A regular meeting of the Adams County Board of Commissioners was held with Chairman Lee Hogan presiding.
Motion by Curtis,seconded by Stromer that this is an open public meeting of the Adams County Board of
Commissioners. Roll Call,Ayes:Stromer, Larsen, Hogan,Johnson, Curtis, Neumann, Patterson Nays: None
Absent: None
Chairman Hogan inquired if there were any conflicts of interest. No conflicts were disclosed.
Roll was taken, roll call members present, Michael Stromer-District 1, Glen Larsen—District 2, Lee Hogan-
District 3, Harold Johnson—District 4, Dale Curtis-District 5,Chuck Neumann—District 6,Joe Patterson -

Chairman Hogan stated minutes from the March 1, 2022 meeting have been circulated to board members and
requested a motion to approve the minutes if there are no corrections.

Thank you for your collaboration on the 2022 South Central East Community Wildfire
Protection Plan(CWPP)for Adams,Clay,Fillmore,Jefferson,Nuckolls,Saline,Thayer,and
Webster Counties.During the review period we received updated graphics for Jefferson and
Webster County Fire Resources and Services,as well as several more fire department surveys.
These have been added to the final document.We also corrected a few typographical errors and
made some minor formatting changes to improve legibility.
Enclosed is the CWPP signature page.Please fill out and sign the section for your county and
return to us via scan(preferred)to:sbenson4®unl.edu or by regular mail to:Nebraska Forest
Service,Attn:Sandy Benson,PO Box 830815,Lincoln,NE 68583-0815.Once we have received
the signatures from the counties we will combine them into a single signature page and

seeking a recommendation by the county board to issue a class I liquor license to Southern Hills Country Club.
Chairman Hogan inquired if there was anyone wishing to speak for or against such recommendation.
Dale Schendt,a representative from Southern Hills Country Club,was present to answer any questions the
board had.
There were no members of the public present to make a comment for or against the issuance of the liquor
license.

Adams County Roads Superintendent, Dawn Miller, presented the board with an agreement with the
Nebraska Department of Transportation for a county bridge match program for Project STWD-CBMP(6). Miller
has reviewed the agreement and has met with the Adams County Road and Bridge Committee. Miller
recommended not to participate in the program as the state will only be funding$200,000.00 of a
$931,155.00 budget. Miller stated the funds the county is responsible for have not been budgeted for and
therefore is recommending to decline participation.

Whereas:Adams County is proposing a transportation project for which it would like to obtain
County Bridge Match funds;and
Whereas:Adams County understands that it must strictly follow all State and local laws,rules,
regulations,policies,and guidelines applicable to the funding of the project;and

into a new Project Program Agreement setting out the various duties and funding

Miller also presented the Board a purchase contract for gravel between Adams County and Deweese
Sand and Gravel which was awarded on March 1, 2022. Miller has reviewed the contact and is
requesting approval of the chairman's signature.

internet service to the Adams County Roads Department, Extension Office Building and the future site of the
Adams County Jail/Justice Center.Stromer stated the project would be paid for using American Rescue Plan
Act(ARPA)funds.
Deputy Attorney Bergin inquired if bids needed to be solicited for this project.
Commissioner Stromer and IT Director, Ron Kucera stated they had inquired with the Adams County Attorney
if bids were necessary and due to the "uniqueness of the project",the bidding process is not necessary.

Beth Janning with the Adams County Extension Office provided the board with an annual report from the
Extension Office. No board action was required.
Commissioner Stromer presented the board with a letter from Adams County to the City of Hastings
requesting the city consider annexing the land for the future Adams County Jail/Justice Center.
Commissioner Patterson inquired if the site could be platted in as that may be an easier process.
Adams County Planning and Zoning Director,Judy Mignery stated that it is defined in statute the process of an
entity requesting annexation from the city.
Motion by Stromer,seconded by Larsen to approved signing and submitting the letter requesting annexation

Commissioner Curtis stated that after speaking with Adams County Attorney, Donna Fegler Daiss,the
purchase would need to be sent out for bid.Curtis stated there would be no action on this item until the
bid process is completed.

REGISTERED LAND SURVEYING
THIS AGREEMENT,made and entered into by and between Adams County,Nebraska.
hereinafter referred to as the"County,"and the State of Nebraska.Department of
Transportation, hereinafter referred to as the"State,"and collectively,the"Parties."
WITNESSETH:
WHEREAS,the State has plans for the improvement of 281 from Highway Reference Post
26.79 to Highway Reference Post 40.69,under Project No. STP-281-1(119),as shown on
Exhibit"A",attached;and
WHEREAS,the Parties recognize that It shall be the duty of the county board of each county,
pursuant to Neb.Rev.Stat.§39-1708,to cause to be perpetuated the existing corners of land
surveys along the public roads and highways where such corners are liable to destruction,
either by public travel or construction or maintenance.
WHEREAS,the State desires the County provide a Registered Land Surveyor In accordance
with Neb. Rev. Stat.§39-1708 to tie out land monuments prior to the above construction and tie
and re-establish monuments after construction.
WHEREAS,"tie our shall be understood by the Parties to mean the process whereby the
surveyor identifies and perpetuates the location of a monument for the purpose of
re-establishing the monument in the event the monument is disturbed during construction.
WHEREAS."re-establish"shall be understood by the Parties to mean the process whereby the
surveyor re-positions the monument for Its preservation based on the tie-out,following
disturbance of the monument resulting from construction.
WHEREAS,the State is willing to provide full or partial reimbursement for performance of
County's duties pursuant to statute as set forth herein,with the expectation that reimbursement
shall be limited to tie-out prior to construction work,tie-out after the completion of
reconstruction,and re-establishment of monuments affected by construction;the State shall not

reimburse the County in cases in where monuments have been unaffected by construction,
rendering re-establishment of monument unnecessary.
WHEREAS. County Board has authorized the Chairperson to sign this Agreement, as
evidenced by the Resolution of County Board, as shown on Exhibit"B", attached.
WHEREAS,the County is willing to perform above referenced surveying services under the
following terms and conditions:
NOW THEREFORE, In consideration of these facts, the parties hereto agree as follows:
SECTION 1. STATUTORY OBLIGQATION. The County agrees to tie out land monuments as
necessary for the above named project prior to construction work beginning and to tie out and
re-establish monuments as necessary after construction Is completed, In accordance with Nob.
Rev. Stat. §23-1907-08 and§39-1708-10, at the location as shown on the attached Exhibit"A",
and hereby made a part of this agreement.
The County agrees to perform all work, all under the direct supervision of a Registered Land
Surveyor. Said surveying work shall be completed with 48 days of receipt of written notice of
the State's Project Manager. The County further agrees to file the survey with the County
Surveyor and/or County Clerk,with the Survey Record Repository in the State Surveyor's Office
in Lincoln and with the Deputy State Surveyor in the Right of Way Division at the Department of
Transportation' Lincoln Headquarters.
SECTION Z. REIMBURSEMENT. The State agrees to reimburse the County for the actual
cost of the work described in Section 1 above, up to a maximum cost to the State for each land
monument of$100.00 to tie out, and$100.00 to re-establish the monument. The maximum cost
to the State shall not exceed$2300 for the tie-out work and$2300 for the work performed to
re-establish the monument. The County shall prepare and submit a detailed billing of the work
completed. All billings shall be forwarded to the State's Project Manager, Wade Harris, at PO
Box 1147. Hastings. Nebraska 68902. Upon the satisfactory completion of the work,the
State will pay the County within 30 days or the completion of an audit by the State, whichever Is
later.
SECTION 4. REIMBURSEMENT EXCLUSION. The State will not reimburse post-construction
costs when no actual re-establishment of monuments has occurred, such as in those cases
whore corners have remained static, or whore monuments have boon unaffected by
construction. Reimbursement in such cases shall be limited to tie-out(if necessary)and the
County's travel expenses incidental to monument survey review/verification following the

conclusion of the State's construction project.
SECTION 4. FAIR EMPLOYMENT PRACTICES ACT
County agrees to abide by the Nebraska Fair Employment Practices Act, as provided by Nab.
Rev. Stat. §48-1101 through§48-1126.
SECTION 5.AUTHORIZATION
The Chair of the County Board is authorized to sign this Agreement, and evidenced by the
Resolution of County Board, attached as Exhibit"B", and hereby made a part of this agreement.
SECTION 6. ENTIRE AGREEMENT
This Agreement, including all exhibits and documents incorporated or included herein.
constitutes the entire agreement of the Parties. This Agreement supersedes all
communications, representations, understandings, either oral or written hereto, leading up to
this Agreement. Any existing written agreements between the Parties remain in effect, except
the language of this Agreement governs over conflicting language on the same subject in an
existing written agreement
