HomeMy WebLinkAboutSP 01-20-09COURTHOUSE HASTINGS NEBRASKA Tuesday, January 20, 2009 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Larson, Neumann, Hynes Orthmann, Saathoff and Woodman. Motion by Larson, seconded by Orthmann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room. The minutes of the previous meeting were approved. Kehoe attended a Buildings and Grounds meeting this morning and went over some things Harold wants to do. He has a bid to make the first floor restrooms handicap assessable. In the search for a building for the Sheriff and Emergency manager, the committee has found one building that may work. He also announced that the new electronic voting board is working. Saathoff attended a Planning Commission work session on the 7th, an Ag Business and HEDC annual meeting on the 15th, a Personnel Committee meeting on the 16th, Sue Brown’s retirement on the 18th and an RSVP meeting on the 19th. Hynes attended a meeting with the Emergency Manager on the 6th, a Road Committee meeting on the 14th and this morning, the HEDC annual meeting on the 15th and Sue Brown’s retirement on the 18th. Neumann was sworn in to his new term of office on the 8th and also attended a Midland Area Agency on Aging meeting. He also toured some of the buildings being looked at and attended a Meth Coalition meeting on the 12th, a South Heartland District Health Dept meeting on the 14th and the Planning Commission work session on the 7th. Larson attended the MAAA meeting on the 8th, the Planning Commission work session on the 7th, a Personnel Committee meeting on the 16th and Sue Brown’s retirement on the 18th and the Road Committee meeting this morning. Orthmann attended a Heartland Pet Connection board meeting on the 7th, the swearing in on the 8th, the building search on the 9th, a BID meeting on the 13th, a Senior Services Board meeting on the 14th, an ACCVB meeting, Senior Services and HEDC meetings on the 15th and a Personnel Committee meeting on the 16th. During the public comments portion of the agenda, Shane Perkins, board member of Big Brothers Big Sisters asked the County Board members to participate in the Big Brothers Big Sisters annual fund raiser, Bowling for Kids Sake. Dawn Miller, Highway Superintendent, presented a preview of the County’s one and Six Year Road Plan. The public hearing will be held February 17th. Lynn Hanson, County Weed Dept Superintendent, presented the year end report and his plan for his department in 2009 and asked for the Board’s approval. Motion by Hynes, seconded by Larson to approve and authorize the Chairman to sign the Weed Dept. year end report. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. At 10:30 the Board reviewed bids for county inventory culverts. Dawn Miller reported three bids were received, Ace Irrigation, $25,432.80; Contech, $29,997.20; and Midwest Service, $28,428.25. Miller recommended awarding the bid to Ace Irrigation. Motion by Larson, seconded by Neumann to award the bid for county inventory culverts to Ace Irrigation in the amount of $25,432.80 with delivery in 4 weeks. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Ron Seymour, Extension Agent, presented a list of Extension Board members to the Board for 2009 and asked for their approval. Motion by Saathoff, seconded by Hynes to appoint the following to Adams County Extension Board for 2009: Greg Schneider, Connie Niles and Jackie Queen for three year terms and approve the current Board members of Kathy DeLashmut, LeRoy Hahn, Mark Swanson, Carol Herrenstein and Janell Trausch, Bev Stein as the Family Community Education Clubs Representative and Rick Meyer as the Adams County 4-H Council Representative. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Harold Johnson, Maintenance Supervisor, asked the Board for permission to donate sick hours to one of his employees who recently had surgery and will be off from work about 6 weeks. Motion by Kehoe, seconded by Orthmann to approve donation of sick hours from Harold Johnson for 54 hours to Orlin Siemers. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Johnson also asked the Board to declare a 1973 Jeep CJ 5 with a mounted snowplow as surplus equipment to be placed at public sale by way of sealed bids. He stated that there were no other departments in the County that had use for the vehicle. Motion by Saathoff, seconded by Larson to declare the 1973 Jeep CJ5 with a mounted snowplow as surplus equipment to be placed at public sale by sealed bid. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Sheriff Gregg Magee told the Board there is a vacancy on the Merit Commission with the resignation of Julia Moeller. The Board needs to appoint an elected or appointed official to fill the vacancy. Motion by Larson, seconded by Hynes to appoint Supervisor Chuck Neumann to the Merit Commission for a term to run to 2010. Roll call, ayes: Kehoe, Larson, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Neumann, abstained. County Clerk Lewis presented a list of outstanding checks from January to December 2008 to the Board asking for approval to cancel them. Motion by Saathoff, seconded by Orthmann to cancel duplicate, voided and outstanding checks from January 8, 2008, written on the County Imprest Fund with the stipulation that claims may be submitted for payment upon request of any of the vendors. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Attorney Daiss asked the Board to approve foreclosure on a list of unsold tax certificates. She also asked for approval of the resolution regarding the expenditures of county funds for employee recognition. Motion by Saathoff, seconded by Kehoe to approve and authorize the Chairman to sign Resolution 09-01-20.1 calling for the foreclosure of tax list certificates. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County Clerk’s office. Motion by Kehoe, seconded by Larson to approve as amended and authorize the Chairman to sign Resolution 09-01-20.2 setting a policy for expenditures of county funds for employee recognition. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County Clerk’s office. Supervisor Neumann proposed changing the amount the County pays to the local mortuaries for county burials from $1250.00 to $1325.00. Motion by Neumann, seconded by Hynes to approve a new rate of $1325.00 for county burial assistance to those funeral homes the County contracts with. Roll call, ayes: Kehoe, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, Larson. Motion by Neumann, seconded by Kehoe to approve and authorize the Chairman to sign the Interlocal Agreement with Nuckolls, Clay and Webster Counties for the South Heartland District Health Dept. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Board recessed at 10:55 AM and reconvened at 11:05 AM Motion by Orthmann, seconded by Kehoe to move to Executive Session for personnel issues and possible litigation. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Also present were Attorney Pam Bourne via conference call, County Clerk Lewis, Attorney Daiss, Law Clerk Bill Troshynski and Deputy Treasurer, Beverly Davis. Entered Executive Session at 11:07 AM. Motion by Neumann, seconded by Saathoff to return to regular session. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced upon returning to regular session that the only discussion in Executive Session was regarding personnel issues and possible litigation. Dee Haussler, Executive Director of Hastings Economic Development Corporation presented information to the Board requesting the release of certain properties in the County Industrial Areas. Motion by Saathoff, seconded by Neumann to approve release of the following properties from County Industrial Areas for annexation by the City of Hastings effective January 2009: release of the 4th 20% of AGP; release of the 3rd 20% of Nebraska Cold Storage; release of the 3rd 20% from Pepsi Cola Bottling Company; release of the 3rd 20% of Eaton Corp.; release of the 3rd 20% of Van Diest Supply Co.; release of the 2nd 20% of Echo Co.; and release of the 2nd 20% 0f L & H Mfg. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none Motion by Kehoe, seconded by Larson that the Board committee appointments remain the same as 2008. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Saathoff to approve the request of Heartland Pet Connection for a Special Designated Liquor License for an event to be held February 7, 2009 at the Elks Club . Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Motion by Kehoe, seconded by Orthmann to move to Board of Equalization for motor vehicle exemption application. Roll call, ayes: Kehoe, Larson, Neumann, Saathoff and Woodman. Nays, none. Entered Board of Equalization at 12:20 AM. Motion by Neumann, seconded by Hynes to approve claims and authorize the County Clerk to pay the same from their respective funds. Motion by Saathoff, seconded by Kehoe to approve Miscellaneous Receipts for the month of December in the amount of $488,623.60. Motion by Neumann, seconded by Larson to accept officers reports from the Sheriff for the month of December. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Board recessed at 12:30 PM and reconvened at 1:30. They continued the meeting in a work session with the other elected officials and department heads. Roll call members present were: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Also present were County Clerk Lewis and Attorney Daiss. The meeting was properly advertised in the Hastings Tribune and the meeting was conducted in accordance with the Open Meetings Act. Applicants interviewed were Lori Hartzell, Christine Junker, Beverly Davis, Michelle Konen-Overy and Leland Lee Preston. At the conclusion of the interviews the Board discussed the qualifications of each applicant. Motion by Larson, seconded by Neumann that based on her experience in the office he nominates Bev Davis for the position of Adams County Treasurer effective February 1, 2009.
