Motion by Stromer, seconded by Larsen that this is an open public meeting of the Adams County Board of Commissioners. No conflicts of interest were stated. Chairman Hogan requested a motion to approve all consent agenda items that include: • Minutes from the July 5, 2023 meeting • Claims to be paid by the county clerk from their respective accounts • Officer reports from the county clerk and the register of deeds Commissioner Stromer stated he had a claim that he would like to request separate action on.Stromer requested action on a claim payable to Seiler& Parker for$3572.50 for a consultant report prepared by Stephen Illingworth regarding the public defenders office.The contract signed regarding such study was between Adams County and Stephen Illingworth for a maximum amount of$2000.00.The clerk's office has recommended denying this claim as the contract is not with Seiler& Parker and the amount billed is $1572.50 over the contracted amount. Chairman Neumann stated Illingworth did a "good job" and mad a motion to pay the claim as submitted. The motion was seconded by Patterson. Holiday billing may or may not be included in our annual budget estimate or standard billing rates. Overtime Overtime of 1.5 times the hourly billing rate is only billed in the following circumstances and not for scheduling issues or vacation coverage. Client will be billed for OT for coverages with 168 or less hours notice. Seasonal work positions will be billed at the Overtime Rate. Billing Frequency and Payment Terms Allied Universal®will invoice Adams County Courthouse on a weekly basis for all scheduled services for the preceding weekly period(starting on Friday and ending the following Thursday) based upon the rates listed above. All invoices are due net 30 days. District Ten Probation Office Director,Joseph Budnick, presented the board with the 2023/2024 budget for the probation office totaling$63,886.00. No action was taken on Budnick's request as all budget requests will be reviewed by the budget committee and a recommendation will be made to the board. Adams County Emergency Management Director, Ron Pughes and Assistant Director, Dawna Whitcomb, presented the board with the 2023/2024 budget for the Emergency Management Office totaling $201,640.00. No action was taken on Pughes and Whitcomb's request as all budget requests will be reviewed by the budget committee and a recommendation will be made to the board. Motion by Patterson,seconded by Stromer to meet as a Board of Equalization to review and take action on;omitted property corrections, property tax list exemptions and motor vehicle tax exemptions. WITNESSETH: WI IEREAS,each county by and through its county attorney is responsible for commencement and appearance at mental health board proceedings,when necessary,for subjects believed to be mentally ill and dangerous as defined by the Nebraska Mental Health Commitment Act(hereinafter referred to as the Act)and whose legal residence is within said county;and WHEREAS,actions pursuant to the Act require each county by and through the Clerk of the District Court to issue all notices,appointments,warrants,subpoenas,or other process in conjunction with proceedings commenced pursuant to the Act and to file and preserve all papers connected with any inquest by the mental health board;and WHEREAS,each county is responsible for the costs associated with conducting a mental health board hearing pursuant to the Act,including but not limited to the cost of convening the mental health board,ensuring a record of the proceedings,and transporting subjects to inpatient facilities,as needed,following commitment;and WHEREAS,each county is responsible for the costs associated with the appointment of counsel for any indigent person who is the subject of a petition under the Act and independent evaluations by physicians or practicing psychologists of the subject's mental condition;and WHEREAS,it is necessary for subjects who are placed in emergency protective custody pursuant to the Act by law enforcement officers located in County to be taken to an appropriate and available medical facility for evaluation as required by the Act;and WI IEREAS,the petition to commence a case under the Act may be filed in any county of the judicial district where the subject is found,or in any county of the judicial district where the alleged behavior of the subject occurred which constituted the basis for the allegation that the subject is a me tally ill and dangerous person,or in any other county as ordered by district judge for good cause;and WHEREAS,pursuant to Section 71-919 of the Nebraska Revised Statutes,expenses incurred by Adams County,on account of a mentally ill and dangerous person placed into emergency protective custody by a law enforcement agency of County shall be the responsibility of _ County;and 223 I Page WHEREAS,pursuant to Section 83-351 of the Nebraska Revised Statutes,expenses incurred by Adams County,on account of a mentally ill and dangerous person whose legal settlement is in ..__ County shall he the responsibility of - County;and WHEREAS,if it is determined that a mental health board proceeding need he commenced,following evaluation of the subject by mental health professionals,and it is more efficient and cost effective for County to enter into an agreement with Adams County for the commencement,filing,and conducting of hearings in Adams County for cases arising under the Act;and WHEREAS,subjects of mental health board proceedings must be escorted to hearings before the Mental Health Board and then,when applicable,transported to places of commitment as ordered by the Mental Health Board,and WHEREAS,the Interlocal Cooperation Act(Neb.Rev.Stat.section 13-801,et.scq.) provides that units of local government of the State of Nebraska and Nebraska State Agencies may enter into agreements for the joint and cooperative exercise of powers,privileges,or authority capable of being exercised by either agency;and WHEREAS,Neb.Rev.Stat.section 13-801 provides that any one or more public agencies may contract with any one or more public agencies to perform any governmental service,activity,or other undertaking which each public agency entering into the contract is authorized by law to pertorm;and WIIERLAS,Counties arc public agencies as defined by Neb.Rev.Stat.section 13-801; NOW,'IITEItEFORE,the Parties mutually covenant and agree as follows: I. Purpose. The purpose of this agreement shall be to provide generally fur payment of fees and expenses associated with the proceedings commenced,proceedings filed,and hearings convened wherein the subject of such action has been placed in emergency protective custody by law enforcement in County specifically as follows: (A) The commencement of mental health board proceedings by the filing of a petition as provided in the Act wherein the subject of such action has been placed in emergency protective custody by law enforcement in County and the appearance before the Mental Health Board of the Tenth Judicial District shall be carried out under the terms of this agreement by the Adams County Attorney or any duly qualified and appointed Deputy County Attorney;and (B) The issuing of all notices,appointments,warrants,subpoenas,or other process in conjunction with proceedings commenced pursuant to the Act and the filing and preservation of all papers connected with any inquest by the mental health board shall be carried out under the terms of this agreement by the Clerk of the District Court of Adams County wherein the subject of such action has been placed in emergency protective custody by law enforcement in _ County;and (C) The representation of indigent persons who are the subject of proceedings commenced pursuant to the Act,and who have been placed in emergency protective custody by law enforcement in___ __County,shall be carried out under the terms of this agreement by the Adams County Public Defender,an Adams County Deputy Public Defender,or any person duly qualified and appointed by the Adams County Public Defender,except in those cases in which the Public Defender's Office has a conflict of interest.If such a conflict does exist, a qualified and competent attorney will be appointed to represent said indigent person;and (D) The cost associated with convening the mental health board and ensuring a record of the proceedings shall be paid by _ County pursuant to the terms of this agreement. 2. Term. This agreement shall commence _,2023,and shall renew annually thereafter on January I',unless notice is provided by any Party to withdraw from this agreement. 3. Hees. County agrees to pay Adams County the following amounts for each case commenced by the Adams County Attorney's Office wherein the subject of said proceeding has been placed in emergency protective custody by law enforcement in County: COUNTY ATTORNEY: Case commenced(a petition filed)but disposed of without hearing $75.00 per ease Case commenced d(a petition filial)and disposed of with hearing Si 15.(X)per hour Case not commenced(EPC dropped) 5-0-per case CLERK OF THE DISTRICT COURT: Set up and maintain tile,issue necessary paperwork and ensure that a record of the proceedings is kept $50.00 per case MENTAL HEALTH BOARD: Cost of the hoard comprised of three members for each hearing S115.00 per hour per member 2241 Page PUBLIC DEFENDER OR APPOINTED ATTORNEY: Representation of indigent persons on cases commenced(a petition filed)but disposed of without hearing $75.00 per case Representation of indigent persons on cases commenced(a petition filed)and disposed of with hearing $115.00 per hour 4. Billing statements. Billing statements to County will be submitted by the Clerk of the District Court of Adams County on behalf of Adams County to: County Clerk of the District Court 5. Method of Payment. County agrees to remit payment to the Clerk of the District Court of Adams County at the following address within thirty(30)days of receipt of the billing statement: Clerk of the District Court of Adams County Adams County Courthouse 500 West 4th Street Suite 200 Hastings,NE 68901 6. Expenses. Adams County agrees to provide personnel,office supplies,and telephone service as typically required for the ootnmencement of these type of cases and accordingly for concluding hearings. Attorneys of the Adams County Attorney's Office and the Adams County Public Defender's Office or appointed attorneys are qualified by education,training,and experience to undertake the representation of such parties in a timely and workmanlike fashion and are licensed to practice law in the State of Nebraska. 'transportation of persons in protective custody to and from hearings,to and from the evaluation site,and to appropriate treatment facilities shall be the responsibility of County.Costs or expenses incurred by law enforcement from County in performing transportation duties or in testifying before the mental health board will be the responsibility of_ County.Should it become necessary for the Adams County Attorney to incur expenses for expert fees or other needs not customary for these types of cases,the Adams County Attorney will notify the County Clerk and County Attorney of County for prior approval of said expenses.Due to the limited time frame by which a hearing before the mental health board must be conducted, County agrees to provide direction within forty-eight(48) hours of the request;failure to act on said request within this time period will be deemed an approval of said request.Expenses of this nature which are incurred but for which prior approval has not been obtained or requested as set forth herein will not be the responsibility of County.Should the subject or the subject's counsel desire an independent professional evaluation pursuant to Neb.Rev.Stat.section 71-949,the costs associated with said evaluation shall be the responsibility of County. The costs,reasonable fees,and expenses associated with said independent evaluation shall be fixed as provided by Nebraska law. 7, Suspension and Termination of this Agreement.This agreement and any services provided for herein may be suspended or terminated by either Party for noncompliance by the other Party of any terms or conditions contained herein. Written notice of such suspension or termination shall be given to the persons set forth in paragraphs 4 and 5 listed above by certified mail and shall be effective upon receipt of said notice by the non- terminating Party. Any amounts due and owing to Adams County as of the date of suspension or termination shall be due and payable within ten(10)days of the effective date of suspension or termination of this agreement. 8. Withdrawal.Any Party may withdraw from this agreement at any time,with or without cause,upon providing to the other Party a written notice of such withdrawal given not less than sixty(60)days prior to the effective date of the withdrawal.Such notice shall be given to the persons set forth in paragraphs 4 and 5. 9. Limitations. his agreement applies only to services provided by the Adams County Attorney's Office,Adams County District Court,and the Adams County Public Defender's Office and any appointed attorneys as set forth herein and for individuals placed in emergency protective custody by law enforcement in County for evaluation as provided by Nebraska law.This agreement does not bind or imply the rendering of services by any offices outside the scope of this agreement. 10. Liability. Itis agreed that in the course of the performance of this Contract by the stated officials of Adams County,such officials or their duly appointed and qualified designee shall be acting as an agent of County. 11. Motion by Patterson, seconded by Stromer that this is an open public meeting of the Adams County Board of Commissioners. Roll Call,Ayes:Stromer, Larsen, Hogan,Johnson, Reams, Neumann, Patterson Nays: None County Assessor,Jackie Russell, presented the board with a protest form filed by Ryan and Amy Rutt protesting omitted property.Assessor Russell submitted her recommendation and findings: During our reviews of the suburban neighborhood,it was discovered that this building was not on the parcel's inventory.We reached out to the City of Hastings to see if there was a permit pulled for the erection of the structure;according to the Permit technician,there was not. The owner has provided an estimate from Carmichael Construction LLC dated 2017 to furnish materials and equipment for the erection of the steel utility building.In my review of the estimate,there were general conditions stated by Carmichael that were excluded from the cost of the estimate.The fees for the building permit,architect and engineer fees,liability insurance,and builder's risk insurance. Excluded from evidence turned in would be a bill for the water and sewer lines being trenched in or the plumbing being installed.Also,electrical lines being trenched in along with the installation of electrical outlets and lighting for a facility of that size. There is no mention of the cost to install the mezzanine,or the finished living quarters in the mezzanine or main floor of a total of 1856 square feet. i have no bill provided for the grading and preparation of the site for the building. He is only showing us what the cost of the frame and the concrete was back In 2017.The comparable buildings he has provided do not have the same components being valued.On both of the comparables, the only thing assessed is the doors. The evidence that is provided is not sufficient to prove our value is not correct.Cost does not equate to value,Just because he is showing an estimate for a building does not equate to value.With the additional finishes and components that were found on the walkthrough a change in value is not recommended.
