Scott Barwick of Juniata voiced his concerns over the rural ambulance service and the County's contract with the City of Hastings. No additional public comments were made and public comment was closed. Ruann Root, Executive Director of CASA of South Central Nebraska provided an update and submitted a budget assistance request for 2023-2024 in the amount of$38,000.00. No action was taken on Root's request as all budget requests will be considered during later budget committee meetings. Stephen R. Illingworth presented the Board with his recommendations for the Public Defender's office. Recommendations of Consultant For Public Defender and Deputies County Attorney Deputies Scope of Agreement for Consulting Services to Evaluate and Assess Public Defender's Office The purpose of this agreement is to provide recommendations including but not limited to those related to staffing requirements(both attorneys and support staff),recruitment of new personnel, compensation structure,whether staff should be full or part time,general operations of the office and processing of caseloads,to improve the administration,efficiency,and effectiveness of the office. BACKGROUND The Adams County Puolic Defender's office is presently in a crisis mode as tflere are presently no attorneys employed in the office. The last attorney recently took a position in the Hall County Public Defender's Office at a much higher salary. Remaining in the office is the Office Manager and one other temporary employee. The current staffing authorization is a Public Defender,four deputies plus support staff of an office manager,three full-time and one part-time employee. The crisis has developed over a period of time as it has been extremely difficult to recruit and retain attorneys and support staff. My investigation reveals that recruiting attorneys has failed primarily due to the noncompetitive salary and compensation offered by Adams County and substandard office space. The physical working space provided is totally physically inadequate and mentally depressing. in addition,Adams County's payment of new hires is unfair and antiquated. This report will address salary and compensation,recruitment, and replacing the location and atmosphere of the current working facility. ;will also address compensation to Deputies and staff in the County Attorney's Office as set out in the consultant contract. The County Attorney's office is also understaffed due to the compensation issues. I will also address the issue of whether the Public Defender's office should remain part time or transition to full time and remain an elected position. This report will also include recommendations on changing the Adams County's payment period and possible incentives to aid in recruitment. 205 I Page In preparing these recommendations the following people were interviewed: Persons Interviewed 1. Nebraska State Bar Association,2022 Economic Survey(portions relevant to issues for Public Defenders/County Attorneys) lune 13,2023.Article Hastings Tribune-Council oks hiring,retention bonuses for HPD officers,and dispatchers RECOMMENDATION 1 pull-or Part Time-Adams County should change from a part time Public Defender to a full-time position with no private practice permitted. Every person interviewed agreed that the position should be full-tune. It was the consensus opinion that allowing a part time private practice compromises the ability to give the position the full attention it deserves. The Public Defender snould net be torn between private practice and Public Defender duties. in addition there is no way for the County to monitor or measure how touch time the Public Defender is spending on each position. As wit be addressed in the compensation area the County wit have to substantially raise the salary if the position goes full time 2. Elected or Appointed-In taking to Public Defenders they were very clear that they would take their chances witn the electorate over an appointed position. The appointed Public Defender has oversight from a three-person policy board which would continually monitor their performance. (See R.R S.iseb.§23-3405 Attachment A-Public Defender);that situation is not attractive to perspective Public defenders I Salaries for Public Defender and Deputies-Before I recommend a salary structure the County Board needs some background as to the present situation in the in-Cities area as to the competition for Public Defender attorneys,recruiting and the present going rate necessary to hire Deputies. This situation also applies to the Adams County Attorney's Office which is short three deputies again primarily because of compensation issues. The first major part to understand is that the competitors for Adams County are Hall and Buffalo Counties.Lawyers who want to live In the Tri-cities area inquire about salaries usually in all three cities. My first inclination was to get comparative salaries from Columbus,Norfolk,and Fremont but upon further investigation found out they are riot Adam County's competition There is no need to look beyond Hail and Buffalo counties in determining how to recruit,hire and retain attorneys. In addition, the County Board has to understand that Public Defenders Offices throughout the state nave similar problems in recruiting attorneys. You have to get the right fit for your area. The week before I interviewed the Hail County Public Defender,he told me he had been at a meeting with Douglas County, Sarpy County and Lancaster County Public Defenders the prior week. Hall county and those three counties are the largest offices in the state. They too have some problems recruiting. None have the magnitude of airing problems of Adams County. The two law schools are in Lincoln and Omaha. That is one reason they have fewer problems recruiting.The majority of graduates want to stay in Lincoln or Omaha.Both the Adams County Attorney and Public Defender have interviewed graduates of both schools. They receive interest until the subject of salary comes up. There are also instances where the law graduate wants to take the job,but the spouse does not want to live in the Tri City Area. In recruiting, the new Public Defender has to sell the benefits of practicing here. You also must understand the motivation and mentality of young lawyers who want to go into cnmmal defense work. They are the most idealistic attorneys out there and are motivated to represent indigent people who have nowhere else to turn to for help. They believe in the constitution and human rights no matter your social status. 206 ' Page You also must understand they represent unpopular and difficult people,many with mental health,drug, and alcohol addictions. The public's perception is that they are just representing criminals. to contrast Deputy County Attorneys who are also very dedicated,are perceived as the attorneys wearing white hats and getting criminals off the streets. To attract the young Public Defender Attorneys,you need to show them respect and support. Their ob can be very depressing. You show them respect by paying them the going rate in the area,providing a clean,bright atmosphere to work in and paying them promptly. This is where Adams County has failed and why the County is in the position of no Public Defender attorneys at the present time. Adams County is not competitive with Hall and Buffalo Counties in three major areas. They are salary,working conditions and payroll payment method, I heard this comment from several in the past and present Public Defenders Office,staff and attorneys"that they do not feel they are supported by the County Board". Adams County has to match the salaries for new Deputy Public Defenders and Deputy County Attorneys in Hall and Buffalo Counties,or the problem persists. Hall County's most recent hire of a Deputy Public Defender was$78,000.00.per year. That hire was the last attorney out of Adams County Public Defender's office. That was a raise from her Adams County salary of$67,540.00. I next contacted the Buffalo County Public Defender's office and they had just hired an attorney fresh out of law school with no experience for 578,000.00. I was told with that hire they had filled their authoreed attorneys. As on aside when I was retiring in November of 2021 one of the bright Deputy County Attorney's in Ms.Daiss' office accepted a job in the Buffalo County Attorney's office. I asked him why he was leaving,and ne said it was because he was getting a$10,000.00 a year raise for doing the same job in Buffalo County. As to the Public Defender's salary here are the numbers for Buffalo and Hall Counties: Hall County Public Defender-$108,000.00 Buffalo County Public Defender-599,986.00 Recommended Salaries for Public Defender and Deputies for Adams County Public Defender-Salary range depending on experience and qualifications Beginning 2025-$100,000.00 to$120,000.00 The present salary as set by the Adams County Board for 2023 is$74,486.94,2024 is$75,600.00.These salaries are 3.time as tnat was the agreement with Shan Lieske(Attachment B). No one,s going to take the job at$76,600.00. The County Board should seek a legal opinion from the County Attorney as to whether more can be paid through salary and a hiring bonus until the County Board sets salaries for the 4 years after 2024. The Adams County Attorney salary is set through 2026 as follows(Attachment Cl; 2023-$102,556.06 2024-$108,709.42 2025-$115,231.99 2026-$122,145.19 Typically,County Attorneys make more than Public Defenders. I was advised by the Hall County Public Defender that Hat,Sarpy,and Lancaster Counties are the only ones in the State where they make the same salary. Recommended Deputy Starting Salaries for Adams County(No Experience) Deputy Public Defender-$73,000.00-$80,000.00 Deputy County Attorney-$73,000.40-$80,000.00 Attorneys With Prior Experience A. Devise a step plan like Hall County for Deputies where Deputy County Attorneys and Public Defenders are paid on the same step plan. (I have attached a copy of Hall County's step plan for Deputy County Attorneys and Public Defenders.i B. Give the existing Deputy County Attorneys a raise based on years of service and a new step plan. i would defer to Ms.Daiss as to appropriate raises for her present deputies. Ms.Daiss needs to provide the remaining deputies with incentives to stay. C, I also recommend if the Public Defender or County Attorney can here a Bilingual attorney you give them a hirng bonus or yearly retention bonus A bilingual attorney will save the county money on interpreter fees. Staff Office Manager with Paralegal Degree-$28.00 per hour to start. Raise the starting wage for Secretaries and support Staff Office Manager-County Attorney/Public Defender-Salary range as suggested by office holder-They do not have to be equal. It depends on qualifications and experience. 4. Present Public Defender's Office-I strongly recommend that the County Board move the Public Defender's office from its present location. I understand the County has space in the Adams County Office Building where there are windows. Some reasonable remodeling would be a tremendous upgrade. I urge the Board to compare the County Attorney's office to the Public Defenders.Visit both locations and see where you would want to work. i can absolutely assure the Board that young lawyers do not want to work In the Public Defender's present environment. Convert that space to storage because I strongly suspect it+s full of mold and it 207 ' Page has a long list of problem areas. People should not have to work in that dungeon environment. The young professional lawyers will not work there, The present location is a basement with the following problems: 1. The entire set of offices has two small windows located in one office,thus there is very little natural light. 2. The building is depressing. To enter the Public Defender's office,you have to go down steps to the basement via steps or a walkway- Even the walkway would be a challenge for a disabled person in a wheelchair. Once you enter the Public Defender's area you must talk to the staff through a window. The outer vestibule area is not heated. 3. In the winter the offices are described as freezing. if the attorneys and staff use three or more floor or space heaters the fuses blow. The staff has no control over the thermostat. 4. The office area smells especially after rain. 5- There are issues in the area that are not addressed by maintenance on a timely basis. 6. There is only one exit. This is a security Issue when the office must go into lockdown. 7. The bathrooms are substandard and bathroom stalls are not wheelchair assessable. The men's urinal overflows on a regular basis. 8. The overall electrical system is bad;running the microwave can blow a fuse. 9. There are security issues,namely one way out and a slow law enforcement response when panic buttons are pushed. 10. In the spring and summer,the offices are invaded by ants. 11. The staff and attorneys have on more than one occasion had to remove snakes from the office. 12. Maintenance has had to replace wall board due to mold. 13. The office must share space with the Election Office which has full access to the Public Defender's space,which is an issue of confidentiality. The office is referred to as the'Dungeon"by staff and attorneys. The consensus of prior attorneys,staff and remaining staff is to just give them office space commensurate with the County Attorney's office with windows and a place where a good working environment can be created. 5. Payment Period-I confirmed that Adams County has a completely antiquated and unfair procedure for paying new hires. This was a common complaint. if.a new employee is hired after the 10`'of the month,they do not receive their first paycheck until the last day of the following month. So,for example,a person hired on May 11'h does not get a paycheck until June 30,a period of 50 days. Consider a new attorney fresh out of law school. Re or she will have to rent an apartment,pay a damage deposit,pay a utility deposit,pay their living expenses,and provide for themselves for almost two months. Most law school graduates come out of law school with seven years of post-high school education and significant student loans. This means student debt for someone admitted to the Nebraska Bar between 2 and 5 years is$153,498.00 and $98,444.00 for all attorneys(See Attachment E(.Because of Adams County's new hire payment policy one past Public Defender gave a new hire a personal loan to live on until he got his first paycheck. It is not the Public Defender's responsibility to fund new Adams County hires. Buffalo and Hall County pay twice a month regardless of hire date. I strongly recommend Adams County change this poiicy. The present policy is unfair and hinders recruiting. 6. Other Considerations-Duties of Public Defender Affecting Salary and Savings for the County- By Statute the Public Defender has the following required duties pursuant to N.R.S.23-3402. (See Attachment A-Article 34 Public Defender) 1. Represent indigent felony defendants. 2. Represent indigent persons against whom a petition has been filed with the Mental Health Board. 3. Represent indigent person charged with a misdemeanor or offense punishable by imprisonment. Public Defenders are not required to represent indigent persons in Juvenile matters.Public Defenders are not required to represent indigent persons regarding child support enforcement. In the past Adams County Public Defenders have provided a great service and savings to Adams County by representing Juveniles and Child Support l-nforcement Clients which saves money on court appointed fees. In checking with Hall and Buffalo Counties they handle those areas as follows: Hall County Handles Juvenile matters as a separate division in the Public Defender's office. Do not handle Child Support Enforcement Buffalo County Do not handle Juvenile matters Handles Child Support Enforcement 208 IPage My recommendation would be to attempt to get the new Public Defender to handle both of these non- required services. It will save a great amount of money on court appointed attorneys. Effective July 1, 2023,the court-appointed rate goes up to$115.00 per hour. If the Public Defender handles the non- required areas,i believe you continue to authorize four deputies and start by filling the Public Defender position plus 3 deputies as soon as possible. if they are unable to do all the work with three fund the fourth position without hesitation. Having Public Defenders handle these areas will save the County a substantial amount of money. Even though the court appointed fees are going up several attorneys have said they will not accept court appointments. One attorney told me he had run the numbers on a system called PracticeMaster. Because of law office overhead an attorney can make a little but not a lot taking court appointments.Without question attorneys make more money on their private practice clients.The$95 per hour was set in 1993 but that rate due to inflation should be$150 in 2022. As stated above the new rate is$115.00. 7. Other Possible Benefits to Aid Recruitment-I have investigated other possible benefits the County could consider, and they include the following: Hiring and Retention,Bonuses-The Hastings City Council on Monday,June 12,2023,voted 6-1 to approve hiring bonuses ranging from$2,000.00 for a new dispatch hire with no experience to $7,500.00 for a certified police officer arid retention bonuses ranging from$3,000.00 to $6,000.00 would be paid to all current dispatchers and sworn officers. (Attachment F-Hastings Tnbune June 13,2023) Moving Expense-Some Public Defenders have been authorized by their County Boards to offer some moving expense reimbursement to further entice a lawyer to move,but this is not commonly offered. Student Loan Replacement Assistance-The Nebraska State Bar Association Economic Survey was recently published,and I have attached relevant pages as it applies to Public Defenders and County Attorneys. The number one benefit young attorneys wish their new employer would provide is student loan repayment assistance(Attachment E). tuition and the cost of attending law school has risen substantially.The County could give a year-end bonus at the completion of each year that the attorney stays employed with Adams County up to a cap of a certain amount. 8. Recruiting-The County Attorney and Public Defender have recruited at the two law schools in Nebraska namely UNL and Creighton. The County Attorney has expanded her recruitment to South Dakota. I think the Public Defender and County Attorney should be authorized to expand that to Denver University,University of Wyoming,and the law schools in Kansas and Iowa. My last Court Reporter I recruited from Kansas City. She is a Nebraska native and wanted to get back home. There are lawyers out there who would want to get Home. If they are experienced in Criminal Law,the pay must be higher than the inexperienced lawyer. In addition,the Hall County Public Defender has recently hired two deputies by going nationwide on Indeed. He said they both wanted to get back to Nebraska. The bottom line is I think both offices need a budget line with an amount set aside for recruiting. CONCLUSION Historically in Nebraska many Counties set up Public.Defenders offices to save money for the taxpayers. That has uniformly been achieved and counties save money. It is in the best interests of Adams County taxpayers to have a fully staffed Public Defender's office to provide this much needed service. Although the current situation is not good it is not impossible to remedy. As set out in these recommendations Adams County can eventually get back to full staffing within two to three years. It is a credit to the management style of Donna Fegler Daiss that her office does not have the same dire predicament but, she also needs salary and compensation raises to get her office back to full staff. The following changes need to be implemented immediately. COMPENSATION Both offices need to have significant raises to the recommended salaries set out in this report, The current step plan is outdated and needs to be revised so the Adams County Public Defender and County Attorney can be competitive in hiring lawyers. In the new step plan the existing Deputy County Attorneys should receive significant raises and the salary for new deputies with no experience should be at least$78,000.00;authorize the County Attorney and Public Defender to go as high as$80,000.00 for an exceptional fit. Staff hourly rates should be raised to a level recommended by the County Attorney and Public Defender. Until you get a Public Defender trust the County Attorney to give you recommendations. This would include a higher-level hourly rate for staff. These are professional offices, and the employees should be paid accordingly. 209 ' Page OFFICE SPACE Provide a new office location for the Public Defender's office that is at least the equal of the County Attorneys office. The present location is beyond repair,and it would be impossible to make it into an acceptable working environment. It is depressing and unsafe as set out in this report. I would suggest if there were space available in the Adams County Office Building where Probation is located,the Public Defender's office should be relocated there immediately.The County Board should commit to remodeling it to properly service the lawyers and the public. If,for instance, I was recruiting a law school graduate and they were agreeable to the salary the present Adams County Public Defenders offices would be a deal breaker. Both Buffalo and Hall County Public Defenders reported they had no issues with the workspace provided to them.
