, allow correction of clerical
errors and Tax List Corrections with Chairman Larry Woodman presiding. Roll call members present were: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Also present
were Attorney Perkins, Assessor Hynes and County Clerk Lewis.
Hynes presented the application of the 1st Church of God for real estate exemption of their parsonage. Hynes recommended denial of this application because the pastor of the church
has purchased a house and the church currently allows a church member in need of housing to live there without paying rent to keep watch over the property. She stated that she felt
this did not meet the requirements of tax exempt status. The Board asked if this use didn’t allow for exempt status. Attorney Perkins asked if the person living in the property was
a sexton of the church. Pastor Stacey Jensby stated the church board felt that their duty was to help the needy and felt that this was a good use of the property in exchange for him
taking care of the property.
Motion by Saathoff, seconded by Neumann to table the application for real estate exemption of property owned by the 1st Church of God until April 15, 2008 for further information from
the attorney. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Hynes also presented information on mobile homes for Board approval.
Motion by Kehoe, seconded by Neumann to correct the value of the mobile home located at Lot 4 K & K Plaza to $28,160.00 for the 2007 tax year. Roll call, ayes: Kehoe, Larson, Neumann,
Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Motion by Saathoff, seconded by Orthmann to the change of value for a mobile home at Lot 12 Bonnavilla Plaza to $22,320.00 for tax year 2007 due to a clerical error. Roll call, ayes:
Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Motion by Neumann, seconded by Larson to add omitted property of a mobile home at Lot 52 Nebraska Trailer Court for tax years 2006 and 2007 in the amount of $5590.00. Roll call, ayes:
Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Larson left at 10:13 AM and returned at 10:17 AM.
Motion by Kehoe, seconded by Neumann to approve the change of value of a mobile home at Lot 51 Bonnavilla Plaza to $17,300.00 due to a clerical error. Roll call, ayes: Kehoe, Neumann,
Hynes, Orthmann, Saathoff and Woodman. Nays, none. Larson, absent.
Motion by Saathoff, seconded by Orthmann to add a mobile home located at #33 Sara Drive to the tax role for 2006 and 2007 in the amount of $23,410.00. Roll call, ayes: Kehoe, Larson,
Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Motion by Kehoe, seconded by Larson to add a mobile home at #3 Kingston Drive to the tax role for 2006 and 2007 in the amount of $26,500.00. Roll call, ayes: Kehoe, Larson, Neumann,
Hynes, Orthmann, Saathoff and Woodman. Nays, none.
