HomeMy WebLinkAboutSP09-15-09COURTHOUSE HASTINGS NEBRASKA Tuesday, September 15, 2009 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Larson, Neumann, Hynes Orthmann, Saathoff and Woodman. Motion by Neumann, seconded by Orthmann that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room. Minutes of the previous meeting were approved as posted. Orthmann attended a meeting of the NACO Institute of Excellence, the Carbon Motors presentation and on September 11th he received a call about water leaking in the roof at The Bridge due to the rain. The roofer who replaced the shingles is supposed to replace the flashing and the shingles around the vent areas where the leak was. He also attended a Buildings and Grounds Committee meeting this morning. Larson attended a meeting of the Midlands Area Agency on Aging, an Extension Board meeting and the Road Committee meeting. Neumann attended the MAAA meeting on September 3rd and the Planning Commission meeting on the 14th. He also announced that the Planning Commission will hold a workshop on September 22nd at 6:00 PM on the Land Use review. He attended a Buildings and Grounds Committee meeting this morning and they discussed the bids for windows at the ACOB and he has also talked with Ron Seymour about an 80/20 grant for trees. He reported that a hospital employee, Dave Wicker, trimmed the shrubs and trees on the west and south sides of the Courthouse and will continue with the north and east sides. He thought they would wait until spring to replace the mulch. He also attended a meeting of the South Heartland District health Board and discussed the H1N1 flu. Hynes attended the NACO Institute of Excellence, a Combined Services meeting, the Carbon Motors demonstration and the Road Committee meeting. Saathoff attended the NACO Institute of Excellence and the Carbon Motors demonstration. Kehoe received an email from Jan Johnson, Register of Deeds, requesting approval for food donations again from county employees for local agencies. He also reported on a complaint from NE Aluminum Castings about the railroad crossing on J Street. He attended the Combined Services meeting and the Carbon Motors demonstration. The Buildings and Grounds Committee met this morning and opened the bids for the replacement of windows at the ACOB and will give more information later in the meeting. He also met at The Bridge about the leak in the roof. Woodman attended the Combined Services meeting and reported that the tire collection event held by the City took in 400 tons of old tires. Last Friday he and Dawn Miller visited the site for the new Whelan II utilities plant and he also attended the Road Committee meeting this morning. Dawn Miller, Highway Superintendent, updated the Board on recent heavy rain damages estimated to be between $250,000.00 and $300,000.00. It does not appear that there will be an area wide disaster declaration for FEMA assistance as Adams County appears to be the only county to receive the heavy rain. In order to get FEMA assistance the loss would need to be over $480,000.00 which would be equivalent to the loss of a bridge. She also reported that after the Central District meeting in Kearney on Thursday, the 17th, the NDOR will be meeting with county officials about proceeds regarding stimulus funding. The Planning Commission meets September 22nd for review of the Land Use Plan. She also stated that it is helpful when citizens get involved with local issues as now the railroad is repairing the crossing on J Street. At 10:00 AM the Board held a public hearing for the 2009-2010 county budget. No one appeared to speak for or against the proposed budget and the hearing was closed. Motion by Neumann, seconded by Larson to approve and adopt the 2009-2010 county budget as proposed. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Miller presented the annual yearend report for the Road Dept. Motion by Saathoff, seconded by Hynes to approve and authorize the Chairman to sign the annual Roads Dept yearend report for 2008-2009 and to place a copy on file with the County Clerk. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Kehoe, seconded by Orthmann to move to Board of Equalization for motor vehicle exemption applications. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Board of Equalization at 10:15 AM. Kehoe reported that there were two bids for replacement of windows at the ACOB and that the bids were about twice as high as the Buildings and Grounds Committee had anticipated. Kroeker Construction of Juniata submitted a bid of $137,282 for 98 non opening windows and $186,052 for windows with openings. Howards Glass submitted bids of $97,753 for non opening windows and $126,786 for windows with openings. The Buildings and Grounds Committee recommends rejecting all bids and wait to see what the plans are for Health & Human Services who occupy the 3rd and 4th floors of the building. They may get informal quotes for replacement of windows on the alley side on the first floor as that is where the moist complaints about the old windows is coming from. Motion by Neumann, seconded by Saathoff to reject all bids received for replacement of windows at the ACOB. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. County Clerk Lewis reported that Hastings State Bank had called a security in the amount of $1,500,000.00 and asked to have it released and replaced. The replacement security will only be for $350,000.00 as the FDIC will guarantee deposits up to $250,000.00 and the remaining amount of county funds on deposit at Hastings State Bank is less than $350,000.00 Motion by Saathoff, seconded by Larson to release the $1,500,000.00 security number 31393ADM6 from Hastings State Bank and replace it with security number 36202FAE6 in the amount of $350,000.00. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Attorney Troshynski reported that he has reviewed the contract with The Bridge and does not see anything in the contract that will prevent the County from giving title to The Bridge and note Adams County as the lien holder for property located at 907 S Kansas Ave. This could be done through a Deed of Trust. He will bring it to the next Board meeting for their approval. Troshynski also reported that he has looked at the NACO purchase card program and several counties are currently using the card and like very well, however he feels that policies need to be in place prior to handing out the cards. He will formulate policies for Board approval at the next meeting. Motion by Saathoff, seconded by Kehoe to approve claims and authorize the County Clerk to pay the same from their respective funds. Roll call, ayes: Kehoe, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Larson, abstain. Motion by Hynes, seconded by Larson to accept Miscellaneous Receipts for the month of August in the amount of $352,870.36. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Kehoe, seconded by Orthmann to accept officers reports for the month of August from the Sheriff, Register of Deeds and County Clerk. Roll call, ayes: Kehoe, Neumann, Hynes, Orthmann< Saathoff and Woodman. Nays, Larson. Motion by Neumann, seconded by Orthmann to enter Executive Session for contracts, real estate negotiations and litigation. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Executive Session at 10:45 AM. Motion by Hynes, seconded by Neumann to return to regular session. The Chairman announced that the only discussion was regarding contracts, real estate negotiations and litigation and no action was taken. Motion by Neumann, seconded by Saathoff to approve motor vehicle exemption applications for South Central Behavioral Services and Mosaic. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Orthmann, seconded by Kehoe to return to regular session. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Returned to regular session art 10:20 AM. This Board is adjourned.
