A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Larson,
Neumann, Hynes Orthmann, Saathoff and Woodman.
Motion by Kehoe, seconded by Larson, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication
in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe,
Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
The Chairman announced the locations of the open meetings law and agendas in the room.
Minutes of the previous meeting were approved as circulated.
The agenda was amended to include personnel issues and county burial to the Executive Session.
Orthmann attended a meeting with Dee Haussler & some of the Board Members on the 8th and the NACO Conference in Lincoln on December 10th through the 12th.
Larson attended the NIRMA annual meeting in Lincoln on December 10th the Midland Area Agency on Aging meeting and the Roads Committee meeting this morning.
Neumann also attended the MAAA meeting on the 4th, a Meth Coalition meeting and a Buildings and Grounds Committee meeting on the 8th and the NACO and NIRMAN meetings December 10th through
the 12th.
Hynes attended the NACO Conference the 10th through the 12th and a Library Board meeting. He also reported that a new Library director has been hired.
Saathoff attended the NACO Conference & NIRMA meeting and Drug Court on the 15th.
Kehoe attended a CASA meeting and a Truancy Committee meeting and the Buildings and Grounds Committee meeting.
Woodman spoke to the Mental Health Oversight Committee on the 9th and the NACO & NIRMA meetings the 10th through the 12th.
During the public comments portion of the Agenda Chuck Neumann of 908 N Kansas read a letter into the record from Ann Harrell, Brenda Essex and Jan Kopisch in support of the staff in
the Treasurer’s office and Deputy Bev Davis.
Michele Bever, Director of South Heartland District Health Board presented a proposed Interlocal Agreement to the Board but will bring it back for their approval when the all county
attorneys finalize the language. She also presented the annual departments annual report.
Dawn Miller addressed the Board regarding the bids received for the 94th St concrete box culvert project. She stated that in view of the bridges in the county that have been closed
by the State, she recommends rejecting all bids on this project as this road is open and she would like to use the money in the budget for this project to re-open some of the 13 closed
bridges in the county.
Motion by Saathoff, seconded by Kehoe to reject all bids for the 94th St concrete box culvert project. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann and Saathoff.
The Board gave each bidder for an excavator 5 minutes to present information to and answer questions from the Board members. Tony of Road Builders spoke about the Komatsu Model PC220L
C-8, Larry chmidt of NE Machinery spoke about the Caterpillar 320 CL and Justin Pape of Murphy Tractor spoke about the Hitachi Z Axis 200 LC. Miller told the Board that she is very
happy with the current Caterpillar excavator they have and it has been very fuel efficient. The specs for the bid were written around the current Caterpillar.
Motion by Neumann, seconded by Larson to award the bid for an excavator to NE Machinery in the amount of $100,000.00 plus $9084.00 for the wheel compactor and $3900.00 for a windshield
debris guard. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Mays, none.
Miller presented information to the Board on the Harmon Hills Subdivision.
Motion by Saathoff, seconded by Larson to approve Harmon Hills Subdivision, case 08-12.1. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
The Board recessed at 10:45 AM and reconvened at 10:55 AM.
Chairman Woodman told the Board that he has contacted the auditors for an audit of the County Treasurer’s office on January 5, 2009 and would like authorization for the expenditure for
the special audit.
Motion by Neumann, seconded by Kehoe to authorize the expenditure for the special audit of the County Treasurer’s office. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff
and Woodman. Nays, none.
Sheriff Gregg Magee presented an addendum to the SCALES Memorandum of Understanding to include Phelps County and the cities of Holdrege and Aurora and asked the Board for approval.
Motion by Kehoe, seconded by Hynes to approve and authorize the Chairman to sign the Addendum to the SCALES MOU. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and
Woodman. Nays, none.
Motion by Orthmann, seconded by Saathoff to move to Board of Equalization for motor vehicle exemption applications and Tax List Corrections. Roll call, ayes: Kehoe, Larson, Neumann,
Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Board of Equalization at 11:00 AM.
County Clerk Lewis told the Board that sufficient signatures for recall of Treasurer Julia Moeller had been gathered and they would need to set a date for the Recall Election. She also
reported that Deputy Secretary of State for Elections, Neal Erickson, stated that an elected official does not retire. They must resign and a letter of resignation for Moeller would
be needed to call off the election. Until that letter of resignation is received, the election requirements proceed.
Motion by Hynes, seconded by Larson to accept receipt of the Certification of Valid Signatures in the recall of Julia Moeller and set January 27, 2009 as the date for the Recall Election.
Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Motion by Saathoff, seconded by Larson that the Board encourage Julia Moeller to submit a letter of resignation. Roll call, ayes: Kehoe, Larson and Saathoff. Nays, Neumann, Hynes,
Orthmann and Woodman. Woodman stated that the reason he did not vote for the motion is because of the possibility of a lawsuit against the County.
Motion by Kehoe, seconded by Orthmann to approve claims and authorize the County Clerk to pay the same from their respective files. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann,
Saathoff and Woodman. Nays, none.
Motion by Saathoff, seconded by Larson to accept Miscellaneous Receipts for the month of November in the amount of $450,904.04. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann,
Saathoff and Woodman. Nays, none.
Motion by Neumann, seconded by Saathoff to accept officers reports for the month of November form the Register of Deeds. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann< Saathoff
and Woodman. Nays, none.
Motion by Orthmann, seconded by Kehoe to move to Executive Session for discussion of litigation, public transportation contract, negotiations for purchase of a building, personnel and
county burial. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Executive Session at 11:20 AM.
Saathoff left at 11:30 AM.
Motion by Kehoe, seconded by Neumann to return to regular session. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann and Woodman. Nays, none. Saathoff, absent.
Hynes left at 12:15 PM.
Motion by Orthmann, seconded by Kehoe to approve the request for county burial assistance. Roll call, ayes: Kehoe, Larson, Neumann, Orthmann and Woodman. Nays, none. Hynes and Saathoff,
absent.
Motion by Neumann, seconded by Orthmann to instruct the County Attorney to work with the CRA to structure a tax refund plan. Roll call, ayes: Kehoe, Larson, Neumann, Orthmann and Woodman.
Nays, none. Hynes and Saathoff, absent.
Motion by Kehoe, seconded by Larson to authorize donations of sick leave for an employee in the Sheriff’s office. Roll call, ayes: Kehoe, Larson, Neumann, Orthmann and Woodman. Nays,
none. Hynes and Saathoff, absent.
The Board recessed at 12:20 PM and reconvened at 1:30 PM. Saathoff returned at 1:30 PM.
The Board continued the meeting in discussion with 33rd Legislative District Senator Elect Dennis Utter about concerns and issues the County faces in the coming year and asked for his
support in legislature in
the future. Utter stated that he would need their knowledge and advice on legislative matters and would work with them on future concerns.
The Board adjourned at 2:10 PM.

The Adams County Board of Supervisors met as a Board of Equalization for the purpose of hearing motor vehicle exemption applications and Tax List Corrections with Chairman, Larry Woodman,
presiding. Roll call members present were: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Also present were County Clerk Lewis, County Attorney Daiss and Dee Thaut,
representing the Treasurer’s office.
Motion by Orthmann, seconded by Hynes to approve motor vehicle exemption applications for the Church of Christ for one vehicle and Mosaic for two additional vehicles. Roll call, ayes:
Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Motion by Orthmann, seconded by Kehoe to approve annual renewal of motor vehicle exemptions for 2009 for the Ag Society and Zion Lutheran Church. Roll call, ayes: Kehoe, Larson, Neumann,
Hynes, Orthmann, Saathoff and Woodman. Nays, none.
Motion by Saathoff, seconded by Hynes to approve and authorize the Chairman to sign Tax List Correction number 13480. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff
and Woodman. Nays, none.
Motion by Orthmann, seconded by Larson to return to regular session. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Returned to regular
