Commissioner Patterson stated he is leasing or ultimately purchasing a property in the areas to be discussed for removal from industrial designation. If the areas are voted on as a whole Patterson stated he would be abstaining from voting, if the properties are considered separately, he will abstain from voting on the area in which his property is present. Adams County Highway Superintendent,Greg Schmidt, informed the board that last week it was announced that the state bridge match program will include a bridge on Marian Road.The program will cover 55%of construction costs. Doran Haussler of 1532 Highland Drive, spoke regarding the agenda item relating to the release of properties from industrial designation in order for the City of Hastings to potential annex those properties. Haussler stated the agreement is between the county, city and property owners. No additional public comments were made and public comment was closed. Chairman Hogan requested a motion to approve all consent agenda items. Motion by Patterson,seconded by Stromer to approval all consent agenda items. Staff Memorandum HASTINGS DFVF.IS)PMEN I SFRVICFS To: Adams County Board of Commissioners From: Chad Bunger,AICP,CFM Director of Development Services Date: December 12,2023 Meeting Date: December 19,2023 Re: Agreement to annex two County Industrial Areas into the Hastings City Limits: • Land within Industrial Park North • Land within Industrial Park West Background Section 2-606 of the City Code of Ordinance requires that the Planning Commission review areas eligible for unilateral annexation every three years, as well as county industrial areas every two years. 2023 is the year to conduct both of these reviews. This process began on May 16, 2023, when the Planning Commission held a work session to discuss the annexation review topic and give direction on areas that the City staff should consider.At that work session,City staff identified 42 separate properties within four areas of the City to be considered for this round of reviews. The four areas are areas: along E. 26th Street and N. 2"d Avenue,the Industrial Park West Area, Industrial Park North,and the east industrial area along U.S.Highway 6,and Showboat Boulevard. the consideration of annexation. Also,during that research,it was confirmed that the properties in the Industrial Park North and Industrial Park West were designated as County Industrial Areas.However,agreements between the County, City, Hastings Economic Development Corporation, and property owners were created for these subdivisions defining when and how these properties served by City infrastructure and services and would be annexed into the City limits.' Details of the properties considered for annexation and the agreements created at the time these two areas were designated as County Industrial Areas are below.The agreements are attached. City staff,on behalf of the Mayor and City Council,is seeking concurrence that these areas should be annexed into the City,per the previous agreements. The City Council passed Resolution Number 2023-42 on December 11, 2023,to set the public hearing dates to officially consider the annexation of these areas for January 22,2024. It should be noted that the City is also considering annexing properties into the City limits that are not designated as County Industrial Areas.These areas include 8 properties along E. 26"' Street and N.2na Avenue and an industrial property off L Street.Because these properties are not part of County Industrial Areas,they are not part of the discussion today.The public hearing to consider annexing the area along E.26th Street and N.2"d Avenue is also on January 22,2023 Property Descriptions The two areas for consideration are described below. Industrial Park North The Industrial Park North area includes eleven properties.One property at 3302 Yost Avenue is several buildings that have been divided by a condominium association.This one property has 15 separate owners within the condominium association.The City owns two parcels in this area, 3305 Yost Avenue,where Fleet Maintenance and the Development Services offices are located and the detention pond and trail,on the east edge of the subdivision. In 2006, this area was designated as a County Industrial Area. As part of this designation, an agreement between the City,County,the Hastings Economic Development Corporation(HEDC), and property owners outlined when a property within this area could be annexed into the City (See attached agreement).This agreement states: (A) No public roads,roadways,easements for roads,or other public rights of way shall be deemed to be within the boundaries of the County Industrial Aera. (B) The real estate shall be subject to annexation in five annual increments,the first of which shall be eligible for annexation after the earlier of ten years after the development of the property or seventeen(17)years from the date of this order. If the annexation meets statutory criteria,annexation shall thereafter be accomplished as follows: (i) In each of the five years,the City may annex 20%of the total value of the land and improvements within the County Industrial Area. (ii) The value of each increment shall be determined by dividing the total value of the land and improvements within the County Industrial Area by five. (iii) A metes and bounds survey shall be prepared for the purpose of physically describing each increment. (iv) During the month of January in each year during which an increment is to be annexed,the County Board shall release the parcel from the County Industrial Area. (C)The ability of the City to annex the tract shall apply to the entire tract included within the County Industrial Area,and no part of the tract shall be expected from the City's right to annex. {D)Upon annexation of each increment, said increment shall be considered one tax district within the City;the remaining parcels not yet annexed shall be considered as another separate tax district outside of the City. (E) Upon the initial annexation of any increment of the tract,the City will provide police and the protection to the entire County Industrial Area. In 2015,it was determined by Adams County that the incremental annexation was inappropriate. The subsequent annexation of this area stopped. Item (B)of the agreement statement above (A)That the named real estate owner's land, buildings and appurtenances affixed thereto, shall not be subject to annexation by the City of Hastings until ten(10)years passes from the date the respective facilities start operating. (B)That after the above-mentioned time period expires,the City may then begin incremental annexation subject to the following terms and conditions: (1) Over a period of five(5)years the City may annex,in equal installments,the total value of the named property owner's real property.The value of each of the five(5)year's installments shall be determined by taking the total value prior to any annexation and dividing it by five(5).Each one fifth(1/5)value shall then be converted into lineal feet of the property owner's land and annexed each respective year. Most of the properties were annexed,per the terms of the agreement. However, in 2015,the annexation of these remaining properties stopped because the County determined that how the properties were being incrementally annexed and assessed City taxes was inappropriate. All three properties are served by the City utility services and streets or have access to public utilities. Individual Site Sheets are provided as an attachment to the Extension of Service Plan providing detailed site information and staff recommendations. Extension of Service Plan Nebraska Revised Statute 16-117(4)requires an Extension of Service Plan be created when every City Council is considering annexing adjacent land into the City limits in situations;other than the property requesting the annexation. "The plan shall (a) state the estimated cost impact of providing the services to such land,(b)state the method by which the city plans to finance the extension of services to the land and how any services already provided to the land will be maintained,(c)include a timetable for extending services to the land proposed for annexation, and(d)include a map drawn to scale clearly delineating the land proposed for annexation,the current boundaries of the city,the proposed boundaries of the city after the annexation,and the general land-use pattern in the land proposed for annexation. The City's Extension of Service Plan for these properties is attached.Generally speaking,public utilities are all present to serve these sites.The size and location of these public services do not necessitate the City extending new services or enlarging the utility mains to provide services to the existing uses in these areas. Similarly, the existing roadways provide adequate access to the properties in these areas at comparable levels of roadway services to other areas of the City of Hastings. Finally,the Hastings Fire Department or Hastings Police Department will not be required to hire new personnel,purchase new equipment,or build new facilities to maintain their level of service to these areas,if annexed. Staff Recommendation industrial Park North All of the properties in this area are connected to public utilities and gain access from City- maintained streets. This area was intended to be annexed into the City,as detailed in the agreement created before the area was designated as a County Industrial Area.Had the incremental annexation process not been stopped in 2015,most of these properties would have been annexed into the City in some manner. Additionally, The 2015 agreement intended for the area to be annexed by 2023 if development on the sites did not occur. Considering these factors,City Staff is recommending that Industrial Park North area be annexed into the City limits. Industrial Park West All of the properties in this area gain access from a City-maintained street.The properties in the Industrial Park West are all connected to public utilities.These properties were intended to be annexed into the City, per the agreement created when the area was designated as a County Industrial Area. Had the incremental annexation of the area not been halted in 2015, these properties would have already been annexed based on the age of the development on each property. Considering these factors,City Staff recommends that Industrial Park West area be annexed into the City limits. Motion by Neumann, seconded by Stromer to remove Industrial Park North and Industrial Park West from the County Industrial Area per the agreement. Motion by Neumann, seconded by Reams to approve the chairman signing the MOU and grant award presented by Kulhanek for juvenile services. Roll Call,Ayes:Stromer, Larsen, Hogan,Johnson, Reams, Neumann, Patterson Nays: None Absent: None MEMORANDUM OF UNDERSTANDING COMMUNITY-BASED JUVENILE SERVICES AID Adams County is serving as the lead organization in the assessment,distribution,and evaluation of the Nebraska Community Based Juvenile Justice Aid funding from the Nebraska Crime Commission.It is the desire of the following counties:Adams,Clay,Fillmore,Franklin,Nuckolls,and Webster to continue this arrangement for the funding requested for 2024-2025. On October 31,2001,the original four counties(Adams,Clay,Nuckolls,and Webster)agreed that Clay County should be the lead county in this funding effort to work with juveniles from ages 12-18 who are already in the juvenile justice system. Assessments were made in 42 focus groups to develop the We CAN Juvenile Services Plan during the 2001-2002.Adams County then became the lead county in 2018-2019.The Comprehensive County Juvenile Services Plan has been approved with input from the Juvenile Justice Institute,as well as representatives from each of the nine counties from the 2021-2025 plan. Virginia Long,Adams County Treasurer,serves as the fiscal agent.Katie Kulhanek,Project Director,coordinates the application,facilitates all program requests for funding from local non-profits,businesses,and individuals working with juveniles in the nine county region reports,and making contact with County Boards in each of the six counties as requested. All quarterly and annual reports are submitted for the Nebraska Crime Commission through the NJJI.An audit of all reports is conducted annually by NCC.Award period is July 1,2024-June 30,2025. This memorandum of understanding is to be signed by the County Board Chair in each of the counties in order for said county to be a part of this regional community based iuvenile services grant,for both the CB and EB funding as requested by the Youth Task Force. Highway Co-superintendent, Greg Schmidt, presented bids received for two new dump trucks.Schmidt is making the recommendation to purchase two trucks from Truck Center Companies for$186,927.00 each.
