Motion by Stromer, seconded by Johnson that this is an open public meeting of the Adams County Board of Commissioners. Roll Call,Ayes:Stromer, Larsen, Hogan,Johnson, Reams, Neumann, Patterson Nays: None The Pledge of Allegiance was performed. Chairman Hogan inquired if there were any conflicts of interest. No conflicts of interest were stated. Adams County Historical Society Executive Director, Elizabeth Spilinek, presented each board member with a 2023 Adams County Historical Society calendar. A public comment was received by Andrea Hays,of 1309 Pershing Dr in Hastings. Ms. Hays spoke in support of today's agenda item of restoring funding to Horizon Recovery. No additional public comments were received and public comment was closed. South Heartland District Health Department(SHDHD) Director, Michele Bever, provided the annual report from the SHDHD. Adams County Highway Department Co-Superintendent, Greg Schmidt, provided the board with a preview of the proposed one and six year Adams County Road Plan.The public hearing for the road plan will be held during the next regularly scheduled board meeting on February 21, 2023 at 9:35 am. Schmidt presented the board with an agreement between Adams and Webster Counties for shared costs for the Bladen Avenue reconstruction project; Resolution 2023-02-07.01.Schmidt and the roads committee have reviewed the agreement and are requesting approval. Roll Call,Ayes:Stromer, Larsen, Hogan,Johnson, Reams, Neumann, Patterson Nays: None INTERLOCAL AGREEMENT Maintenance of Village Streets This Agreement by and between the County of Adams,Nebraska and the Village of Juniata in Adams County,Nebraska. The County of Adams,Nebraska does hereby agree to maintain specific street(s)for the Village of Juniata at the rate of$145.00 per hour as reviewed and billed biannually.Maintenance,as described in the Agreement,Is to include periodic surface maintenance by motor grader,and snow removal as necessary.This rate does ma apply to maintenance work on unpaved boundary roads. Village of Juniata is responsible for gravel,culverts,ditch work,etc.,for non-boundary roads/streets maintained by the County of Adams under this agreement. For unpaved boundary roads maintained by the County of Adams,the Village of Juniata would be responsible for road materials(gravel)and 50%of the labor and materials for work to the roadway,culverts,ditches,etc.,that would not be considered regular maintenance. In addition to the unpaved boundary roads that are the subject of this agreement,the County of Adams,Nebraska agrees to maintain the following sections of the interior roads that abut the border roads of Juniata.Said work to be completed at the same hourly rate as above. Those roads being Juniata Avenue,North of 12'"Street for approximately.21 miles;DLD Road (South Street)from Republican to Liberty for approximately.3 miles;and 8'"Street from Brass Avenue for approximately 211 feet East. No other roads will be maintained by the County of Adams unless specifically requested by the Village of Juniata and agreed upon by the County of Adams. The County of Adams agrees to maintain the unpaved boundary roads of the Village of Juniata and in exchange for the provided maintenance,the Village of Juniata agrees to be responsible for any top coating materials such as gravel. The County of Adams will notify the Village of Juniata with recommendations for road materials and the Village of Juniata can decide what amount of materials,if any,it wishes to provide for the boundary roads. It will further be the responsibility of the Village of Juniata to purchase and arrange for the delivery of road materials and to coordinate with the County of Adams for the Count's employees to spread or distribute the material on the boundary roads once delivered. This agreement is made according to the map maintained by NDOT(Nebraska Department of Transportation)and the 2022 Lane Mile Report produced by the State of Nebraska and based on the current NDOT map. It is understood by both parties,that should the Boundaries of the Village of Juniata change according to the NDOT map and the Lane Miles Report,that it could affect the roads that are maintained by the County which could also affect the amount of maintenance and materials each party is responsible for under this agreement. The Village of Juniata hereby covenants and agrees to save and hold harmless the County of Adams,its agents,and employees from all liabilities,charges,expenses,costs or claims for damages arising for any reason whatsoever under this Agreement. This Agreement shall remain in full force and effect until terminated by either party by providing thirty(30)days advance written notice of the intent to terminate said Agreement.
