Motion by Stromer,seconded by Johnson that this is an open public meeting of the Adams County Board of Commissioners. Roll Call,Ayes:Stromer, Larsen, Hogan,Johnson, Reams, Neumann, Patterson Nays: None The Pledge of Allegiance was performed. Chairman Hogan inquired if there were any conflicts of interest. Commissioner Reams stated he had a conflict with the agenda item pertaining to the possible purchase.of a vehicle for the assessor's office and would be abstaining from that vote. No public comments were made and public comment was closed. Adams County IT Director, Ron Kucera, presented the board with a memorandum of understanding between Adams County and the Administrative Office of the Courts and Probation Office,for a transfer of ownership of Adams County Courtroom video equipment. Kucera and deputy attorney Bergin reviewed the agreement and Kucera is requesting approval. Motion by Patterson, seconded by Reams to approve the MOU to transfer ownership of courtroom media equipment to Adams County. Roll Call,Ayes:Stromer, Larsen, Hogan,Johnson, Reams, Neumann, Patterson Nays: None Memorandum of Understanding Nebraska Courtroom Technology Transfer of Ownership This Memorandum of Understanding is created to facilitate transfer of audio- visual components,equipment,or full systems(equipment)to be used in courtrooms located in the Adams County courthouse. The agreement is made and entered into as of the date set forth below,by and between the Administrative Office of the Courts and Probation(AOCP)and Adams County,Nebraska(the county). Signatories to this Memorandum of Understanding recognize such technology and equipment is in excess and outside of the AOCP's statutory obligation to provide minimum standards of technology for Nebraska courtrooms per Neb.Rev.Stat.§24-514. Further,the parties understand and recognize that no payment of funds is required to complete this transfer of ownership. 134 ' Page Therefore,the above-named parties agree to the following understandings: • The AOCP will provide upgraded equipment to be used only in the county's courtroom(s). • The AOCP will facilitate installation of said equipment in the county's courtroom(s). • After installation and confirmation of working order,the AOCP will transfer ownership of all equipment to the county by Statement of Acceptance which shall include a complete inventory listing. • The AOCP will provide a five-year warranty and service plan for upgraded equipment in the county's courtroom(s),which begins on the first of the month following the substantial completion and usage of the upgraded equipment. • There is no payment of funds required to complete the transfer of ownership. • There shall be no further monetary involvement on the part of the AOCP or State of Nebraska after the county accepts ownership of the equipment. • The county understands that upon transfer,the county is the owner of the equipment and responsible for determining and acting upon all future needs for repair,maintenance,replacement,and disposal of such equipment. • The AOCP will not provide technical assistance or provide repair or maintenance for such equipment after transfer of ownership occurs. • No equipment purchased with Federal Funds will be transferred to any county. • All equipment shall become the property and responsibility of the county and will not be reclaimed by the AOCP at any future date. • The AOCP and State of Nebraska releases any legal right or claim to such equipment after transfer occurs to the county. Page135 ' g e Chairman Hogan inquired if there was anyone present wishing to speak for or against the proposed closure. John Klusman of 9545 S Brown Ave in Holstein,spoke against the closure citing that there was no traffic count done. Adams County Roads Co-Superintendent,Greg Anderson,stated only the railroad crossing would be closed and the road would remain open on either side of the crossing. Doug Pattman with Tradewell Pallet spoke in favor of the closure as it is a safety concern due to it being a blind crossing. Anderson stated the Village of Kenesaw approved the closure and the intersection would be closed by installing guardrails. Motion by Neumann, seconded by Reams to close the public hearing on the proposed railroad crossing closure. NOW,THEREFORE,BE IT RESOLVED the County Board of Adams County hereby authorizes the Chair of the County Board to sign an agreement with the State of Nebraska, Department of Transportation (NDOT),the Village of Kenesaw,and BNSF for the permanent closure and vacation of the public crossing located on N Constitution Avenue at BNSF,at DOT. No.083194L. BE IT FURTHER RESOLVED,the County will enter into such agreement with the NDOT,the Village of Kenesaw,and with the BNSF,providing that: 1. The insurance committee recommends no changes to the current health insurance plan with Blue Cross Blue Shield through the NACO group. Patterson presented the proposed rates and proposed the county contributing to an employee's dental plan at the same contribution levels as the health insurance. Motion by Patterson,seconded by Johnson to direct Deputy Attorney Bergin to draft a resolution amending the current county insurance contribution policy to include dental coverage at the same levels as health insurance. Motion by Patterson, seconded by Stromer to renew employee health insurance coverage with BCBS through the NACO group. Roll Call,Ayes:Stromer, Larsen, Hogan,Johnson, Reams, Neumann, Patterson Nays: None Adams County Attorney, Donna Fegler Daiss, addressed the board regarding the issue of receiving no applicants for the vacant Public Defender position. Fegler Daiss stated that the courts continue to appoint third party attorneys however many of these attorneys are stating they are unable to absorb anymore cases. Fegler Daiss requested direction from the board of how to proceed with operations for the office of the public defender. Commissioner Patterson,who is the personnel and insurance committee chairman, stated his committee meets with the public defender's office every week regarding office operations. The board did not have any directions for Fegler Daiss at this time.
