A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Larson,
Neumann, Hynes Orthmann, Saathoff and Woodman.
Motion by Larson, seconded by Kehoe, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in
the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe,
Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
The Chairman announced the locations of the open meetings law and agendas in the room.
Orthmann attended a meeting on the 19th at the Senior Services with Woodman, Chris Lewis, Sharon Stonecipher, Chuck Evans and Colleen Sedlacek to discuss public transportation in the
county. The matter will be discussed later on the agenda. On the 20th he attended a meeting of the South Central Economic Development Board in Holdrege, the officials meeting on
the 21st and a meeting of the Personnel committee.
Larson attended the Personnel Committee meeting, the Road Committee meeting and looked at several county roads last week.
Neumann attended the officials meeting on the 21st. The Christmas luncheon and work sessions were discussed. Most of the officials felt that quarterly work sessions with the Board
would be good. He also attended a South Heartland District Health meeting on the 25th. Senator Carlson was there and was updated on some health issues in the district. He also attended
the Planning Commission meeting last night and the Buildings and Grounds meeting this morning.
Hynes attended the Combined Services meeting on the 19th and the Road Committee meeting this morning.
Saathoff attended the Personnel Committee meeting and a Chamber meeting & Mid Ne Individual Services meeting on the 19th.
Kehoe attended a CASA meeting, a Combined Services meeting, the monthly meeting with the Emergency manager and a Buildings and Grounds meeting this morning. They are withdrawing the
bid for the voting machine that was voted on last Board meeting as they want a bigger Board similar to what the City has.
Woodman attended the Combined Services meeting and the City was asked if they would participate in the local funding portion of the public transportation costs. The City is not wanting
to do this at this time but the County will continue to discuss it with the City. He also discussed the mushrooming costs for mental health services with the City and he has been
asked to serve on an oversight committee. He also attended the meeting at the Senior Services on the 19th and the Road Committee meeting this morning.
During the public comments portion of the agenda Butch Hughes of 4135 E Hadco Rd, Hastings told the Board that the Recall Committee had gathered 4023 signatures and would be turning
the petitions in to the County Clerk for verification after the Board meeting. He also detailed the dates for a possible election of January 27th which would be well past the 16 days
from the effective date of the retirement of Julia Moeller which would mean the election would not have to be held. He also repeated that the comments he has heard from the public
express that they do not wish to see anyone from within the treasurer’s office appointed as the new treasurer.
At 9:45 the Board opened bids for a used excavator. Bids received were from Murphy Tractor in the amount of $99,500.00, Nebraska Machinery in the amount of $100,000.00 , and Road Builders
for $154,268.00 . She asked the Board to hold awarding of the bid until the Road Committee had the opportunity to inspect the machines and bring back a recommendation to the Board.
Neumann asked if the model numbers of the machines indicated horse power and if there was any record of fuel consumption of each machine. The bidders stated that the model numbers
indicated metric ton and the Road Builders machine does come equipped with a program to monitor fuel consumption. The other machines had that function available as an option.
At 10:00 AM the Board opened bids for a concrete box culvert at 94th St and Shiloh Ave. Dawn Miller introduced Jeff Pollack, engineer from Olsson & Assoc Engineering. Three bids were
received from the following companies: Midlands, $88,823.90; TCW Construction, $79,937.90 and Diamond Engineering, $73,870.33.
All bids came in over the engineers estimate of $65,000.00. Miller asked the Board to delay awarding of the bid until she and the engineer could review them and see why they are over
the estimate and why there is such a discrepancy in some of the bids.
Miller also asked the Board to reappoint Dave Niemoth to the Planning Commission.
Motion by Saathoff, seconded by Neumann to reappoint Dave Niemoth to the Planning Commission for a three year to expire December 2011. Roll call, ayes: Kehoe, Larson, Neumann, Hynes,
Orthmann, Saathoff and Woodman. Nays, none.
Motion by Kehoe, seconded by Orthmann to move to Board of Equalization for motor vehicle exemption renewals and Tax List Corrections. Roll call, ayes: Kehoe, Larson, Neumann, Hynes,
Orthmann, Saathoff and Woodman. Nays, none.
Motion by Kehoe, seconded by Saathoff to accept the notice of retirement from Treasurer, Julia Moeller, effective January 5, 2009. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann,
Saathoff and Woodman. Nays, none.
Donna Fegler Daiss, attorney, presented the resolution regarding expenditures of county funds for recognition of employees. Woodman stated that he has thought about the resolution and
feels that the portion referring to years of service should be removed from the resolution. He stated that there has never been an issue regarding an employee’s years of service and
doesn’t feel that we should create problems by placing a time referencing years of service in the resolution.
Motion by Neumann, seconded by Orthmann to approve and authorize the Chairman to sign Resolution 08-12-02 as amended by omitting the section that states years of service for recognition
of county employees. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete resolution on file in the County Clerk’s office.
Orthmann reported to the Board about the transportation issue with NIRMA and the County handibuses. He told the Board that NIRMA has a problem with the Senior Services employees driving
County vehicles and not being County employees. The discussion at the meeting on the 19th at Senior Services centered around the bus drivers becoming County employees. The Senior
Center would still dispatch and manage the operations of the handibuses. The program is funded 50% by the federal government and the remaining 50% is divided by the state and county.
All the costs associated with the drivers becoming County employees would be factored into the grant request at budget time each year. There would be some increase in costs to the
County as the funding from United Way would be lost. NIRMA has no issues with the transportation program and the bus drivers if the drivers become county employees. Attorney Daiss
questioned whether NIRMA had any issues regarding employment issues when the county employees would not be supervised by an official or county employee. She would contact NIRMA to
check on this. The Board will take up the discussion again when she gets more information.
Woodman mentioned that Christmas falls on Thursday this year and more than likely the federal and state governments will be closing on Friday after Christmas. He asked the Board if
they wished to give Friday as holiday here at the courthouse as well.
Motion by Larson, seconded by Orthmann to approve closing the Courthouse on December 26, 2008. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays,
none.
Motion by Kehoe, seconded by Hynes to approve claims and authorize the County Clerk to pay the same from their respective funds. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann,
Saathoff and Woodman. Nays, none.
Motion by Neumann, seconded by Orthmann to accept officers reports for the month of November from the County Clerk and Clerk of District Court. Roll call, ayes: Kehoe, Larson, Neumann,
Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Motion by Neumann, seconded by Kehoe to move to Executive Session for personnel issues and property negotiations. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann< Saathoff
and Woodman. Nays, none. Entered Executive Session at 11:15 AM.
Motion by Neumann, seconded by Orthmann to return to regular session. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced
that the only discussion in Executive Session was regarding personnel matters and property negotiations.
Motion by Saathoff, seconded by Kehoe to approve hiring Pam Bourne and Mark McQueen of Spencer, Fane Britt and Browne to rewrite the county personnel policies. Roll call, ayes: Kehoe,
Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.

The Adams County Board of Supervisors met as a Board of Equalization with Chairman, Larry Woodman, presiding for the purpose of hearing motor vehicle exemption annual renewal requests.
Roll call members
present were: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Also present were County Clerk Lewis, Attorney Daiss and Deann Thaut representing the Treasurer.
Motion by Hynes, seconded by Larson to approve and authorize the Chairman to sign Tax List Corrections numbers 13476 through 13479. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann,
Saathoff and Woodman. Nays, none.
Motion by Neumann, seconded by Saathoff to approve motor vehicle exemption applications for the Revival Center for the remainder of 2008 due to a name change from United Pentacostal
Church. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Motion by Neumann, seconded by Kehoe to approve annual renewal of 36 entities for motor vehicle exemptions as presented by the Treasurer’s office. Roll call, ayes: Kehoe, Larson, Neumann,
Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Motion by Orthmann, seconded by Hynes to return to regular session. Roll call, ayes: Kehoe, Larson, Neumann, Saathoff and Woodman. Nays, none. Returned to regular session at 10:35
AM.
